"إِنْ مَاتَ وَلَمْ يَدَعْ وَارِثًا فَلَكَ مَالُهُ" .  

[ق] البيهقى في السنن [ض] ضياء المقدسي في مختاره رواية الأشعث بن سُوار عن الحسن أَن رجلا أتى النبى ﷺ بِرَجُل فَقَالَ: إِنِّى اشتريتُهُ وَأعْتَقْتُهُ فَمَا أمر ميرَاثِه؟ فَقَالَ إِنَّ ماتَ وَذَكَرَه. . ثم قال وهذا مرسل انتهى والأَشعث ضعيف
