Bakr [Chain 2] And ʾNbʾ al-ʿAbbās b. al-Walīd from my father > al-Awzāʿī > Yaḥyá b. Abū Kathīr > Abū Salamah b. ʿAbd al-Raḥman > Abū Hurayrah ؓ > Qāl Rasūl Allāh Ṣllá

[Machine] The Messenger of Allah ﷺ said, "Do not marry a divorced woman until you have sought her permission, and do not marry a virgin until you have sought her consent." They asked, "How can her consent be obtained, O Messenger of Allah?" He said, "By her silence."  

البيهقي:١٣٦٩٩وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ إِسْحَاقُ بْنُ مُحَمَّدِ بْنِ يُوسُفَ السُّوسِيُّ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا أَبُو عُثْمَانَ سَعِيدُ بْنُ عُثْمَانَ التَّنُوخِيُّ ثنا بِشْرُ بْنُ بَكْرٍ ح قَالَ وَأنبأ الْعَبَّاسُ بْنُ الْوَلِيدِ أنبأ أَبِي قَالَا ثنا الْأَوْزَاعِيُّ ثنا يَحْيَى بْنُ أَبِي كَثِيرٍ حَدَّثَنِي أَبُو سَلَمَةَ بْنُ عَبْدِ الرَّحْمَنِ عَنْ أَبِي هُرَيْرَةَ ؓ قَالَ

قَالَ رَسُولُ اللهِ ﷺ لَا تُنْكَحُ الثَّيِّبُ حَتَّى تُسْتَأْمَرَ وَلَا تُنْكَحُ الْبِكْرُ حَتَّى تُسْتَأْذَنَ قَالُوا كَيْفَ إِذْنُهَا يَا رَسُولَ اللهِ؟ فَقَالَ الصُّمُوتُ  

أَخْرَجَهُ مُسْلِمٌ فِي الصَّحِيحِ مِنْ حَدِيثِ الْأَوْزَاعِيِّ

the Messenger of Allah said: “A previously-married woman should not be married until she is consulted, and a virgin should not be married until her consent is sought, and her consent is her silence.” (Using translation from Ibn Mājah 1871)
