[Machine] "To perform ablution with it, meaning what the fire has touched," he said. So I said to him, "I asked Sa'id bin Al-Musayyib about it, and he said, 'If you eat it, then it is good and you do not need to perform ablution for it. But if it comes out [as waste], then it is impure and you need to perform ablution for it.'" He said, "Is there anyone in this town who knows about it?" I said, "Yes, the oldest man in the Arabian Peninsula in terms of knowledge." He asked, "Who?" I said, "Ata' bin Abi Rabah." He said, "Come and bring him to me." He sent for him and he came. He said, "Jabir informed me that they ate bread and meat with Abu Bakr As-Siddiq and he prayed without performing ablution." He said, "What do you say about 'Umrah?" I said, "Jabir informed me that the Prophet ﷺ said, 'Umrah is permissible.'"  

أحمد:١٤٩٢٠حَدَّثَنَا عَفَّانُ وَبَهْزٌ قَالَا حَدَّثَنَا هَمَّامٌ قَالَ بَهْزٌ حَدَّثَنَا قَتَادَةُ قَالَ قَالَ لِي سُلَيْمَانُ بْنُ هِشَامٍ إِنَّ هَذَا يَعْنِي الزُّهْرِيَّ لَا يَدَعُنَا نَأْكُلُ شَيْئًا إِلَّا أَمَرَنَا

أَنْ نَتَوَضَّأَ مِنْهُ يَعْنِي مَا مَسَّتْهُ النَّارُ قَالَ فَقُلْتُ لَهُ سَأَلْتُ عَنْهُ سَعِيدَ بْنَ الْمُسَيِّبِ فَقَالَ إِذَا أَكَلْتَهُ فَهُوَ طَيِّبٌ لَيْسَ عَلَيْكَ فِيهِ وُضُوءٌ فَإِذَا خَرَجَ فَهُوَ خَبِيثٌ عَلَيْكَ فِيهِالْوُضُوءُ قَالَ فَهَلْ بِالْبَلَدِ أَحَدٌ؟ قَالَ قُلْتُ نَعَمْ أَقْدَمُ رَجُلٍ فِي جَزِيرَةِ الْعَرَبِ عِلْمًا قَالَ مَنْ؟ قُلْتُ عَطَاءُ بْنُ أَبِي رَبَاحٍ قَالَ بَهْزٌ فَأَرْسَلَ إِلَيْهِ فَجِيءَ بِهِ قَالَ فَبَعَثَ إِلَيْهِ فَقَالَ حَدَّثَنِي جَابِرٌ أَنَّهُمْ أَكَلُوا مَعَ أَبِي بَكْرٍ الصِّدِّيقِ خُبْزًا وَلَحْمًا فَصَلَّى وَلَمْ يَتَوَضَّأْ قَالَ قَالَ لِعَطَاءٍ مَا تَقُولُ يَعْنِي فِي الْعُمْرَى؟ قَالَ حَدَّثَنِي جَابِرٌ أَنَّ النَّبِيَّ ﷺ قَالَ الْعُمْرَى جَائِزَةٌ

Then he said, "I only see the two of you disagreeing. Is there anyone else in the town?" I said, "Yes, the oldest man in the Arabian Peninsula." He asked, "Who?" I said, "Ata." So he sent for him, and he came. Then he said, "These two have differed upon me. What do you say?" He said, "Jabir bin Abdullah told me that they ate bread and meat with Abu Bakr, then he stood up to pray without performing ablution. He asked me, 'What do you say about Al Umrah?' I said, 'Nadhr bin Anas narrated from Bashir bin Nahik from Abu Hurairah that the Prophet ﷺ said, Al Umrah is a reward.' Then Az-Zuhri said, 'It does not count as Al Umrah until it is performed with a sacrifice.' Abu Hurairah said to Ata, 'What do you say?' He said, 'Jabir bin Abdullah told me that the Messenger of Allah ﷺ said, Al Umrah is a reward.' Az-Zuhri said, 'The caliphs do not decide based on that.' Ata said, 'No, Abd al-Malik bin Marwan decided upon it in such and such a way.'"  

البيهقي:١١٩٧٨أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ مِنْ أَصْلِ كِتَابِهِ ثنا الْعَبَّاسُ بْنُ مُحَمَّدٍ الدُّورِيُّ ثنا أَبُو عُمَرَ الْحَوْضِيُّ ثنا هَمَّامٌ ثنا قَتَادَةُ قَالَ قَالَ لِي سُلَيْمَانُ بْنُ هِشَامٍ إِنَّ هَذَا لَا يَدَعُنَا يَعْنِي الزُّهْرِيَّ نَأْكُلُ شَيْئًا إِلَّا أَمَرَنَا أَنْ نَتَوَضَّأَ مِنْهُ قُلْتُ سَأَلْتُ عَنْهُ سَعِيدَ بْنَ الْمُسَيِّبِ فَقَالَ

إِذَا أَكَلْتَهُ فَهُوَ طَيِّبٌ فَلَيْسَ عَلَيْكَ فِيهِ وُضُوءٌ وَإِذَا خَرَجَ فَهُوَ خَبِيثٌ عَلَيْكَ فِيهِ الْوُضُوءُ فَقَالَ مَا أُرَاكُمَا إِلَّا قَدِ اخْتَلَفْتُمَا فَهَلْ فِي الْبَلَدِ أَحَدٌ؟ قُلْتُ نَعَمْ أَقْدَمُ رَجُلٍ فِي جَزِيرَةِ الْعَرَبِ قَالَ مَنْ؟ قُلْتُ عَطَاءٌ فَأَرْسَلَ إِلَيْهِ فَجِيءَ بِهِ فَقَالَ إِنَّ هَذَيْنِ قَدِ اخْتَلَفَا عَلَيَّ فَمَا تَقُولُ؟ قَالَ حَدَّثَنِي جَابِرُ بْنُ عَبْدِ اللهِ أَنَّهُمْ أَكَلُوا مَعَ أَبِي بَكْرٍ خُبْزًا وَلَحْمًا ثُمَّ قَامَ فَصَلَّى وَلَمْ يَتَوَضَّأْ فَقَالَ لِي مَا تَقُولُ فِي الْعُمْرَى؟ قَالَ قُلْتُ حَدَّثَنِي النَّضْرُ بْنُ أَنَسٍ عَنْ بَشِيرِ بْنِ نَهِيكٍ عَنْ أَبِي هُرَيْرَةَ أَنَّ النَّبِيَّ ﷺ قَالَ الْعُمْرَى جَائِزَةٌ قَالَ فَقَالَ الزُّهْرِيُّ إِنَّهَا لَا تَكُونُ عُمْرَى حَتَّى تُجْعَلَ لَهُ وَلِعَقِبِهِ قَالَ فَقَالَ لِعَطَاءٍ مَا تَقُولُ؟ قَالَ حَدَّثَنِي جَابِرُ بْنُ عَبْدِ اللهِ أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْعُمْرَى جَائِزَةٌ قَالَ الزُّهْرِيُّ إِنَّ الْخُلَفَاءَ لَا يَقْضُونَ بِذَلِكَ قَالَ عَطَاءٌ بَلْ قَضَى بِهِ عَبْدُ الْمَلِكِ بْنُ مَرْوَانَ فِي كَذَا وَكَذَا
