[Machine] They would say the man has the right to marry off his virgin daughter without her consent, even if she is not a virgin, her father cannot marry her off without her permission.

البيهقي:١٣٦٦٧ – وَأَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدِ بْنِ يُوسُفَ الْبَغْدَادِيُّ الرَّفَّاءُ أنبأ أَبُو عَمْرٍو عُثْمَانُ بْنُ مُحَمَّدِ بْنِ بِشْرٍ ثنا إِسْمَاعِيلُ بْنُ إِسْحَاقَ ثنا إِسْمَاعِيلُ بْنُ أَبِي أُوَيْسٍ وَعِيسَى بْنُ مِينَاءَ قَالَا ثنا عَبْدُ الرَّحْمَنِ بْنُ أَبِي الزِّنَادِ عَنْ أَبِيهِ عَمَّنْ أُدْرِكَ مِنْ فُقَهَائِهِمُ الَّذِينَ يُنْتَهَى إِلَى قَوْلِهِمْ مِنْهُمْ سَعِيدُ بْنُ الْمُسَيِّبِ وَعُرْوَةُ بْنُ الزُّبَيْرِ وَالْقَاسِمُ بْنُ مُحَمَّدٍ وَأَبُو بَكْرِ بْنُ عَبْدِ الرَّحْمَنِ وَخَارِجَةُ بْنُ زَيْدِ بْنِ ثَابِتٍ وَعُبَيْدُ اللهِ بْنُ عَبْدِ اللهِ بْنِ عُتْبَةَ وَسُلَيْمَانُ بْنُ يَسَارٍ فِي مَشْيَخَةٍ جُلَّةٍ سِوَاهُمْ مِنْ نُظَرَائِهِمْ قَالَ وَرُبَّمَا اخْتَلَفُوا فِي الشَّيْءِ فَأَخَذْتُ بِقَوْلِ أَكْثَرِهِمْ قَالَ

كَانُوا يَقُولُونَ الرَّجُلُ أَحَقُّ بِإِنْكَاحِ ابْنَتِهِ الْبِكْرِ بِغَيْرِ أَمْرِهَا وَإِنْ كَانَتْ ثَيِّبًا فَلَا جَوَازَ لِأَبِيهَا فِي نِكَاحِهَا إِلَّا بِإِذْنِهَا
