٢٠۔ كِتَابُ الْحُدُودِ ص ٢
ذِكْرُ الْأَمْرِ بِقَتْلِ مَنْ عَادَ فِي شُرْبِ الْخَمْرِ بَعْدَ ثَلَاثِ مَرَّاتٍ فَسَكِرَ مِنْهَا
The Messenger of Allah [SAW] said: "If he becomes drunk, whip him; then if he becomes drunk, whip him; then if he becomes drunk, whip him." Then he said concerning the fourth time, "Strike his neck (i.e., kill him)." (Using translation from Nasāʾī 5662)
عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «إِذَا سَكِرَ الرَّجُلُ فَاجْلِدُوهُ ثُمَّ إِنْ سَكِرَ فَاجْلِدُوهُ ثُمَّ إِنْ سَكِرَ فَاجْلِدُوهُ ثُمَّ إِنْ سَكِرَ الرَّابِعَةَ فَاضْرِبُوا عُنُقَهُ»
ذِكْرُ وَصْفِ ضَرْبِ الْحَدِّ الَّذِي كَانَ فِي أَيَّامِ الْمُصْطَفَى ﷺ
[Machine] "The Prophet ﷺ was lashed with a whip and sandals as punishment. When Abu Bakr (may Allah be pleased with him) became the caliph, he lashed someone forty times. When Umar approached the people of the countryside and villages, his companions mentioned this to him. So Abdur Rahman said, 'Make it the lightest form of punishment'."
«أَنَّ النَّبِيَّ ﷺ جَلَدَ فِي الْحَدِّ بِالْجَرِيدِ وَالنِّعَالِ» فَلَمَّا كَانَ أَبُو بَكْرٍ رِضْوَانُ اللَّهِ عَلَيْهِ جَلَدَ أَرْبَعِينَ فَلَمَّا كَانَ عُمَرُ دَنَا النَّاسُ مِنَ الرِّيفِ وَالْقُرَى فَذُكِرَ لِأَصْحَابِهِ فَقَالَ عَبْدُ الرَّحْمَنِ «اجْعَلْهَا كَأَخَفِّ الْحُدُودِ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْحَدَّ الَّذِي وَصَفْنَاهُ كَانَ لِشَارِبِ الْخَمْرِ
[Machine] "That the Messenger of Allah ﷺ and Abu Bakr were lashed for alcohol with a whip and sandals. When Umar ibn al-Khattab became the caliph, people from the countryside and villages approached him. Umar consulted the people regarding the punishment for alcohol. Abdul Rahman ibn Awf said, 'O Amir al-Mu'minin (Commander of the Believers), whenever someone drinks it, they should be expelled. And whenever someone is expelled, they should be stoned. So we suggest that you make it the lightest of punishments.' The first person to be lashed for alcohol was Umar bin Khattab, may Allah be pleased with him, and there were eighty others after him."
«أَنَّ رَسُولَ اللَّهِ ﷺ وَأَبَا بَكْرٍ جَلَدَا فِي الْخَمْرِ بِالْجَرِيدِ وَالنِّعَالِ» فَلَمَّا قَامَ عُمَرُ بْنُ الْخَطَّابِ دَنَا النَّاسُ مِنَ الرِّيفِ وَالْقُرَى فَاسْتَشَارَ عُمَرُ النَّاسَ فِي جَلْدِ الْخَمْرِ فَقَالَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ «يَا أَمِيرَ الْمُؤْمِنِينَ مَتَى مَا يَشْرَبْهَا يُهَجَّرْ وَمَتَى مَا يُهَجَّرْ يُقْذَفْ فَنَرَى أَنْ تَجْعَلَهُ كَأَخَفِّ الْحُدُودِ» فَكَانَ أَوَّلُ مَنْ جَلَدَ فِي الْخَمْرِ ثَمَانِينَ عُمَرُ رِضْوَانُ اللَّهِ عَلَيْهِ
ذِكْرُ وَصْفِ الْعِدَّةِ الَّتِي ضَرَبَ الْمُصْطَفَى ﷺ فِي الْخَمْرِ
[Machine] "A man came to the Messenger of Allah ﷺ while having drunk alcohol, so he ordered for him to be flogged with forty lashes. Then Abu Bakr brought a man who had drunk alcohol and he did the same to him. Then Umar brought a man who had drunk alcohol and he consulted the people about it, so Abdul Rahman ibn Awf said, 'He deserves to be punished with eighty lashes.' So Umar, may Allah be pleased with him, flogged him with eighty lashes."
«أَتَى رَجُلٌ رَسُولَ اللَّهِ ﷺ وَقَدْ شَرِبَ الْخَمْرَ فَأَمَرَ بِهِ فَضُرِبَ بِنَعْلَيْنِ أَرْبَعِينَ ثُمَّ أُتِيَ أَبُو بَكْرٍ بِرَجُلٍ قَدْ شَرِبَ الْخَمْرَ فَصَنَعَ بِهِ مِثْلَ ذَلِكَ ثُمَّ أُتِيَ عُمَرُ بِرَجُلٍ قَدْ شَرِبَ الْخَمْرَ فَاسْتَشَارَ النَّاسَ فِي ذَلِكَ فَقَالَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ » أَخَفَّ الْحُدُودِ ثَمَانِينَ « فَضَرَبَهُ عُمَرُ رِضْوَانُ اللَّهِ عَلَيْهِ ثَمَانِينَ
20.4 [Machine] The answer to this is: "The semen discharge limit.
٢٠۔٤ بَابُ حَدِّ الْقَذْفِ
ذِكْرُ الْبَيَانِ بِأَنَّ الْقَاذِفَ امْرَأَتَهُ عِنْدَ عَدِمِ الشُّهُودَ الْأَرْبَعَةَ بِقَذْفِهِ إِيَّاهَا أَوْ تَلَكُّئِهِ عَنِ اللِّعَانِ يَجِبُ عَلَيْهِ الْحَدُّ لِقَذْفِهِ امْرَأَتَهُ
"The first Li'an in Islam was when Hilal bin Umayyah accused Sharik bin As-Sahma' (of committing adultery) with his wife. He came to the Prophet and told him about that. The Prophet said: '(Bring) four witnesses, otherwise (you will feel) the Hadd punishment on your back.' And he repeated that several times. Hilal said to him: 'By Allah, O Messenger of Allah! Allah, the Mighty and Sublime, knows that I am telling the truth, and Allah, the Mighty and Sublime, will certainly reveal to you that which will spare my back from the whip.' While they were like that, the Verse of Li'an was revealed to him: 'As to those who accuse their wives.' He called Hilal and he bore witness four times by Allah that he was telling the truth, and the fifth time he invoked the curse of Allah upon him if he were lying. Then he called the woman and she bore witness four times by Allah that he was lying. When it came to the fourth or fifth time, the Messenger of Allah said: 'Stop her, for it will inevitably bring the punishment of Allah upon the liar.' She hesitated until we thought that she was going to confess, then she said: 'I will not dishonor my people today.' Then she went ahead with the oath. The Messenger of Allah said: 'Wait and see. If she produces a child who is white, with straight hair and Qadiy'a eyes, then he belongs to Hilal bin Umayyah, but if she produces a child who is dark with curly hair, of average size and with narrow calves, then he belongs to Sharik bin As-Sahma'.' She produced a child who was dark with curly hair, of average size and with narrow calves. The Messenger of Allah said: 'Had not the matter been settled by the Book of Allah, I would have punished her severely.'" (Using translation from Nasāʾī 3469)
أَنَّ شَرِيكَ بْنَ سَحْمَاءَ أَقْذَفَهُ هِلَالُ بْنُ أُمَيَّةَ بِامْرَأَتِهِ فَرَفَعَهُ إِلَى النَّبِيِّ ﷺ فَقَالَ النَّبِيُّ ﷺ «يَا هِلَالُ أَرْبَعَةُ شُهُودٍ وَإِلَّا فَحَدٌّ فِي ظَهْرِكَ» قَالَ يَا رَسُولَ اللَّهِ إِنَّ اللَّهَ يَعْلَمُ أَنِّي صَادِقٌ وَلَيُنْزِلَنَّ اللَّهُ عَلَيْكَ مَا يُبَرِّئُ ظَهْرِي مِنَ الْجَلْدِ فَأَنْزَلَ اللَّهُ {وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ} إِلَى آخِرِ الْآيَةِ فَدَعَاهُ النَّبِيُّ ﷺ فَقَالَ «اشْهَدْ بِاللَّهِ إِنَّكَ لِمَنِ الصَّادِقِينَ فِيمَا رَمَيْتَهَا بِهِ مِنَ الزِّنَى» فَشَهِدَ بِذَلِكَ أَرْبَعَ شَهَادَاتٍ ثُمَّ قَالَ لَهُ فِي الْخَامِسَةِ «وَلَعْنَةُ اللَّهِ عَلَيْكَ إِنْ كُنْتَ مِنَ الْكَاذِبِينَ فِيمَا رَمَيْتَهَا بِهِ مِنَ الزِّنَى» فَفَعَلَ ثُمَّ دَعَاهَا رَسُولُ اللَّهِ ﷺ فَقَالَ «قَوْمِي اشْهَدِي بِاللَّهِ إِنَّهُ لِمَنِ الْكَاذِبِينَ فِيمَا رَمَاكَ بِهِ مِنَ الزِّنَى» فَشَهِدَتْ بِذَلِكِ أَرْبَعَ شَهَادَاتٍ ثُمَّ قَالَ لَهَا فِي الْخَامِسَةِ «وَغَضَبُ اللَّهِ عَلَيْكِ إِنْ كَانَ مِنَ الصَّادِقِينَ فِيمَا رَمَاكِ بِهِ مِنَ الزِّنَى» فَلَمَّا كَانَ فِي الرَّابِعَةِ أَوِ الْخَامِسَةِ فَسَكَتَتْ سَكْتَةً حَتَّى ظَنُّوا أَنَّهَا سَتَعْتَرِفُ ثُمَّ قَالَتْ لَا أَفْضَحُ قَوْمِي سَائِرَ الْيَوْمِ فَمَضَتْ عَلَى الْقَوْلِ فَفَرَّقَ رَسُولُ اللَّهِ ﷺ بَيْنَهُمَا وَقَالَ «انْظُرُوا إِنْ جَاءَتْ بِهِ جَعْدًا حَمْشَ السَّاقَيْنِ فَهُوَ لِشَرِيكِ بْنِ سَحْمَاءَ وَإِنْ جَاءَتْ بِهِ أَبْيَضَ سَبِطًا قَضِئَ الْعَيْنَيْنِ فَهُوَ لِهِلَالِ بْنِ أُمَيَّةَ» فَجَاءَتْ بِهِ آدَمَ جَعْدًا حَمْشَ السَّاقَيْنِ فَقَالَ رَسُولُ اللَّهِ ﷺ «لَوْلَا مَا نَزَلَ فِيهِمَا مِنْ كِتَابِ اللَّهِ لَكَانَ لِي وَلَهُمَا شَأْنٌ»
20.5 [Machine] Punishment
٢٠۔٥ بَابُ التَّعْزِيرِ
ذِكْرُ الْإِخْبَارِ عَمَّا يَجِبُ عَلَى الْأُمَرَاءِ مِنَ الْجَلْدِ فِي تَأْدِيبِ مَنْ أَسَاءَ مِنَ الرَّعِيَّةِ فِيمَا دُونَ حَدٍّ مِنَ الْحُدُودِ
[Machine] I heard the Messenger of Allah ﷺ saying, "There is no punishment of more than ten lashes for anything below the prescribed limits of Allah's punishments."
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «لَا جَلْدَ فَوْقَ عَشْرَةِ أَسْوَاطٍ فِيمَا دُونَ حَدٍّ مِنْ حُدُودِ اللَّهِ»
ذِكْرُ الزَّجْرِ عَنْ أَنْ يُجْلَدَ فِي غَيْرِ الْحُدُودِ الْمُسْلِمُونَ أَكْثَرَ مِنْ عَشْرَةِ أَسْوَاطٍ
I heard the Prophet ﷺ saying, "Do not flog anyone more than ten stripes except if he is involved in a crime necessitating Allah's legal Punishment." (Using translation from Bukhārī 6850)
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «لَا يُجْلَدُ فَوْقَ عَشْرَةِ أَسْوَاطٍ إِلَّا فِي حَدٍّ مِنْ حُدُودِ اللَّهِ»
20.6 [Machine] The limit of theft
٢٠۔٦ بَابُ حَدِّ السَّرِقَةِ
ذِكْرُ نَفْيِ اسْمِ الْإِيمَانِ عَنِ السَّارِقِ وَشَارِبِ الْخَمْرِ فِي وَقْتِ ارْتِكَابِهِمَا الْفِعْلَيْنِ الْمَنْهِيِّ عَنْهُمَا
When one commits fornication, one is not a believer ; when one steals, one is not a believer ; when one drinks, one is not a believer ; and repentance is placed before him. (Using translation from Abū Dāʾūd 4689)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَسْرِقُ السَّارِقُ حِينَ يَسْرِقُ وَهُوَ مُؤْمِنٌ وَلَا يَشْرَبُ الْخَمْرَ حِينَ يَشْرَبُهَا وَهُوَ مُؤْمِنٌ وَلَكِنْ أَبْوَابُ التَّوْبَةِ مَعْرُوضَةٌ»
ذِكْرُ الْخَبَرِ الْمُفَسِّرِ لِقَوْلِهِ جَلَّ وَعَلَا: {وَالسَّارِقُ وَالسَّارِقَةُ فَاقْطَعُوا أَيْدِيَهُمَا}
"The hand of the thief is to be cut off for a quarter of a Dinar, or more." (Using translation from Nasāʾī 4917)
عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «تُقْطَعُ يَدُ السَّارِقِ فِي رُبْعِ دِينَارٍ فَصَاعِدًا»
ذِكْرُ نَفْيِ الْقَطْعِ عَنِ الْمُنْتَهِبِ، وَإِنْ كَانَ ذَلِكَ الشَّيْءُ رُبْعَ دِينَارٍ فَصَاعِدًا
[Machine] The Messenger of Allah ﷺ said, "There is no cutting off on a path, and whoever cuts off, it is not of us." "Abu Al-Zubayr, his name is Muhammad ibn Tadrus Al-Makki."
قَالَ رَسُولُ اللَّهِ ﷺ «لَيْسَ عَلَى مُنْتَهِبٍ قَطْعٌ وَمَنِ انْتَهَبَ نُهْبَةً فَلَيْسَ مِنَّا» «أَبُو الزُّبَيْرِ اسْمُهُ مُحَمَّدُ بْنُ تَدْرُسَ الْمَكِّيُّ»
ذِكْرُ الْعَدَدِ الْمَحْصُورِ الَّذِي اسْتُثْنِيَ مِنْهُ مَا ذَكَرْنَاهُ
The prophet ﷺ used to cut off a thief’s hand for a quarter of a dinar and upwards. (Using translation from Abū Dāʾūd 4383)
«أَنَّ النَّبِيَّ ﷺ كَانَ يَقْطَعُ فِي رُبْعِ دِينَارٍ فَصَاعِدًا»
ذِكْرُ الْحَدِّ الَّذِي يُقْطَعُ السَّارِقُ إِذَا سَرَقَ مِثْلَهُ، أَوْ يَقُومُ مَقَامَهُ
"The hand of the thief is to be cut off for a quarter of a Dinar, or more." (Using translation from Nasāʾī 4917)
عَنْ رَسُولِ اللَّهِ ﷺ أَنَّهُ قَالَ «تُقْطَعُ يَدُ السَّارِقِ فِي رُبْعِ دِينَارٍ فَصَاعِدًا»
ذِكْرُ الْحُكْمِ فِيمَنْ سَرَقَ مِنَ الْحِرْزِ مَا قِيمَتُهُ ثَلَاثَةُ دَرَاهِمَ
“The Prophet ﷺ cut off (the hand of a thief) for a shield worth three Dirham.” (Using translation from Ibn Mājah 2584)
«قَطَعَ رَسُولُ اللَّهِ ﷺ فِي مِجَنٍّ قِيمَتُهُ ثَلَاثَةُ دَرَاهِمَ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْقَطْعَ الَّذِي وَصَفْنَاهُ فِي رُبْعِ دِينَارٍ لَيْسَ بِحَدٍّ لَا يُقْطَعُ فِيمَنْ سَرَقَ أَكْثَرَ مِنْهُ
"It has not been too long and I have not forgotten yet. Cutting off (the hand of the thief) is for one-quarter of a Dinar or more." (Using translation from Nasāʾī 4927)
أَنَّ عَائِشَةَ زَوْجَ النَّبِيِّ ﷺ قَالَتْ «مَا طَالَ عَلَيَّ وَلَا نَسِيتُ الْقَطْعَ فِي رُبْعِ دِينَارٍ فَصَاعِدًا»
ذِكْرُ صَرْفِ الدِّينَارِ الَّذِي كَانَ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ
[Machine] We were informed by Al-Qa'nabi, who said that Malik narrated from Nafi' who narrated from Ibn Umar, who said, "The Prophet ﷺ cut a male camel that was worth three dirhams."
«قَطَعَ النَّبِيُّ ﷺ فِي مِجَنٍّ قِيمَتُهُ ثَلَاثَةُ دَرَاهِمَ
ذِكْرُ بَعْضِ الْعَدَدِ الْمَحْصُورِ الْمُسْتَثْنَى مِنْ جُمْلَتِهِ الْخَارِجَ حُكْمُهُ مِنْ حُكْمِهِ
[Machine] A boy stole a grenade from a wall and it was brought to Marwan. He ordered to cut it. Rafi bin Khadijah said, "The Prophet ﷺ said, 'There should be no cutting in fruit or in abundance.'"
أَنَّ غُلَامًا سَرَقَ وَدِيًّا مِنْ حَائِطٍ فَرُفِعَ إِلَى مَرْوَانَ فَأَمَرَ بِقَطْعِهِ فَقَالَ رَافِعُ بْنُ خَدِيجٍ إِنَّ النَّبِيَّ ﷺ قَالَ «لَا قَطَعَ فِي ثَمَرٍ وَلَا كَثَرٍ»
20.6.4 Subsection
٢٠۔٦۔٤ ذِكْرُ نَفْيِ الْقَطْعِ عَنِ الْمُنْتَهِبِ مَا لَيْسَ لَهُ
“The hand of the one who betrays a trust, the robber and the pilferer is not to be cut off”. (Using translation from Ibn Mājah 2591)
أَنَّ النَّبِيَّ ﷺ قَالَ «لَيْسَ عَلَى مُنْتَهِبٍ وَلَا مُخْتَلِسٍ وَلَا خَائِنٍ قَطْعٌ»
That the Prophet ﷺ said: "There is no cutting of the hand for the traitor, or the embezzler, nor the plunderer." (Using translation from Tirmidhī 1448)
عَنِ النَّبِيِّ ﷺ قَالَ «لَيْسَ عَلَى الْمُخْتَلِسِ وَلَا عَلَى الْخَائِنِ قَطْعٌ»
20.6.10 Subsection
٢٠۔٦۔١٠ ذِكْرُ نَفْيِ إِيجَابِ الْقَطْعِ عَنِ السَّارِقِ الَّذِي يَسْرِقُ أَقَلَّ مِنْ رُبْعِ دِينَارٍ
she heard the Messenger of Allah say: "The hand of the thief is not be cut off except for one-quarter of a Dinar or more." (Using translation from Nasāʾī 4928)
أَنَّهَا سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «لَا تُقْطَعُ يَدُ السَّارِقِ إِلَّا فِي رُبْعِ دِينَارٍ فَصَاعِدًا»
“Do not cut off (the thief's hand) except for something worth one quarter of a Dinar or more (Using translation from Ibn Mājah 2585)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا قَطَعَ إِلَّا فِي رُبْعِ دِينَارٍ فَصَاعِدًا»
20.7 [Machine] Road closures
٢٠۔٧ بَابُ قَطْعِ الطَّرِيقِ
ذِكْرُ الْبَيَانِ بِأَنَّ الْمُصْطَفَى ﷺ بَعَثَ فِي طَلَبِ الْعُرَنِيِّينَ قَافَةً يَقْفُو آثَارَهُمْ
Some people from 'Ukl came to the Prophet [SAW] but the climate of Al-Madinah did not suit them. The Prophet [SAW] told them to go to the camels that had been given in Sadaqah and drink some of their milk and urine. They did that, then they killed their herdsman and drove off the camels. The Prophet [SAW] sent (men) after them, and they were brought to him. He had their hands and feet cut off, and their eyes gouged out, and he did not have (their wounds) cauterized, and he left them to die. Then Allah, the Mighty and Sublime, revealed: "The recompense of those who wage war against Allah and His Messenger." (Using translation from Nasāʾī 4025)
قَدِمَ ثَمَانِيَةُ نَفَرٍ مِنْ عُكْلٍ عَلَى رَسُولِ اللَّهِ ﷺ فَاجْتَوَوَا الْمَدِينَةَ «فَأَمَرَ بِهِمْ رَسُولُ اللَّهِ ﷺ أَنْ يَأْتُوا إِبِلَ الصَّدَقَةِ فَيَشْرَبُوا مِنْ أَلْبَانِهَا وَأَبْوَالِهَا» فَفَعَلُوا فَقَتَلُوا الرَّاعِيَ وَاسْتَاقُوا الْإِبِلَ «فَبَعَثَ رَسُولُ اللَّهِ ﷺ فِي طَلَبِهِمْ قَافَةً فَأُتِيَ بِهِمْ فَقَطَعَ أَيْدِيَهُمْ وَأَرْجُلَهُمْ وَسَمَّرَ أَعْيُنَهُمْ وَتَرَكَهُمْ وَلَمْ يَحْسِمْهُمْ»
ذِكْرُ الْمُدَّةِ الَّتِي رَدَّ الْقَوْمُ الَّذِي ذَكَرْنَاهُمْ فِيهَا إِلَى الْمَدِينَةِ
A group of people from ʿUkl (or ʿUraina) tribe ----but I think he said that they were from ʿUkl came to Medina and (they became ill, so) the Prophet ﷺ ordered them to go to the herd of (Milch) she-camels and told them to go out and drink the camels' urine and milk (as a medicine). So they went and drank it, and when they became healthy, they killed the shepherd and drove away the camels. This news reached the Prophet ﷺ early in the morning, so he sent (some) men in their pursuit and they were captured and brought to the Prophet ﷺ before midday. He ordered to cut off their hands and legs and their eyes to be branded with heated iron pieces and they were thrown at Al-Harra, and when they asked for water to drink, they were not given water. (Abu Qilaba said, "Those were the people who committed theft and murder and reverted to disbelief after being believers (Muslims), and fought against Allah and His Apostle"). عُكْلٍ قَدِمُوا الْمَدِينَةَ «فَأَمَرَ لَهُمُ النَّبِيُّ ﷺ بِلِقَاحٍ وَأَمَرَهُمْ أَنْ يَخْرُجُوا فَيَشْرَبُوا مِنْ أَبْوَالِهَا وَأَلْبَانِهَا» فَشَرِبُوا حَتَّى إِذَا بَرِؤُوا قَتَلُوا الرَّاعِيَ وَاسْتَاقُوا النَّعَمَ فَبَلَغَ النَّبِيَّ ﷺ غُدْوَةً فَبَعَثَ الطَّلَبَ فِي أَثَرِهِمْ فَمَا ارْتَفَعَ النَّهَارُ حَتَّى جِيءَ بِهِمْ «فَأَمَرَ بِهِمْ فَقَطَعَ أَيْدِيَهُمْ وَأَرْجُلَهُمْ وَسَمَّرَ أَعْيُنَهُمْ فَأُلْقُوا بِالْحَرَّةِ يَسْتَسْقُونَ فَلَا يَسْقُونَ» قَالَ أَبُو قِلَابَةَ «هَؤُلَاءِ قَوْمٌ سَرَقُوا وَقَتَلُوا وَكَفَرُوا بَعْدَ إِيمَانِهِمْ وَحَارَبُوا اللَّهَ وَرَسُولَهُ»
ذِكْرُ الْمُدَّةِ الَّتِي جِيءَ فِيهَا بِالْعُرَنِيِّينَ إِلَى رَسُولِ اللَّهِ ﷺ
Some people of ‘Ukl or ‘Urainah’ came to the Messenger of Allah ﷺ and found Madinah unhealthy. So the Messenger of Allah ﷺ ordered them to go to the camels (of the sadaqah) and ordered them to drink some of their urine and milk. They went there when they became well, they killed the herdsman of the Messenger of Allah ﷺ and drove off the camels. The news about them reached the prophet ﷺ early in the morning. So he sent people in pursuit of them, and they were brought when they day had risen high. He ordered and their hands and feet were cut off and nails were drawn into their eyes, and they were thrown out of Harrah. They begged for water but were not supplied water. Abu Qilabah said: They were people who had stolen, killed, apostatized after their faith and fought against Allah and his Apostle ﷺ. (Using translation from Abū Dāʾūd 4364)
مِنْ عُرَيْنَةَ قَدِمُوا الْمَدِينَةَ فَاجْتَوَوْهَا «فَأَمَرَ لَهُمُ النَّبِيُّ ﷺ بِلِقَاحٍ وَأَمَرَهُمْ أَنْ يَشْرَبُوا مِنْ أَلْبَانِهَا وَأَبْوَالِهَا فَشَرِبُوا مِنْ أَلْبَانِهَا وَأَبْوَالِهَا حَتَّى بَرِئُوا» وَذَهَبَ سَقَمُهُمْ فَقَتَلُوا رَاعِيَ رَسُولِ اللَّهِ ﷺ وَطَرَدُوا النَّعَمَ «فَبَلَغَ ذَلِكَ النَّبِيَّ ﷺ فَبَعَثَ إِلَيْهِمْ غُدْوَةً فَمَا ارْتَفَعَ النَّهَارُ حَتَّى جِيءَ بِهِمْ فَقُطِعَتْ أَيْدِيهِمْ وَأَرْجُلَهُمْ وَسَمَلَ أَعْيُنَهُمْ وَأُلْقُوا بِالْحَرَّةِ يَسْتَسْقُونَ فَلَا يُسْقَوْنَ» قَالَ فَقَالَ أَبُو قِلَابَةَ «هَؤُلَاءِ قَوْمٌ قَتَلُوا وَسَرَقُوا وَكَفَرُوا بَعْدَ إِيمَانِهِمْ وَحَارَبُوا اللَّهَ وَرَسُولَهُ ﷺ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمُصْطَفَى ﷺ طَرَحَ الْعُرَنِيِّينَ فِي الشَّمْسِ بَعْدَ تَعْذِيبِهِ إِيَّاهُمْ بِمَا عَذَّبَ حَتَّى مَاتُوا
A group of eighty people from 'Ukl came to the Prophet [SAW], but the climate of Al-Madinah did not suit them and they fell sick. They complained about that to the Messenger of Allah [SAW] and he said: "Why don't you go out with our herdsmen and drink the milk and urine of the camels?" They said: "Yes (we will do that)." They went out and drank some of the (camels') milk and urine, and they recovered. Then they killed the herdsman of the Messenger of Allah [SAW], so he sent (men after them) and they caught them and brought them back. He had their hands and feet cut off and branded their eyes, and left them in the sun to die. (Using translation from Nasāʾī 4024)
أَنَّ نَفَرًا مِنْ عُكْلٍ ثَمَانِيَةً قَدِمُوا عَلَى رَسُولِ اللَّهِ ﷺ فَبَايَعُوهُ عَلَى الْإِسْلَامِ فَاسْتَوْخَمُوا الْأَرْضَ وَسَقِمَتْ أَجْسَامُهُمْ فَقَالَ رَسُولُ اللَّهِ ﷺ «أَلَا تَخْرُجُونَ مَعَ رَاعِينَا فِي إِبِلِهِ فَتُصِيبُونَ مِنْ أَلْبَانِهَا وَأَبْوَالِهَا؟ » فَقَالُوا بَلَى فَخَرَجُوا فَشَرِبُوا مِنْ أَلْبَانِهَا وَأَبْوَالِهَا فَصَحُّوا فَقَتَلُوا رَاعِيَ رَسُولِ اللَّهِ ﷺ وَطَرَدُوا النَّعَمَ فَبَلَغَ ذَلِكَ رَسُولَ اللَّهِ ﷺ فَبَعَثَ فِي آثَارِهِمْ فَجَلَبَهُمْ فَأَمَرَ بِهِمْ رَسُولُ اللَّهِ ﷺ فَقَطَعَ أَيْدِيَهُمْ وَأَرْجُلَهُمْ وَسَمَّرَ أَعْيُنَهُمْ وَنَبَذَهُمْ فِي الشَّمْسِ حَتَّى مَاتُوا
ذِكْرُ الْبَيَانِ بِأَنَّ الْعُرَنِيِّينَ كَفَرُوا بَعْدَ فِعْلِهِمُ الَّذِي فَعَلُوا
"Some people from 'Uraynah came to the Messenger of Allah [SAW] and the Messenger of Allah [SAW] said to them: 'Why don't you go out to our camels and stay with them and drink their milk and urine?' So they did that, and when they recovered, they went to the herdsman of the Messenger of Allah [SAW] and killed him, reverted to being disbelievers, and drove off the camels of the Prophet [SAW]. He sent (men) after them, and they were brought to him. He had their hands and feet cut off, and their eyes gouged out." (Using translation from Nasāʾī 4029)
أَنَّهُ قَدِمَ عَلَى النَّبِيِّ ﷺ نَفَرٌ مِنْ عُرَيْنَةَ فَقَالَ لَهُمْ «لَوْ خَرَجْتُمْ إِلَى ذَوْدِنَا فَكُنْتُمْ فِيهَا فَشَرِبْتُمْ مِنْ أَلْبَانِهَا وَأَبْوَالِهَا» فَفَعَلُوا فَلَمَّا صَحُّوا قَامُوا إِلَى رَاعِي رَسُولِ اللَّهِ ﷺ فَقَتَلُوهُ وَرَجَعُوا كُفَّارًا وَاسْتَاقُوا ذَوْدَ رَسُولِ اللَّهِ ﷺ فَأَرْسَلَ رَسُولُ اللَّهِ ﷺ فِي طَلَبِهِمْ فَأُتِيَ بِهِمْ فَقَطَعَ أَيْدِيَهُمْ وَأَرْجُلَهُمْ وَسَمَّلَ أَعْيُنَهُمْ
ذِكْرُ الْبَيَانِ بِأَنَّ الْمُصْطَفَى ﷺ إِنَّمَا قَتَلَ الْعُرَنِيِّينَ لِأَنَّهُمْ كَفَرُوا وَارْتَدُّوا بَعْدَ إِسْلَامِهِمْ
Some people from the tribes of ʿUkl and ʿUraina came to Messenger of Allah ﷺ and embraced Islam and said, "O Messenger of Allah ﷺ! We are owners of livestock and have never been farmers," and they found the climate of Medina unsuitable for them. So Messenger of Allah ﷺ ordered that they be given some camels and a shepherd, and ordered them to go out with those camels and drink their milk and urine. So they set out, but when they reached a place called Al-Harra, they reverted to disbelief after their conversion to Islam, killed the shepherd and drove away the camels. When this news reached the Prophet ﷺ he sent in their pursuit (and they were caught and brought). The Prophet ﷺ ordered that their eyes be branded with heated iron bars and their hands be cut off, and they were left at Al-Harra till they died in that state. (Using translation from Bukhārī 5727)
أَنَّ نَاسًا مِنْ عُكْلٍ وَعُرَيْنَةَ قَدِمُوا عَلَى رَسُولِ اللَّهِ ﷺ وَتَكَلَّمُوا بِالْإِسْلَامِ وَقَالُوا يَا نَبِيَّ اللَّهِ إِنَّا كُنَّا أَهْلَ ضَرْعٍ وَلَمْ نَكُنْ أَهْلَ رِيفٍ وَاسْتَوْخَمُوا الْمَدِينَةَ «فَأَمَرَ لَهُمْ رَسُولُ اللَّهِ ﷺ بِذَوْدٍ وَرَاعي وَأَمَرَهُمْ أَنْ يَخْرُجُوا لِيَشْرَبُوا مِنْ أَبْوَالِهَا وَأَلْبَانِهَا» فَانْطَلَقُوا حَتَّى إِذَا كَانُوا فِي نَاحِيَةِ الْحَرَّةِ كَفَرُوا بَعْدَ إِسْلَامِهِمْ وَقَتَلُوا رَاعِيَ رَسُولِ اللَّهِ ﷺ وَاسْتَاقُوا الذَّوْدَ فَبَلَغَ ذَلِكَ النَّبِيَّ ﷺ فَبَعَثَ الطَّلَبَ فِي آثَارِهِمْ فَأُتِيَ بِهِمْ فَسَمَّرَ أَعْيُنَهُمْ وَقَطَعَ أَيْدِيَهُمْ وَأَرْجُلَهُمْ ثُمَّ تَرَكَهُمْ فِي نَاحِيَةِ الْحَرَّةِ حَتَّى مَاتُوا عَلَى حَالِهِمْ ذَلِكَ
ذِكْرُ خَبَرٍ قَدْ يُوهِمُ عَالِمًا مِنَ النَّاسِ ضِدَّ مَا ذَهَبْنَا إِلَيْهِ
[Machine] "Do not cut his hand, for the Messenger of Allah ﷺ used to stand among us and command us to give charity and forbid us from mutilation."
لَا تَقْطَعْ يَدَهُ «فَإِنَّ رَسُولَ اللَّهِ ﷺ كَانَ يَقُومُ فِينَا فَيَأْمُرُنَا بِالصَّدَقَةِ وَيَنْهَانَا عَنِ الْمُثْلَةِ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمُصْطَفَى ﷺ إِنَّمَا سَمَّرَ أَعْيَنَ الْعُرَنِيِّينَ لِأَنَّهُمْ سَمَّرُوا أَعْيَنَ الرِّعَاءِ
[Machine] "That the Prophet ﷺ only dyed their eyes because they dyed the eyes of the herd."
«أَنَّ النَّبِيَّ ﷺ إِنَّمَا سَمَّرَ أَعْيُنَهُمْ لِأَنَّهُمْ سَمَّرُوا أَعْيَنَ الرِّعَاءِ»
20.8 [Machine] The Apostasy
٢٠۔٨ بَابُ الرِّدَّةِ
ذِكْرُ الْأَمْرِ بِالْقَتْلِ لِمَنْ بَدَّلَ دِينَهُ رَجُلًا كَانَ أَوِ امْرَأَةً إِلَى أَيِّ دِينٍ كَانَ سِوَى الْإِسْلَامِ
[Machine] "The Prophet ﷺ said, 'Whoever changes his religion, kill him.'"
أَنَّ النَّبِيَّ ﷺ قَالَ «مَنْ بَدَّلَ دِينَهُ فَاقْتُلُوهُ»
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِصِحَّةِ مَا ذَكَرْنَاهُ
[Machine] “He said: The Messenger of Allah ﷺ said, 'Whoever leaves his religion or renounces his religion, then kill him and do not torture anyone with the punishment of Allah, meaning through fire.'
أَنَّهُ قَالَ قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ تَرَكَ دِينَهُ أَوْ قَالَ رَجَعَ عَنْ دِينِهِ فَاقْتُلُوهُ وَلَا تُعَذِّبُوا بِعَذَابِ اللَّهِ أَحَدًا يَعْنِي بِالنَّارِ
ذِكْرُ السَّبَبِ الَّذِي مِنْ أَجْلِهِ أَنْزَلَ اللَّهُ جَلَّ وَعَلَا: {كَيْفَ يَهْدِي اللَّهُ قَوْمًا كَفَرُوا بَعْدَ إِيمَانِهِمْ}
"A man from among the Ansar accepted Islam, then he apostatized and went back to Shirk. Then he regretted that, and sent word to his people (saying): 'Ask the Messenger of Allah [SAW], is there any repentance for me?' His people came to the Messenger of Allah [SAW] and said: 'So and so regrets (what he did), and he has told us to ask you if there is any repentance for him?' Then the Verses: 'How shall Allah guide a people who disbelieved after their Belief up to His saying: Verily, Allah is Oft-Forgiving, Most Merciful' was revealed. So he sent word to him, and he accepted Islam." (Using translation from Nasāʾī 4068)
«كَانَ رَجُلٌ مِنَ الْأَنْصَارِ أَسْلَمَ ثُمَّ ارْتَدَّ فَلَحِقَ بِالشِّرْكِ ثُمَّ نَدِمَ فَأَرْسَلَ إِلَى قَوْمِهِ أَنْ سَلُوا رَسُولَ اللَّهِ ﷺ هَلْ لِي مِنْ تَوْبَةٍ؟ قَالَ فَنَزَلَتْ {كَيْفَ يَهْدِي اللَّهُ قَوْمًا كَفَرُوا بَعْدَ إِيمَانِهِمْ وَشَهِدُوا أَنَّ الرَّسُولَ حَقٌّ وَجَاءَهُمُ الْبَيِّنَاتُ} إِلَى قَوْلِهِ {إِلَّا الَّذِينَ تَابُوا مِنْ بَعْدَ ذَلِكَ وَأَصْلِحُوا فَإِنَّ اللَّهَ غَفُورٌ رَحِيمٌ} فَأَرْسَلَ إِلَيْهِ قَوْمُهُ فَأَسْلَمَ»
