[Machine] "And it was reported to the Prophet ﷺ, and he said: 'If she willingly accepted it, then she is a servant and her mistress has the same rights (over her). And if she was forced into it, then she is free and her mistress has the same rights (over her).' Ali said: 'So I said to Sufyan, 'Indeed, Qatadah said, on the authority of Al-Hasan, on the authority of Qabeesah ibn Hurayth, on the authority of Salamah ibn Al-Muhabbiq. And Sufyan said: 'Umar said that between them (the differing narrations) there is a man or a person.' Al-Hathli said to him (meaning Abu Bakr Al-Hathli), 'Between them (the differing narrations) is Qabeesah ibn Hurayth.' Sufyan said, 'And I only know this (person) Al-Hathli, that he is from the tribe of Salamah.'  

الطبراني:٦٣٣٧حَدَّثَنَا أَبُو خَلِيفَةَ ثنا عَلِيُّ بْنُ الْمَدِينِيِّ ثنا سُفْيَانُ بْنُ عُيَيْنَةَ عَنْ عَمْرِو بْنِ دِينَارٍ عَنِ الْحَسَنِ الْبَصْرِيِّ عَنْ سَلَمَةَ بْنِ الْمُحَبِّقِ أَنَّ رَجُلًا أَتَى جَارِيَةَ امْرَأَتِهِ

وَأَنَّ ذَلِكَ رُفِعَ إِلَى النَّبِيِّ ﷺ فَقَالَ «إِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ أَمَةٌ وَلَهَا مِثْلُهَا يَعْنِي لِسَيِّدَتِهَا وَإِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَلِسَيَّدَتِهَا مِثْلُهَا» قَالَ عَلِيٌّ فَقُلْتُ لِسُفْيَانَ فَإِنَّ قَتَادَةَ يَقُولُ عَنِ الْحَسَنِ عَنْ قَبِيصَةَ بْنِ حُرَيْثٍ عَنْ سَلَمَةَ بْنِ الْمُحَبِّقِ فَقَالَ سُفْيَانُ قَالَ عَمْرٌو بَيْنَهُمَا إِنْسَانٌ أَوْ رَجُلٌ فَقَالَ لَهُ الْهُذَلِيُّ يَعْنِي أَبَا بَكْرٍ الْهُذَلِيَّ بَيْنَهُمَا قَبِيصَةُ بْنُ حُرَيْثٍ قَالَ سُفْيَانُ وَإِنَّمَا أَعْرِفُ هَذَا الْهُذَلِيَّ إِنَّهُ مِنْ قَوْمِ سَلَمَةَ
