البيهقي:١٦٣٧٧ – أَخْبَرَنَا أَبُو بَكْرٍ مُحَمَّدُ بْنُ إِبْرَاهِيمَ الْأَصْبَهَانِيُّ أنبأ أَبُو نَصْرٍ الْعِرَاقِيُّ ثنا سُفْيَانُ بْنُ مُحَمَّدٍ الْجَوْهَرِيُّ ثنا عَلِيُّ بْنُ الْحَسَنِ ثنا عَبْدُ اللهِ بْنُ الْوَلِيدِ ثنا سُفْيَانُ عَنْ حَمَّادٍ عَنْ إِبْرَاهِيمَ أَنَّ الزُّبَيْرَ وَعَلِيًّا ؓ اخْتَصَمَا فِي مَوَالٍ لِصَفِيَّةَ إِلَى عُمَرَ بْنِ الْخَطَّابِ ؓ فَقَضَى بِالْمِيرَاثِ لِلزُّبَيْرِ وَالْعَقْلِ عَلَى عَلِيٍّ ؓ وَيُذْكَرُ عَنِ الْحَسَنِ أَنَّ عُمَرَ قَالَ لِعَلِيٍّ

ؓ فِي جِنَايَةٍ جَنَاهَا عُمَرُ ؓ عَزَمْتُ عَلَيْكَ لَمَا قَسَمْتَ الدِّيَةَ عَلَى بَنِي أَبِيكَ قَالَ فَقَسَمَهَا عَلَى قُرَيْشٍ
