"أيُّمَا رَجُل بَاعَ مَتَاعَهُ فَأفْلَسَ الَّذي ابْتَاعَهُ وَلَمْ يَقْبِض الَّذِي بَاعَهُ منْ ثَمِنَهِ شَيئًا فَوَجَدَ مَتَاعَهُ بِعَينِهِ فهو أحَقُّ بِهِ وَإن مَاتَ المُشْتَرَى فَصَاحِبُ المتَاع أسْوَةُ الغْرَماءِ".  

مالك، والشافعي، [عب] عبد الرازق [د] أبو داود [ق] البيهقى في السنن عن أبي بكر بن عبد الرحمن بن الحارث بن هشام مرسلًا

The Prophet ﷺ said: If a man sells (his) property and the man who buys it becomes insolvent, and the seller does not receive the price of the property he had sold, but finds his very property with him (i.e. the buyer), he is more entitled to it (than others). If the buyer dies, then the owner of the property is equal to the creditors.  

أبو داود:٣٥٢٠حَدَّثَنَا عَبْدُ اللَّهِ بْنُ مَسْلَمَةَ عَنْ مَالِكٍ عَنِ ابْنِ شِهَابٍ عَنْ أَبِي بَكْرِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ هِشَامٍ

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ أَيُّمَا رَجُلٍ بَاعَ مَتَاعًا فَأَفْلَسَ الَّذِي ابْتَاعَهُ وَلَمْ يَقْبِضِ الَّذِي بَاعَهُ مِنْ ثَمَنِهِ شَيْئًا فَوَجَدَ مَتَاعَهُ بِعَيْنِهِ فَهُوَ أَحَقُّ بِهِ وَإِنْ مَاتَ الْمُشْتَرِي فَصَاحِبُ الْمَتَاعِ أُسْوَةُ الْغُرَمَاءِ

Yahya related to me from Malik from Ibn Shihab from Abu Bakr ibn Abd ar-Rahman ibn al-Harith ibn Hisham that the Messenger of Allah ﷺ said, "Whenever a man sells wares and then the buyer becomes bankrupt and the seller has not taken any of the price and he finds some of his property intact with the buyer, he is more entitled to it than anyone else. If the buyer dies, then the seller is the same as other creditors with respect to it."
