البيهقي:١٦٠٧٤ – أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ أنبأ الشَّافِعِيُّ أنبأ مُحَمَّدٌ هُوَ ابْنُ الْحَسَنِ أنبأ أَبُو حَنِيفَةَ عَنْ حَمَّادٍ عَنْ إِبْرَاهِيمَ النَّخَعِيِّ أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ أُتِيَ بِرَجُلٍ قَدْ قَتَلَ عَمْدًا فَأَمَرَ بِقَتْلِهِ فَعَفَا بَعْضُ الْأَوْلِيَاءِ فَأَمَرَ بِقَتْلِهِ فَقَالَ ابْنُ مَسْعُودٍ كَانَتِ النَّفْسُ لَهُمْ جَمِيعًا فَلَمَّا عَفَا هَذَا أَحْيَا النَّفْسَ فَلَا يَسْتَطِيعُ أَنْ يَأْخُذَ حَقَّهُ حَتَّى يَأْخُذَ غَيْرُهُ قَالَ فَمَا تَرَى؟ قَالَ أَرَى

أَنْ تَجْعَلَ الدِّيَةَ عَلَيْهِ فِي مَالِهِ وَتَرْفَعَ حِصَّةَ الَّذِي عَفَا فَقَالَ عُمَرُ ؓ وَأَنَا أَرَى ذَلِكَ هَذَا مُنْقَطِعٌ وَالْمَوْصُولُ قَبْلَهُ يُؤَكِّدُهُ
