٢٤۔ كتاب الهبات

(1045) bukhari:1490ʿAbdullāh b. Yūsuf > Mālik b. Anas > Zayd b. Aslam from his father > ʿUmar

Once I gave a horse in Allah's Cause (in charity) but that person did not take care of it. I intended to buy it, as I thought he would sell it at a low price. So, I asked the Prophet ﷺ about it. He said, "Neither buy, nor take back your alms which you have given, even if the seller were willing to sell it for one Dirham, for he who takes back his alms is like the one who swallows his own vomit."  

(١٠٤٥) البخاري:١٤٩٠حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ أَخْبَرَنَا مَالِكُ بْنُ أَنَسٍ عَنْ زَيْدِ بْنِ أَسْلَمَ عَنْ أَبِيهِ قَالَ

سَمِعْتُ عُمَرَ ؓ يَقُولُ حَمَلْتُ عَلَى فَرَسٍ فِي سَبِيلِ اللَّهِ فَأَضَاعَهُ الَّذِي كَانَ عِنْدَهُ فَأَرَدْتُ أَنْ أَشْتَرِيَهُ وَظَنَنْتُ أَنَّهُ يَبِيعُهُ بِرُخْصٍ فَسَأَلْتُ النَّبِيَّ ﷺ فَقَالَ لاَ تَشْتَرِ وَلاَ تَعُدْ فِي صَدَقَتِكَ وَإِنْ أَعْطَاكَهُ بِدِرْهَمٍ فَإِنَّ الْعَائِدَ فِي صَدَقَتِهِ كَالْعَائِدِ فِي قَيْئِهِ

I gave a horse to be used in Allah's Cause, but later on I saw it being sold. I asked the Prophet ﷺ whether I could buy it. He said, "Don't buy it and don't take back your gift of charity."  

(١٠٤٦) البخاري:٢٩٧٠حَدَّثَنَا الْحُمَيْدِيُّ حَدَّثَنَا سُفْيَانُ قَالَ سَمِعْتُ مَالِكَ بْنَ أَنَسٍ سَأَلَ زَيْدَ بْنَ أَسْلَمَ فَقَالَ زَيْدٌ سَمِعْتُ أَبِي يَقُولُ قَالَ

عُمَرُ بْنُ الْخَطَّابِ ؓ حَمَلْتُ عَلَى فَرَسٍ فِي سَبِيلِ اللَّهِ فَرَأَيْتُهُ يُبَاعُ فَسَأَلْتُ النَّبِيَّ ﷺ آشْتَرِيهِ فَقَالَ لاَ تَشْتَرِهِ وَلاَ تَعُدْ فِي صَدَقَتِكَ  

(1047) bukhari:2589Muslim b. Ibrāhīm > Wuhayb > Ibn Ṭāwus from his father > Ibn ʿAbbās

The Prophet ﷺ said, "One who takes back his gift (which he has already given) is like a dog that swallows its vomit."  

(١٠٤٧) البخاري:٢٥٨٩حَدَّثَنَا مُسْلِمُ بْنُ إِبْرَاهِيمَ حَدَّثَنَا وُهَيْبٌ حَدَّثَنَا ابْنُ طَاوُسٍ عَنْ أَبِيهِ عَنِ ابْنِ عَبَّاسٍ ؓ قَالَ

قَالَ النَّبِيُّ ﷺ الْعَائِدُ فِي هِبَتِهِ كَالْكَلْبِ يَقِيءُ ثُمَّ يَعُودُ فِي قَيْئِهِ  

(1048) bukhari:2586ʿAbdullāh b. Yūsuf > Mālik > Ibn Shihāb > Ḥumayd b. ʿAbd al-Raḥman And Muḥammad b. al-Nuʿmān b. Bashīr > Umā > al-Nuʿmān b. Bashīr

that his father took him to Messenger of Allah ﷺ and said, "I have given this son of mine a slave." The Prophet asked, "Have you given all your sons the like?" He replied in the negative. The Prophet ﷺ said, "Take back your gift then."  

(١٠٤٨) البخاري:٢٥٨٦حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ أَخْبَرَنَا مَالِكٌ عَنِ ابْنِ شِهَابٍ عَنْ حُمَيْدِ بْنِ عَبْدِ الرَّحْمَنِ وَمُحَمَّدِ بْنِ النُّعْمَانِ بْنِ بَشِيرٍ أَنَّهُمَا حَدَّثَاهُ عَنِ النُّعْمَانِ بْنِ بَشِيرٍ

أَنَّ أَبَاهُ أَتَى بِهِ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ إِنِّي نَحَلْتُ ابْنِي هَذَا غُلاَمًا فَقَالَ أَكُلَّ وَلَدِكَ نَحَلْتَ مِثْلَهُ قَالَ لاَ قَالَ فَارْجِعْهُ  

(1049) bukhari:2587Ḥāmid b. ʿUmar > Abū ʿAwānah > Ḥuṣayn > ʿĀmir > al-Nuʿmān b. Bashīr / > al-Minbar > Aʿṭānī Abū ʿAṭiyyah

I heard An-Nuʿman bin Bashir on the pulpit saying, "My father gave me a gift but ʿAmra bint Rawaha (my mother) said that she would not agree to it unless he made Messenger of Allah ﷺ as a witness to it. So, my father went to Messenger of Allah ﷺ and said, 'I have given a gift to my son from ʿAmra bint Rawaha, but she ordered me to make you as a witness to it, O Messenger of Allah ﷺ!' Messenger of Allah ﷺ asked, 'Have you given (the like of it) to everyone of your sons?' He replied in the negative. Messenger of Allah ﷺ said, 'Be afraid of Allah, and be just to your children.' My father then returned and took back his gift."  

(١٠٤٩) البخاري:٢٥٨٧حَدَّثَنَا حَامِدُ بْنُ عُمَرَ حَدَّثَنَا أَبُو عَوَانَةَ عَنْ حُصَيْنٍ عَنْ عَامِرٍ قَالَ سَمِعْتُ النُّعْمَانَ بْنَ بَشِيرٍ ؓ وَهُوَ عَلَى الْمِنْبَرِ يَقُولُ أَعْطَانِي أَبِي عَطِيَّةً فَقَالَتْ

عَمْرَةُ بِنْتُ رَوَاحَةَ لاَ أَرْضَى حَتَّى تُشْهِدَ رَسُولَ اللَّهِ ﷺ فَأَتَى رَسُولَ اللَّهِ ﷺ فَقَالَ إِنِّي أَعْطَيْتُ ابْنِي مِنْ عَمْرَةَ بِنْتِ رَوَاحَةَ عَطِيَّةً فَأَمَرَتْنِي أَنْ أُشْهِدَكَ يَا رَسُولَ اللَّهِ قَالَ أَعْطَيْتَ سَائِرَ وَلَدِكَ مِثْلَ هَذَا قَالَ لاَ قَالَ فَاتَّقُوا اللَّهَ وَاعْدِلُوا بَيْنَ أَوْلاَدِكُمْ قَالَ فَرَجَعَ فَرَدَّ عَطِيَّتَهُ  

(1050) bukhari:2625Abū Nuʿaym > Shaybān > Yaḥyá > Abū Salamah > Jābir

The Prophet ﷺ gave the verdict that ʿUmra is for the one to whom it is presented.  

(١٠٥٠) البخاري:٢٦٢٥حَدَّثَنَا أَبُو نُعَيْمٍ حَدَّثَنَا شَيْبَانُ عَنْ يَحْيَى عَنْ أَبِي سَلَمَةَ عَنْ جَابِرٍ ؓ قَالَ

قَضَى النَّبِيُّ ﷺ بِالْعُمْرَى أَنَّهَا لِمَنْ وُهِبَتْ لَهُ  

(1051) bukhari:2626Ḥafṣ b. ʿUmar > Hammām > Qatādah > al-Naḍr b. Anas > Bashīr b. Nahīk > Abū Hurayrah

The Prophet ﷺ said, "ʿUmrá is permissible."  

Ata said, "Jabir narrated the same to me from the Prophet."
(١٠٥١) البخاري:٢٦٢٦حَدَّثَنَا حَفْصُ بْنُ عُمَرَ حَدَّثَنَا هَمَّامٌ حَدَّثَنَا قَتَادَةُ قَالَ حَدَّثَنِي النَّضْرُ بْنُ أَنَسٍ عَنْ بَشِيرِ بْنِ نَهِيكٍ عَنْ أَبِي هُرَيْرَةَ ؓ

عَنِ النَّبِيِّ ﷺ قَالَ: «الْعُمْرَى جَائِزَةٌ۔»  

وَقَالَ عَطَاءٌ حَدَّثَنِي جَابِرٌ عَنِ النَّبِيِّ ﷺ نَحْوَهُ
