Rulings announced after the conquest of Makkah
When Makkah was conquered for the Messenger of Allah ﷺ, he said, "Hold back the weapons, except Khuzaah against Banu Bakr." He gave them permission until he had prayed Asr, then he said, "Hold back the weapons." The next day, a man from Khuzaah met a man from Banu Bakr at Muzdalifah and killed him. That reached the Messenger of Allah ﷺ, so he stood to deliver an address. He said—and I saw him with his back leaning against the Kaabah—he said, "The most hostile of people toward Allah ﷻ is one who kills in the Haram, or kills someone other than the one who killed him, or kills over the vendettas of Jahiliyyah."
A man stood before him and said, "So-and-so is my son." The Messenger of Allah ﷺ said, "There is no claim of lineage in Islam. The affair of Jahiliyyah has gone. The child belongs to the bed, and for the fornicator is al-athlab." They said, "What is al-athlab?" He said, "The stone."
He said, "For the fingers there are ten each, and for wounds exposing the bone there are five each." He said: And he said, "There is no prayer after the morning prayer until the sun rises, and no prayer after Asr until the sun sets." He said, "A woman may not be married in addition to her paternal aunt nor in addition to her maternal aunt, and no gift by a woman is valid except with her husband's permission."
لَمَّا فُتِحَتْ مَكَّةُ عَلَى رَسُولِ اللهِ ﷺ قَالَ: «كُفُّوا السِّلَاحَ إِلَّا خُزَاعَةَ عَنْ بَنِي بَكْرٍ»، فَأَذِنَ لَهُمْ حَتَّى صَلَّى الْعَصْرَ، ثُمَّ قَالَ: «كُفُّوا السِّلَاحَ». فَلَقِيَ رَجُلٌ مِنْ خُزَاعَةَ رَجُلًا مِنْ بَنِي بَكْرٍ مِنْ غَدٍ بِالْمُزْدَلِفَةِ فَقَتَلَهُ، فَبَلَغَ ذَلِكَ رَسُولَ اللهِ ﷺ، فَقَامَ خَطِيبًا فَقَالَ، وَرَأَيْتُهُ وَهُوَ مُسْنِدٌ ظَهْرَهُ إِلَى الْكَعْبَةِ، قَالَ: «إِنَّ أَعْدَى النَّاسِ عَلَى اللهِ مَنْ قَتَلَ فِي الْحَرَمِ، أَوْ قَتَلَ غَيْرَ قَاتِلِهِ، أَوْ قَتَلَ بِذُحُولِ الْجَاهِلِيَّةِ».
فَقَامَ إِلَيْهِ رَجُلٌ فَقَالَ: إِنَّ فُلَانًا ابْنِي، فَقَالَ رَسُولُ اللهِ ﷺ: «لَا دَعْوَةَ فِي الْإِسْلَامِ، ذَهَبَ أَمْرُ الْجَاهِلِيَّةِ، الْوَلَدُ لِلْفِرَاشِ، وَلِلْعَاهِرِ الْأَثْلَبُ». قَالُوا: وَمَا الْأَثْلَبُ؟ قَالَ: «الْحَجَرُ».
قَالَ: «وَفِي الْأَصَابِعِ عَشْرٌ عَشْرٌ، وَفِي الْمَوَاضِحِ خَمْسٌ خَمْسٌ». قَالَ: وَقَالَ: «لَا صَلَاةَ بَعْدَ الْغَدَاةِ حَتَّى تَطْلُعَ الشَّمْسُ، وَلَا صَلَاةَ بَعْدَ الْعَصْرِ حَتَّى تَغْرُبَ الشَّمْسُ». قَالَ: «وَلَا تُنْكَحُ الْمَرْأَةُ عَلَى عَمَّتِهَا وَلَا عَلَى خَالَتِهَا، وَلَا يَجُوزُ لِامْرَأَةٍ عَطِيَّةٌ إِلَّا بِإِذْنِ زَوْجِهَا».
