0.48. Making Judgment of people keeping in view their evident actions and leaving their hidden Actions to Allah (swt)

٠.٤٨۔ باب إجراء أحكام الناس على الظاهر وسرائرهم إلى الله تعالى

(390) bukhari:25ʿAbdullāh b. Muḥammad al-Musnadī > Abū Rawḥ al-Ḥaramī b. ʿUmārah > Shuʿbah > Wāqid b. Muḥammad > Abū > Ibn ʿUmar

Messenger of Allah ﷺ said: "I have been ordered (by Allah) to fight against the people until they testify that none has the right to be worshipped but Allah and that Muhammad is Messenger of Allah ﷺ, and offer the prayers perfectly and give the obligatory charity, so if they perform that, then they save their lives and property from me except for Islamic laws and then their reckoning (accounts) will be done by Allah."  

(٣٩٠) البخاري:٢٥حَدَّثَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدٍ الْمُسْنَدِيُّ قَالَ حَدَّثَنَا أَبُو رَوْحٍ الْحَرَمِيُّ بْنُ عُمَارَةَ قَالَ حَدَّثَنَا شُعْبَةُ عَنْ وَاقِدِ بْنِ مُحَمَّدٍ قَالَ سَمِعْتُ أَبِي يُحَدِّثُ عَنِ ابْنِ عُمَرَ

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ: «أُمِرْتُ أَنْ أُقَاتِلَ النَّاسَ حَتَّى: يَشْهَدُوا أَنْ لاَ إِلَهَ إِلاَّ اللَّهُ وَأَنَّ مُحَمَّدًا رَسُولُ اللَّهِ، وَيُقِيمُوا الصَّلاَةَ، وَيُؤْتُوا الزَّكَاةَ۔ فَإِذَا فَعَلُوا ذَلِكَ، عَصَمُوا مِنِّي دِمَاءَهُمْ وَأَمْوَالَهُمْ إِلاَّ بِحَقِّ الإِسْلاَمِ، وَحِسَابُهُمْ عَلَى اللَّهِ۔»

I heard the Messenger of Allah ﷺ say: He who professed that there is no god but Allah and made a denial of everything which the people worship beside Allah, his property and blood became inviolable, an their affairs rest with Allah.  

(٣٩١) مسلم:٢٣aوَحَدَّثَنَا سُوَيْدُ بْنُ سَعِيدٍ وَابْنُ أَبِي عُمَرَ قَالاَ حَدَّثَنَا مَرْوَانُ يَعْنِيَانِ الْفَزَارِيَّ عَنْ أَبِي مَالِكٍ عَنْ أَبِيهِ قَالَ

سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ مَنْ قَالَ لاَ إِلَهَ إِلاَّ اللَّهُ وَكَفَرَ بِمَا يُعْبَدُ مِنْ دُونِ اللَّهِ حَرُمَ مَالُهُ وَدَمُهُ وَحِسَابُهُ عَلَى اللَّهِ

That Al-Miqdad bin ʿAmr Al-Kindi, who was an ally of Bani Zuhra and one of those who fought the battle of Badr together with Messenger of Allah ﷺ told him that he said to Messenger of Allah ﷺ, "Suppose I met one of the infidels and we fought, and he struck one of my hands with his sword and cut it off and then took refuge in a tree and said, "I surrender to Allah (i.e. I have become a Muslim),' could I kill him, O Messenger of Allah ﷺ, after he had said this?" Messenger of Allah ﷺ said, "You should not kill him." Al- Miqdad said, "O Messenger of Allah ﷺ! But he had cut off one of my two hands, and then he had uttered those words?" Messenger of Allah ﷺ replied, "You should not kill him, for if you kill him, he would be in your position where you had been before killing him, and you would be in his position where he had been before uttering those words."  

(٣٩٢) البخاري:٤٠١٩حَدَّثَنَا أَبُو عَاصِمٍ عَنِ ابْنِ جُرَيْجٍ عَنِ الزُّهْرِيِّ عَنْ عَطَاءِ بْنِ يَزِيدَ عَنْ عُبَيْدِ اللَّهِ بْنِ عَدِيٍّ عَنِ الْمِقْدَادِ بْنِ الأَسْوَدِ حَدَّثَنِي إِسْحَاقُ حَدَّثَنَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ بْنِ سَعْدٍ حَدَّثَنَا ابْنُ أَخِي ابْنِ شِهَابٍ عَنْ عَمِّهِ قَالَ أَخْبَرَنِي عَطَاءُ بْنُ يَزِيدَ اللَّيْثِيُّ ثُمَّ الْجُنْدَعِيُّ أَنَّ عُبَيْدَ اللَّهِ بْنَ عَدِيِّ بْنِ الْخِيَارِ أَخْبَرَهُ أَنَّ الْمِقْدَادَ بْنَ عَمْرٍو الْكِنْدِيَّ وَكَانَ حَلِيفًا لِبَنِي زُهْرَةَ وَكَانَ مِمَّنْ شَهِدَ بَدْرًا مَعَ رَسُولِ اللَّهِ ﷺ أَخْبَرَهُ

أَنَّهُ قَالَ لِرَسُولِ اللَّهِ ﷺ أَرَأَيْتَ إِنْ لَقِيتُ رَجُلاً مِنَ الْكُفَّارِ فَاقْتَتَلْنَا فَضَرَبَ إِحْدَى يَدَىَّ بِالسَّيْفِ فَقَطَعَهَا ثُمَّ لاَذَ مِنِّي بِشَجَرَةٍ فَقَالَ أَسْلَمْتُ لِلَّهِ آأَقْتُلُهُ يَا رَسُولَ اللَّهِ بَعْدَ أَنْ قَالَهَا فَقَالَ رَسُولُ اللَّهِ ﷺ لاَ تَقْتُلْهُ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّهُ قَطَعَ إِحْدَى يَدَىَّ ثُمَّ قَالَ ذَلِكَ بَعْدَ مَا قَطَعَهَا فَقَالَ رَسُولُ اللَّهِ ﷺ لاَ تَقْتُلْهُ فَإِنْ قَتَلْتَهُ فَإِنَّهُ بِمَنْزِلَتِكَ قَبْلَ أَنْ تَقْتُلَهُ وَإِنَّكَ بِمَنْزِلَتِهِ قَبْلَ أَنْ يَقُولَ كَلِمَتَهُ الَّتِي قَالَ

An ally of Bani Zuhra who took part in the battle of Badr with the Prophet, that he said, "O Allah's Apostle! If I meet an unbeliever and we have a fight, and he strikes my hand with the sword and cuts it off, and then takes refuge from me under a tree, and says, 'I have surrendered to Allah (i.e. embraced Islam),' may I kill him after he has said so?" Messenger of Allah ﷺ said, "Do not kill him." Al- Miqdad said, "But O Messenger of Allah ﷺ! He had chopped off one of my hands and he said that after he had cut it off. May I kill him?" The Prophet ﷺ said. "Do not kill him for if you kill him, he would be in the position in which you had been before you kill him, and you would be in the position in which he was before he said the sentence." The Prophet ﷺ also said to Al-Miqdad, "If a faithful believer conceals his faith (Islam) from the disbelievers, and then when he declares his Islam, you kill him, (you will be sinful). Remember that you were also concealing your faith (Islam) at Mecca before."  

(٣٩٢) البخاري:٦٨٦٥حَدَّثَنَا عَبْدَانُ حَدَّثَنَا عَبْدُ اللَّهِ حَدَّثَنَا يُونُسُ عَنِ الزُّهْرِيِّ حَدَّثَنَا عَطَاءُ بْنُ يَزِيدَ أَنَّ عُبَيْدَ اللَّهِ بْنَ عَدِيٍّ حَدَّثَهُ أَنَّ الْمِقْدَادَ بْنَ عَمْرٍو الْكِنْدِيَّ حَلِيفَ بَنِي زُهْرَةَ حَدَّثَهُ

وَكَانَ شَهِدَ بَدْرًا مَعَ النَّبِيِّ ﷺ أَنَّهُ قَالَ يَا رَسُولَ اللَّهِ إِنْ لَقِيتُ كَافِرًا فَاقْتَتَلْنَا فَضَرَبَ يَدِي بِالسَّيْفِ فَقَطَعَهَا ثُمَّ لاَذَ بِشَجَرَةٍ وَقَالَ أَسْلَمْتُ لِلَّهِ آقْتُلُهُ بَعْدَ أَنْ قَالَهَا قَالَ رَسُولُ اللَّهِ ﷺ لاَ تَقْتُلْهُ قَالَ يَا رَسُولَ اللَّهِ فَإِنَّهُ طَرَحَ إِحْدَى يَدَىَّ ثُمَّ قَالَ بَعْدَ مَا قَطَعَهَا آقْتُلُهُ قَالَ لاَ تَقْتُلْهُ فَإِنْ قَتَلْتَهُ فَإِنَّهُ بِمَنْزِلَتِكَ قَبْلَ أَنْ تَقْتُلَهُ وَأَنْتَ بِمَنْزِلَتِهِ قَبْلَ أَنْ يَقُولَ كَلِمَتَهُ الَّتِي قَالَ وَقَالَ حَبِيبُ بْنُ أَبِي عَمْرَةَ عَنْ سَعِيدٍ عَنِ ابْنِ عَبَّاسٍ قَالَ قَالَ النَّبِيُّ ﷺ لِلْمِقْدَادِ إِذَا كَانَ رَجُلٌ مُؤْمِنٌ يُخْفِي إِيمَانَهُ مَعَ قَوْمٍ كُفَّارٍ فَأَظْهَرَ إِيمَانَهُ فَقَتَلْتَهُ فَكَذَلِكَ كُنْتَ أَنْتَ تُخْفِي إِيمَانَكَ بِمَكَّةَ مِنْ قَبْلُ  

(393) bukhari:4269ʿAmr b. Muḥammad > Hushaym > Ḥuṣayn > Abū Ẓabyān > Usāmah b. Zayd > Baʿathanā

Messenger of Allah ﷺ sent us towards Al-Huruqa, and in the morning we attacked them and defeated them. I and an Ansari man followed a man from among them and when we took him over, he said, "La ilaha illal-Lah." On hearing that, the Ansari man stopped, but I killed him by stabbing him with my spear. When we returned, the Prophet ﷺ came to know about that and he said, "O Usama! Did you kill him after he had said "La ilaha ilal-Lah?" I said, "But he said so only to save himself." The Prophet ﷺ kept on repeating that so often that I wished I had not embraced Islam before that day.  

(٣٩٣) البخاري:٤٢٦٩حَدَّثَنِي عَمْرُو بْنُ مُحَمَّدٍ حَدَّثَنَا هُشَيْمٌ أَخْبَرَنَا حُصَيْنٌ أَخْبَرَنَا أَبُو ظَبْيَانَ قَالَ سَمِعْتُ أُسَامَةَ بْنَ زَيْدٍ ؓ يَقُولُ

بَعَثَنَا رَسُولُ اللَّهِ ﷺ إِلَى الْحُرَقَةِ فَصَبَّحْنَا الْقَوْمَ فَهَزَمْنَاهُمْ وَلَحِقْتُ أَنَا وَرَجُلٌ مِنَ الأَنْصَارِ رَجُلاً مِنْهُمْ فَلَمَّا غَشِينَاهُ قَالَ لاَ إِلَهَ إِلاَّ اللَّهُ فَكَفَّ الأَنْصَارِيُّ فَطَعَنْتُهُ بِرُمْحِي حَتَّى قَتَلْتُهُ فَلَمَّا قَدِمْنَا بَلَغَ النَّبِيَّ ﷺ فَقَالَ يَا أُسَامَةُ أَقَتَلْتَهُ بَعْدَ مَا قَالَ لاَ إِلَهَ إِلاَّ اللَّهُ قُلْتُ كَانَ مُتَعَوِّذًا فَمَا زَالَ يُكَرِّرُهَا حَتَّى تَمَنَّيْتُ أَنِّي لَمْ أَكُنْ أَسْلَمْتُ قَبْلَ ذَلِكَ الْيَوْمِ  

(393) bukhari:6872ʿAmr b. Zurārah > Hushaym > Ḥuṣayn > Abū Ẓabyān > Usāmah b. Zayd b. Ḥārithah > Baʿathanā

Messenger of Allah ﷺ sent us (to fight) against Al-Huraqa (one of the sub-tribes) of Juhaina. We reached those people in the morning and defeated them. A man from the Ansar and I chased one of their men and when we attacked him, he said, "None has the right to be worshipped but Allah." The Ansari refrained from killing him but I stabbed him with my spear till I killed him. When we reached (Medina), this news reached the Prophet. He said to me, "O Usama! You killed him after he had said, 'None has the right to be worshipped but Allah?"' I said, "O Messenger of Allah ﷺ! He said so in order to save himself." The Prophet ﷺ said, "You killed him after he had said, 'None has the right to be worshipped but Allah." The Prophet ﷺ kept on repeating that statement till I wished I had not been a Muslim before that day.  

(٣٩٣) البخاري:٦٨٧٢حَدَّثَنَا عَمْرُو بْنُ زُرَارَةَ حَدَّثَنَا هُشَيْمٌ حَدَّثَنَا حُصَيْنٌ حَدَّثَنَا أَبُو ظَبْيَانَ قَالَ سَمِعْتُ أُسَامَةَ بْنَ زَيْدِ بْنِ حَارِثَةَ ؓ يُحَدِّثُ قَالَ

بَعَثَنَا رَسُولُ اللَّهِ ﷺ إِلَى الْحُرَقَةِ مِنْ جُهَيْنَةَ قَالَ فَصَبَّحْنَا الْقَوْمَ فَهَزَمْنَاهُمْ قَالَ وَلَحِقْتُ أَنَا وَرَجُلٌ مِنَ الأَنْصَارِ رَجُلاً مِنْهُمْ قَالَ فَلَمَّا غَشِينَاهُ قَالَ لاَ إِلَهَ إِلاَّ اللَّهُ قَالَ فَكَفَّ عَنْهُ الأَنْصَارِيُّ فَطَعَنْتُهُ بِرُمْحِي حَتَّى قَتَلْتُهُ قَالَ فَلَمَّا قَدِمْنَا بَلَغَ ذَلِكَ النَّبِيَّ ﷺ قَالَ فَقَالَ لِي يَا أُسَامَةُ أَقَتَلْتَهُ بَعْدَ مَا قَالَ لاَ إِلَهَ إِلاَّ اللَّهُ قَالَ قُلْتُ يَا رَسُولَ اللَّهِ إِنَّمَا كَانَ مُتَعَوِّذًا قَالَ أَقَتَلْتَهُ بَعْدَ أَنْ قَالَ لاَ إِلَهَ إِلاَّ اللَّهُ قَالَ فَمَا زَالَ يُكَرِّرُهَا عَلَىَّ حَتَّى تَمَنَّيْتُ أَنِّي لَمْ أَكُنْ أَسْلَمْتُ قَبْلَ ذَلِكَ الْيَوْمِ  

(394) muslim:97Aḥmad b. al-Ḥasan b. Khirāsh > ʿAmr b. ʿĀṣim > Muʿtamir > Abū > Khālid al-Athbaj from my cousin Ṣafwān b. Muḥriz Ḥaddath > Ṣafwān b. Muḥriz > Ḥaddath > Jundab b. ʿAbdullāh al-Bajalī Baʿath > ʿAsʿas b. Salāmah Zaman Fitnah Ibn al-Zubayr

Gather some men of your family so that I should talk to them. He ('As'as) sent a messenger to them (to the members of his family). When they had assembled, Jundab came there with a yellow hooded cloak on him, He said: Talk what you were busy in talking. The talk went on by turns, till there came his (Jundab's) turn. He took off the hooded cloak from his head and said: I have come to you with no other intention but to narrate to you a hadith of your Apostle: Verily the Messenger of Allah ﷺ sent a squad of the Muslims to a tribe of the polytheists. Both the armies confronted one another. There was a man among the army of polytheists who (was so dashing that), whenever he intended to kill a man from among the Muslims, he killed him. Amongst the Muslims too was a man looking forward to (an opportunity of) his (the polytheist's) unmindfulness. He (the narrator) said: We talked that he was Usama b, Zaid. When he raised his sword, he (the soldier of the polytheists) uttered:" There is no god but Allah," but he (Usama b. Zaid) killed him. When the messenger of the glad tidings came to the Apostle ﷺ he asked him (about the events of the battle) and he informed him about the man (Usama) and what he had done He (the Prophet of Allah) called for him and asked him why he had killed him. He (Usama) said: Messenger of Allah, he struck the Muslims and killed such and such of them. And he even named some of them. (He continued): I attacked him and when he saw the sword he said: There is no god but Allah. The Messenger of Allah ﷺ said: Did you kill him? He (Usama) replied in the affirmative. He (the Holy Prophet) remarked: What would you do with:" There is no god but Allah," when he would come (before you) on the Day of Judgment? He (Usama) said: Messenger of Allah, beg pardon for me (from your Lord). He (the Holy Prophet) said: What would you do with:" There is no god but Allah" when he would come (before you) on the Day of Judgment? He (the Holy Prophet) added nothing to it but kept saying: What would you do with:" There is no god but Allah," when he would come (before you) on the Day of Judgment?  

(٣٩٤) مسلم:٩٧حَدَّثَنَا أَحْمَدُ بْنُ الْحَسَنِ بْنِ خِرَاشٍ حَدَّثَنَا عَمْرُو بْنُ عَاصِمٍ حَدَّثَنَا مُعْتَمِرٌ قَالَ سَمِعْتُ أَبِي يُحَدِّثُ أَنَّ خَالِدًا الأَثْبَجَ ابْنَ أَخِي صَفْوَانَ بْنِ مُحْرِزٍ حَدَّثَ عَنْ صَفْوَانَ بْنِ مُحْرِزٍ أَنَّهُ حَدَّثَ أَنَّ جُنْدَبَ بْنَ عَبْدِ اللَّهِ الْبَجَلِيَّ بَعَثَ إِلَى عَسْعَسِ بْنِ سَلاَمَةَ زَمَنَ فِتْنَةِ ابْنِ الزُّبَيْرِ فَقَالَ

اجْمَعْ لِي نَفَرًا مِنْ إِخْوَانِكَ حَتَّى أُحَدِّثَهُمْ فَبَعَثَ رَسُولاً إِلَيْهِمْ فَلَمَّا اجْتَمَعُوا جَاءَ جُنْدَبٌ وَعَلَيْهِ بُرْنُسٌ أَصْفَرُ فَقَالَ تَحَدَّثُوا بِمَا كُنْتُمْ تَحَدَّثُونَ بِهِ حَتَّى دَارَ الْحَدِيثُ فَلَمَّا دَارَ الْحَدِيثُ إِلَيْهِ حَسَرَ الْبُرْنُسَ عَنْ رَأْسِهِ فَقَالَ إِنِّي أَتَيْتُكُمْ وَلاَ أُرِيدُ أَنْ أُخْبِرَكُمْ عَنْ نَبِيِّكُمْ إِنَّ رَسُولَ اللَّهِ ﷺ بَعَثَ بَعْثًا مِنَ الْمُسْلِمِينَ إِلَى قَوْمٍ مِنَ الْمُشْرِكِينَ وَإِنَّهُمُ الْتَقَوْا فَكَانَ رَجُلٌ مِنَ الْمُشْرِكِينَ إِذَا شَاءَ أَنْ يَقْصِدَ إِلَى رَجُلٍ مِنَ الْمُسْلِمِينَ قَصَدَ لَهُ فَقَتَلَهُ وَإِنَّ رَجُلاً مِنَ الْمُسْلِمِينَ قَصَدَ غَفْلَتَهُ قَالَ وَكُنَّا نُحَدَّثُ أَنَّهُ أُسَامَةُ بْنُ زَيْدٍ فَلَمَّا رَفَعَ عَلَيْهِ السَّيْفَ قَالَ لاَ إِلَهَ إِلاَّ اللَّهُ فَقَتَلَهُ فَجَاءَ الْبَشِيرُ إِلَى النَّبِيِّ ﷺ فَسَأَلَهُ فَأَخْبَرَهُ حَتَّى أَخْبَرَهُ خَبَرَ الرَّجُلِ كَيْفَ صَنَعَ فَدَعَاهُ فَسَأَلَهُ فَقَالَ لِمَ قَتَلْتَهُ قَالَ يَا رَسُولَ اللَّهَ أَوْجَعَ فِي الْمُسْلِمِينَ وَقَتَلَ فُلاَنًا وَفُلاَنًا وَسَمَّى لَهُ نَفَرًا وَإِنِّي حَمَلْتُ عَلَيْهِ فَلَمَّا رَأَى السَّيْفَ قَالَ لاَ إِلَهَ إِلاَّ اللَّهُ قَالَ رَسُولُ اللَّهِ ﷺ أَقَتَلْتَهُ قَالَ نَعَمْ قَالَ فَكَيْفَ تَصْنَعُ بِلاَ إِلَهَ إِلاَّ اللَّهُ إِذَا جَاءَتْ يَوْمَ الْقِيَامَةِ قَالَ يَا رَسُولَ اللَّهِ اسْتَغْفِرْ لِي قَالَ وَكَيْفَ تَصْنَعُ بِلاَ إِلَهَ إِلاَّ اللَّهُ إِذَا جَاءَتْ يَوْمَ الْقِيَامَةِ قَالَ فَجَعَلَ لاَ يَزِيدُهُ عَلَى أَنْ يَقُولَ كَيْفَ تَصْنَعُ بِلاَ إِلَهَ إِلاَّ اللَّهُ إِذَا جَاءَتْ يَوْمَ الْقِيَامَةِ

People were (sometimes) judged by the revealing of a Divine Inspiration during the lifetime of Allah's Apostle but now there is no longer any more (new revelation). Now we judge you by the deeds you practice publicly, so we will trust and favor the one who does good deeds in front of us, and we will not call him to account about what he is really doing in secret, for Allah will judge him for that; but we will not trust or believe the one who presents to us with an evil deed even if he claims that his intentions were good.  

(٣٩٥) البخاري:٢٦٤١حَدَّثَنَا الْحَكَمُ بْنُ نَافِعٍ أَخْبَرَنَا شُعَيْبٌ عَنِ الزُّهْرِيِّ قَالَ حَدَّثَنِي حُمَيْدُ بْنُ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ أَنَّ عَبْدَ اللَّهِ بْنَ عُتْبَةَ قَالَ

سَمِعْتُ عُمَرَ بْنَ الْخَطَّابِ ؓ يَقُولُ إِنَّ أُنَاسًا كَانُوا يُؤْخَذُونَ بِالْوَحْىِ فِي عَهْدِ رَسُولِ اللَّهِ ﷺ وَإِنَّ الْوَحْىَ قَدِ انْقَطَعَ وَإِنَّمَا نَأْخُذُكُمُ الآنَ بِمَا ظَهَرَ لَنَا مِنْ أَعْمَالِكُمْ فَمَنْ أَظْهَرَ لَنَا خَيْرًا أَمِنَّاهُ وَقَرَّبْنَاهُ وَلَيْسَ إِلَيْنَا مِنْ سَرِيرَتِهِ شَىْءٌ اللَّهُ يُحَاسِبُهُ فِي سَرِيرَتِهِ وَمَنْ أَظْهَرَ لَنَا سُوءًا لَمْ نَأْمَنْهُ وَلَمْ نُصَدِّقْهُ وَإِنْ قَالَ إِنَّ سَرِيرَتَهُ حَسَنَةٌ
