malik:36-29 – Yaḥyá > Mālik > Ibn Shihāb > Sunayn Abū Jamīlah a man Min Banī Sulaym

Yahya said that Malik related from Ibn Shihab that Sunayn Abi Jamila, a man from the Banu Sulaym, found an abandoned child in the time of Umar ibn al-Khattab. Sunayn took him to Umar ibn al-Khattab. He asked, "What has induced you to take this person?" He answered, "I found him lost, so I took him.'' Umar's advisor said to him,' 'Amir al-Muminin! He is a man who does good." Umar inquired of him, "Is it so?" He replied, "Yes." Umar ibn al-Khattab said, "Go, he is free, and you have his wala' inheritance, and we will provide for him." Yahya said that he heard Malik say, "What is done in our community about an abandoned child is that he is free, and his wala' inheritance belongs to the muslims, and they inherit from him and pay his blood money."  

مالك:٣٦-٢٩ – قَالَ يَحْيَى قَالَ مَالِكٌ عَنِ ابْنِ شِهَابٍ عَنْ سُنَيْنٍ أَبِي جَمِيلَةَ رَجُلٌ مِنْ بَنِي سُلَيْمٍ

أَنَّهُ وَجَدَ مَنْبُوذًا فِي زَمَانِ عُمَرَ بْنِ الْخَطَّابِ قَالَ فَجِئْتُ بِهِ إِلَى عُمَرَ بْنِ الْخَطَّابِ فَقَالَ مَا حَمَلَكَ عَلَى أَخْذِ هَذِهِ النَّسَمَةِ فَقَالَ وَجَدْتُهَا ضَائِعَةً فَأَخَذْتُهَا فَقَالَ لَهُ عَرِيفُهُ يَا أَمِيرَ الْمُؤْمِنِينَ إِنَّهُ رَجُلٌ صَالِحٌ فَقَالَ لَهُ عُمَرُ أَكَذَلِكَ قَالَ نَعَمْ فَقَالَ عُمَرُ بْنُ الْخَطَّابِ اذْهَبْ فَهُوَ حُرٌّ وَلَكَ وَلاَؤُهُ وَعَلَيْنَا نَفَقَتُهُ

[Machine] Indeed, the Prophet ﷺ came to realize that he had gone out during the year of the Conquest, and he informed him that he had found him ostracized during the caliphate of Umar ibn al-Khattab. So he took him, and said, "This was mentioned by an informant." When Umar saw me, he said, "Perhaps you have done something wrong to cause you to take this soul?" I said, "I found it lost, so I took it." The informant said, "Indeed, he is a righteous man." Umar said, "In that case, take him, for he is free and his loyalty belongs to you, and his provision is on us."  

البيهقي:١٢١٣٤ – أَخْبَرَنَا أَبُو الْقَاسِمِ عَبْدُ الْخَالِقِ بْنُ عَلِيِّ بْنِ عَبْدِ الْخَالِقِ الْمُؤَذِّنُ ثنا أَبُو بَكْرٍ مُحَمَّدُ بْنُ أَحْمَدَ بْنِ خَنْبٍ ثنا أَبُو إِسْمَاعِيلَ التِّرْمِذِيُّ ثنا أَيُّوبُ بْنُ سُلَيْمَانَ حَدَّثَنِي أَبُو بَكْرِ بْنُ أَبِي أُوَيْسٍ حَدَّثَنِي سُلَيْمَانُ بْنُ بِلَالٍ قَالَ قَالَ يَحْيَى أَخْبَرَنِي ابْنُ شِهَابٍ أَنَّ سُنَيْنًا أَبَا جَمِيلَةَ أَخْبَرَهُ قَالَ وَنَحْنُ مَعَ سَعِيدِ بْنِ الْمُسَيِّبِ جُلُوسٌ قَالَ وَزَعَمَ أَبُو جَمِيلَةَ

أَنَّهُ أَدْرَكَ النَّبِيَّ ﷺ أَنَّهُ كَانَ خَرَجَ مَعَهُ عَامَ الْفَتْحِ فَأَخْبَرَهُ أَنَّهُ وَجَدَ مَنْبُوذًا فِي خِلَافَةِ عُمَرَ بْنِ الْخَطَّابِ ؓ فَأَخَذَهُ قَالَ فَذَكَرَ ذَلِكَ عَرِيفِيٌّ فَلَمَّا رَآنِي عُمَرُ قَالَ عَسَى الْغُوَيْرُ أَبْؤُسًا مَا حَمَلَكَ عَلَى أَخْذِكَ هَذِهِ النَّسَمَةَ؟ قَالَ قُلْتُ وَجَدْتُهَا ضَائِعَةً فَأَخَذْتُهَا فَقَالَ عَرِيفِيٌّ إِنَّهُ رَجُلٌ صَالِحٌ قَالَ كَذَلِكَ قَالَ نَعَمْ قَالَ فَاذْهَبْ بِهِ فَهُوَ حُرٌّ وَلَكَ وَلَاؤُهُ وَعَلَيْنَا نَفَقَتُهُ
