[Machine] "How can I stay among you in this situation?" So we said, "We have accepted your proposal." And it was decided that the first husband would choose between friendship and his wife. Then Uthman was killed. So we went to Ali, and he decided according to what Uthman had said. He said, "The first husband was given the choice between his wife and friendship, and he chose friendship. So he took from me two thousand and from my husband two thousand, and this was his friendship that he had established for the woman." He said, "And she had a mother and children who had married after him, and she gave birth to children for her husband. So he returned her to him and to her children, and he made their father responsible for them." Abdul Wahhab said, Said and Iyyub reported from Abu al-Malih with a similar hadith, except that Iyyub said, "He made her children to their father." Qatadah used to say, "He would take the second friendship." And Qatadah reported from Al-Hasan that he said, "He would take the first friendship." This woman did not know what proof her narration was based on. If her narration is proven, it weakens the narration of Abu al-Malih from Ali, and it is transmitted in the lost category. But if this narration is true, it is about a woman whose husband had died, and the well-known narration is from Ali. We have not mentioned it, and Allah knows best.  

البيهقي:١٥٥٧٥وَقَدْ أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو مُحَمَّدٍ عُبَيْدُ بْنُ مُحَمَّدِ بْنِ مُحَمَّدِ بْنِ مَهْدِيٍّ الصَّيْدَلَانِيُّ قَالَا نا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ نا يَحْيَى بْنُ أَبِي طَالِبٍ قَالَ قَالَ أَبُو نَصْرٍ يَعْنِي عَبْدَ الْوَهَّابِ بْنَ عَطَاءٍ سَأَلْتُ سَعِيدًا عَنِ الْمَفْقُودِ فَأَخْبَرَنَا عَنْ قَتَادَةَ عَنْ أَبِي الْمَلِيحِ الْهُذَلِيِّ أَنَّهُ قَالَ بَعَثَنِي الْحَكَمُ بْنُ أَيُّوبَ إِلَى سُهَيْمَةَ بِنْتِ عُمَيْرٍ الشَّيْبَانِيَّةِ أَسْأَلُهَا فَحَدَّثَتْنِي أَنَّ زَوْجَهَا صَيْفِيَّ بْنَ قَتِيلٍ نُعِيَ لها مِنْ قَنْدَايِلَ فَتَزَوَّجَتْ بَعْدَهُ الْعَبَّاسَ بْنَ طَرِيفٍ الْقَيْسِيَّ ثُمَّ إِنَّ زَوْجَهَا الْأَوَّلَ قَدِمَ فَأَتَيْنَا عُثْمَانَ بْنَ عَفَّانَ ؓ وَهُوَ مَحْصُورٌ فَأَشْرَفَ عَلَيْنَا فَقَالَ

كَيْفَ أَقْضِي بَيْنَكُمْ وَأَنَا عَلَى هَذِهِ الْحَالِ؟ فَقُلْنَا قَدْ رَضِينَا بِقَوْلِكَ فَقَضَى أَنْ يُخَيَّرَ الزَّوْجُ الْأَوَّلُ بَيْنَ الصَّدَاقِ وَبَيْنَ امْرَأَتِهِ ثُمَّ قُتِلَ عُثْمَانُ ؓ فَأَتَيْنَا عَلِيًّا ؓ فَقَضَى بِمَا قَالَ عُثْمَانُ ؓ قَالَ خُيِّرَ الزَّوْجُ الْأَوَّلُ بَيْنَ امْرَأَتِهِ وَبَيْنَ الصَّدَاقِ فَاخْتَارَ الصَّدَاقَ فَأَخَذَ مِنِّي أَلْفَيْنِ وَمِنْ زَوْجِي أَلْفَيْنِ وَهُوَ صَدَاقُهُ الَّذِي كَانَ جَعَلَ لِلْمَرْأَةِ قَالَ وَكَانَتْ لَهُ أُمُّ وَلَدٍ قَدْ تَزَوَّجَتْ مِنْ بَعْدِهِ وَوَلَدَتْ لِزَوْجِهَا أَوْلَادًا فَرَدَّهَا عَلَيْهِ وَوَلَدَهَا وَجَعَلَ لِأَبِيهِمْ أَنْ يَفْتَكَّهُمْ قَالَ عَبْدُ الْوَهَّابِ قَالَ سَعِيدٌ وَنا أَيُّوبُ عَنْ أَبِي الْمَلِيحِ بِمِثْلِ هَذَا الْحَدِيثِ غَيْرَ أَنَّ أَيُّوبَ قَالَ قَالَ جَعَلَ أَوْلَادَهَا لِأَبِيهِمْ قَالَ وَكَانَ قَتَادَةُ يَقُولُ يَأْخُذُ الصَّدَاقَ الْآخَرَ وَعَنْ قَتَادَةَ عَنِ الْحَسَنِ أَنَّهُ قَالَ يَأْخُذُ الصَّدَاقَ الْأَوَّلَ هَذِهِ الْمَرْأَةُ لَمْ تَعْرِفْ بِمَا تُثْبِتُ بِهِ رِوَايَتَهَا هَذِهِ وَإِنْ ثَبَتَتْ تُضَعِّفْ رِوَايَةَ أَبِي الْمَلِيحِ عَنْ عَلِيٍّ ؓ مُرْسَلَةً فِي الْمَفْقُودِ فَإِنَّ هَذِهِ الرِّوَايَةَ أَنَّ ذَلِكَ كَانَ فِي امْرَأَةٍ نُعِيَ لَهَا زَوْجُهَا وَالْمَشْهُورُ عَنْ عَلِيٍّ ؓ مَا قَدَّمْنَا ذِكْرُهُ وَاللهُ أَعْلَمُ
