ذِكْرُ الْإِخْبَارِ عَنْ فَضْلِ إِقَامَةِ الْحُدُودِ مِنَ الْأَئِمَّةِ الْعُدُولِ

"Abu Hurairah said: 'Carrying out a Hadd punishment in a land is better for its people than if it were to rain for forty nights." (Daif) (Using translation from Nasāʾī 4905)   

ابن حبّان:٤٣٩٧أَخْبَرَنَا ابْنُ قُتَيْبَةَ حَدَّثَنَا مُحَمَّدُ بْنُ قُدَامَةَ حَدَّثَنَا ابْنُ عُلَيَّةَ عَنْ يُونُسَ بْنِ عُبَيْدٍ عَنْ عَمْرِو بْنِ سَعِيدٍ عَنْ أَبِي زُرْعَةَ بْنِ عَمْرٍو عَنْ أَبِي هُرَيْرَةَ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «إِقَامَةُ حَدٍّ بِأَرْضٍ خَيْرٌ لِأَهْلِهَا مِنْ مَطَرِ أَرْبَعِينَ صَبَاحًا»  

ذِكْرُ الْأَمْرِ بِإِقَامَةِ الْحُدُودِ فِي الْبِلَادِ إِذْ إِقَامَةُ الْحَدِّ فِي بَلَدٍ يَكُونُ أَعَمَّ نَفْعًا مِنْ أَضْعَافِهِ الْقَطْرُ إِذَا عَمَّتْهُ

[Machine] The Messenger of Allah ﷺ said: "Something that happens on the earth that is better than forty mornings of rain."  

ابن حبّان:٤٣٩٨أَخْبَرَنَا أَبُو يَعْلَى قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ الرَّحْمَنِ بْنِ سَهْمٍ قَالَ حَدَّثَنَا ابْنُ الْمُبَارَكِ قَالَ أَخْبَرَنَا عِيسَى بْنُ يَزِيدَ * عَنِ أَبِي هُرَيْرَةَ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «حَدٌّ يُقَامُ فِي الْأَرْضِ خَيْرٌ مِنْ مَطَرِ أَرْبَعِينَ صَبَاحًا»  

ذِكْرُ إِبَاحَةِ التَّوَقُّفِ فِي إِمْضَاءِ الْحُدُودِ، وَاسْتِئْنَافِ أَسْبَابِهَا بِمَا فِيهِ الِاحْتِيَاطُ لِلرَّعِيَةِ

A man of the tribe of Aslam came to the Prophet ﷺ and testified four times against himself that he had had illicit intercourse with a woman, while all the time the Prophet ﷺ was turning away from him. Then when he confessed a fifth time, he turned round and asked: Did you have intercourse with her? He replied: Yes. He asked: Have you done it so that your sexual organ penetrated hers? He replied: Yes. He asked: Have you done it like a collyrium stick when enclosed in its case and a rope in a well? He replied: Yes. He asked: Do you know what fornication is? He replied: Yes. I have done with her unlawfully what a man may lawfully do with his wife. He then asked: What do you want from what you have said? He said: I want you to purify me. So he gave orders regarding him and he was stoned to death. Then the Prophet ﷺ heard one of his companions saying to another: Look at this man whose fault was concealed by Allah but who would not leave the matter alone, so that he was stoned like a dog. He said nothing to them but walked on for a time till he came to the corpse of an ass with its legs in the air. He asked: Where are so and so? They said: Here we are, Messenger of Allah ﷺ! He said: Go down and eat some of this ass's corpse. They replied: Messenger of Allah! Who can eat any of this? He said: The dishonour you have just shown to your brother is more serious than eating some of it. By Him in Whose hand my soul is, he is now among the rivers of Paradise and plunging into them. ابن حبّان:٤٣٩٩أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدٍ قَالَ حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ الْحَنْظَلِيُّ قَالَ أَخْبَرَنَا عَبْدُ الرَّزَّاقِ قَالَ أَخْبَرَنَا ابْنُ جُرَيْجٍ قَالَ أَخْبَرَنِي أَبُو الزُّبَيْرِ أَنَّ عَبْدَ الرَّحْمَنِ بْنَ الصَّامِتِ ابْنِ عَمِّ أَبِي هُرَيْرَةَ

أَخْبَرَهُ أَنَّهُ سَمِعَ أَبَا هُرَيْرَةَ يَقُولُ جَاءَ الْأَسْلَمِيُّ إِلَى رَسُولِ اللَّهِ ﷺ فَشَهِدَ عَلَى نَفْسِهِ أَرْبَعَ مَرَّاتٍ بِالزِّنَى يَقُولُ أَتَيْتُ امْرَأَةً حَرَامًا وَفِي ذَلِكَ يَعْرِضُ عَنْهُ رَسُولُ اللَّهِ ﷺ حَتَّى أَقْبَلَ فِي الْخَامِسَةِ فَقَالَ رَسُولُ اللَّهِ ﷺ لَهُ «أَنِكْتَهَا؟ » فَقَالَ نَعَمْ فَقَالَ «هَلْ غَابَ ذَلِكَ مِنْكَ فِيهَا كَمَا يَغِيبُ الْمِرْوَدُ فِي الْمُكْحُلَةِ وَالرِّشَاءُ فِي الْبِئْرِ؟ » فَقَالَ نَعَمْ فَقَالَ «فَهَلْ تَدْرِي مَا الزِّنَا؟ » قَالَ نَعَمْ أَتَيْتُ مِنْهَا حَرَامًا مِثْلَ مَا يَأْتِي الرَّجُلَ مِنِ امْرَأَتِهِ حَلَالًا قَالَ «فَمَا تُرِيدُ بِهَذَا الْقَوْلِ؟ » قَالَ أُرِيدُ أَنْ تُطَهِّرَنِي فَأَمَرَ بِهِ رَسُولُ اللَّهِ ﷺ أَنْ يُرْجَمَ فَرُجِمَ فَسَمِعَ رَجُلَيْنِ مِنْ أَصْحَابِهِ يَقُولُ أَحَدُهُمَا لِصَاحِبِهِ انْظُرُوا إِلَى هَذَا الَّذِي سَتَرَ اللَّهُ عَلَيْهِ فَلَمْ تَدَعْهُ نَفْسُهُ حَتَّى رُجِمَ رَجْمَ الْكَلْبِ قَالَ فَسَكَتَ رَسُولُ اللَّهِ ﷺ عَنْهُمَا فَمَرَّ بِجِيفَةِ حِمَارٍ شَائِلٍ بِرِجْلِهِ فَقَالَ «أَيْنَ فُلَانٌ وَفُلَانٌ؟ » فَقَالَا نَحْنُ ذَا يَا رَسُولَ اللَّهِ فَقَالَ لَهُمَا «كُلَا مِنْ جِيفَةِ هَذَا الْحِمَارِ» فَقَالَا يَا رَسُولَ اللَّهِ غَفَرَ اللَّهُ لَكَ مَنْ يَأْكُلُ مِنْ هَذَا؟ فَقَالَ رَسُولُ اللَّهِ ﷺ «مَا نِلْتُمَا مِنْ عِرْضِ هَذَا الرَّجُلِ آنِفًا أَشَدُّ مِنْ أَكَلِ هَذِهِ الْجِيفَةِ فَوَالَّذِي نَفْسِي بِيَدِهِ إِنَّهُ الْآنَ فِي أَنْهَارِ الْجَنَّةِ»  

ذِكْرُ الْبَيَانِ بِأَنَّ الْمُصْطَفَى ﷺ رَدَّ مَاعِزَ بْنَ مَالِكٍ فِي الْمِرَارِ الْأَرْبَعِ، وَأَمَرَ بِهِ فَطُرِدَ

[Machine] Ma'iz ibn Malik came to the Messenger of Allah ﷺ and said, "Indeed, Al-Ab'ad has committed adultery." The Prophet ﷺ said to him, "Woe to you! How do you know what adultery is?" He then ordered that he be turned away and expelled. Then he came to him a second time and said, "O Messenger of Allah, Al-Ab'ad has committed adultery." He said, "Woe to you! How do you know what adultery is?" He was turned away and expelled. Then he came to him a third time and said, "O Messenger of Allah, Al-Ab'ad has committed adultery." He said, "Woe to you! How do you know what adultery is?" He said, "I approached a woman unlawfully, just as a man approaches his wife." So he ordered that he be dealt with, turned away, and expelled. Then he came to him a fourth time and said, "O Messenger of Allah, Al-Ab'ad has committed adultery." He said, "Woe to you! How do you know what adultery is?" He said, "Did you enter her and withdraw?" He said, "Yes." So he ordered that he be stoned. When he was pelted with stones, he found that he could not bear it, so he went to a tree, leaned against it, and was stoned to death there. The Messenger of Allah ﷺ later passed by with a group of his companions, and one man said to his companion and his father, "Indeed, this is the loser who came to the Messenger of Allah ﷺ repeatedly, and he rejected him each time, until he was killed like a dog." The Prophet ﷺ remained silent about them until he passed by the carcass of a donkey with its legs raised, and he said, "Leave it, leave it." They said, "It is the carcass of a donkey, O Messenger of Allah." He said, "By the One in whose hand is the soul of Muhammad, it is in a river from the rivers of Paradise enjoying itself."  

ابن حبّان:٤٤٠٠أَخْبَرَنَا الْحُسَيْنُ بْنُ مُحَمَّدِ بْنِ أَبِي مَعْشَرٍ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ الْحَارِثِ الْبَزَّارُ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ سَلَمَةَ عَنْ أَبِي عَبْدِ الرَّحِيمِ عَنْ زَيْدِ بْنِ أَبِي أُنَيْسَةَ عَنْ أَبِي الزُّبَيْرِ الْمَكِّيِّ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْهِضْهَاضِ الدَّوْسِيِّ عَنْ أَبِي هُرَيْرَةَ قَالَ

جَاءَ مَاعِزُ بْنُ مَالِكٍ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ إِنَّ الْأَبْعَدَ قَدْ زَنَى فَقَالَ لَهُ النَّبِيُّ ﷺ «وَيْلَكَ وَمَا يُدْرِيكَ مَا الزِّنَى» ثُمَّ أَمَرَ بِهِ فَطُرِدَ وَأُخْرِجَ ثُمَّ أَتَاهُ الثَّانِيَةَ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ الْأَبْعَدَ قَدْ زَنَى فَقَالَ «وَيْلَكَ وَمَا يُدْرِيكَ مَا الزِّنَى» فَطُرِدَ وَأُخْرِجَ ثُمَّ أَتَاهُ الثَّالِثَةَ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ الْأَبْعَدَ قَدْ زَنَى قَالَ «وَيْلَكَ وَمَا يُدْرِيكَ مَا الزِّنَى» قَالَ أَتَيْتُ امْرَأَةً حَرَامًا مِثْلَ مَا يَأْتِي الرَّجُلُ مِنِ امْرَأَتِهِ فَأَمَرَ بِهِ فَطُرِدَ وَأُخْرِجَ ثُمَّ أَتَاهُ الرَّابِعَةَ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ الْأَبْعَدَ قَدْ زَنَى قَالَ «وَيْلَكَ وَمَا يُدْرِيكَ مَا الزِّنَى» قَالَ «أَدْخَلْتَ وَأَخْرَجْتَ؟ » قَالَ نَعَمْ فَأَمَرَ بِهِ أَنْ يُرْجَمَ فَلَمَّا وَجَدَ مَسَّ الْحِجَارَةِ تَحَمَّلَ إِلَى شَجَرَةٍ فَرُجِمَ عِنْدَهَا حَتَّى مَاتَ فَمَرَّ رَسُولُ اللَّهِ ﷺ بَعْدَ ذَلِكَ مَعَهُ نَفَرٌ مِنْ أَصْحَابِهِ فَقَالَ رَجُلٌ مِنْهُمْ لِصَاحِبِهِ وَأَبِيكَ إِنَّ هَذَا لَهُوَ الْخَائِبُ أَتَى النَّبِيَّ ﷺ مِرَارًا كُلُّ ذَلِكَ يَرُدَّهُ حَتَّى قُتِلَ كَمَا يَقْتُلُ الْكَلْبُ فَسَكَتَ عَنْهُمَا النَّبِيُّ ﷺ حَتَّى مَرَّ بِجِيفَةِ حِمَارٍ شَائِلَةٌ رِجْلُهَا فَقَالَ «كُلَا مِنْ هَذَا» قَالَا مِنْ جِيفَةِ حِمَارٍ يَا رَسُولَ اللَّهِ قَالَ «فَالَّذِي نِلْتُمَا مِنْ عِرْضِ أَخِيكُمَا أَكْثَرُ وَالَّذِي نَفْسُ مُحَمَّدٍ ﷺ بِيَدِهِ إِنَّهُ لَفِي نَهَرٍ مِنْ أَنْهَارِ الْجَنَّةِ يَتَقَمَّصُ»  

ذِكْرُ وَصْفِ تَقَمُّصِ مَاعِزِ بْنِ مَالِكٍ الَّذِي ذَكَرْنَاهُ فِي الْجَنَّةِ

[Machine] When the Prophet ﷺ stoned Ma'iz ibn Malik, he said, "I saw him engaging in sexual intercourse in the rivers of paradise."  

ابن حبّان:٤٤٠١أَخْبَرَنَا الْحَسَنُ بْنُ سُفْيَانَ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ أَبِي بَكْرٍ الْمُقَدَّمِيُّ حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ عَنْ أَيُّوبَ عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرٍ

أَنَّ النَّبِيَّ ﷺ لَمَّا رَجَمَ مَاعِزَ بْنَ مَالِكٍ قَالَ «لَقَدْ رَأَيْتُهُ يَتَخَضْخَضُ فِي أَنْهَارِ الْجَنَّةِ»  

ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى أَنَّ الْحُدُودَ يَجِبُ أَنْ تُقَامَ عَلَى مَنْ وَجَبَتْ شَرِيفًا كَانَ أَوْ وَضِيعًا

The Quraish were anxious about the Makhzumi woman who had committed theft, They said : Who will speak to the Messenger of Allah ﷺ about her ? Then they said: Who will be bold enough for it but Uasmah bin Zaid, the prophet’s ﷺ friend! So Usamah spoke to him, and the Messenger of Allah ﷺ said : Are you interceding regarding one of the punishments prescribed by Allah ? He then got up and gave an address, saying : What destroyed your predecessors was just that when a person of rank among them committed a theft, They left him alone , and when a weak one of them committed a theft, they inflicted the prescribed punishment on him . I swear by Allah that if Fatimah daughter of Muhammad should steal, I would have her hand cut off. (Using translation from Abū Dāʾūd 4373)  

ابن حبّان:٤٤٠٢أَخْبَرَنَا مُحَمَّدُ بْنُ الْحَسَنِ بْنِ قُتَيْبَةَ بِعَسْقَلَانَ حَدَّثَنَا يَزِيدُ بْنُ مَوْهَبٍ حَدَّثَنِي اللَّيْثُ بْنُ سَعْدٍ عَنِ ابْنِ شِهَابٍ عَنْ عُرْوَةَ عَنْ عَائِشَةَ أَنَّ قُرَيْشًا أَهَمَّتْهُمْ

شَأْنُ الْمَرْأَةِ الْمَخْزُومِيَّةِ الَّتِي سَرَقَتْ فَقَالُوا مَنْ يُكَلِّمُ فِيهَا رَسُولَ اللَّهِ ﷺ فَقَالُوا وَمَنْ يَجْتَرِئُ عَلَيْهِ إِلَّا أُسَامَةُ بْنُ زَيْدٍ حُبُّ رَسُولِ اللَّهِ ﷺ فَكَلَّمَهُ أُسَامَةُ فَقَالَ رَسُولُ اللَّهِ ﷺ «أَتَشْفَعُ فِي حَدٍّ مِنْ حُدُودِ اللَّهِ» ثُمَّ قَامَ فَاخْتَطَبَ فَقَالَ «إِنَّمَا هَلَكَ الَّذِينَ قَبْلَكُمْ أَنَّهُمْ كَانُوا إِذَا سَرَقَ فِيهِمُ الشَّرِيفُ تَرَكُوهُ وَإِذَا سَرَقَ فِيهِمُ الضَّعِيفُ أَقَامُوا عَلَيْهِ الْحَدَّ وَايْمُ اللَّهِ لَوْ أَنَّ فَاطِمَةَ بِنْتَ مُحَمَّدٍ ﷺ سَرَقَتْ لَقَطَعْتُ يَدَهَا»  

ذِكْرُ الْإِخْبَارِ بِأَنَّ الْحُدُودَ تَكُونُ كَفَّارَاتٍ لِأَهْلِهَا

a woman from Juhainah came to the Messenger of Allah sand said: "I have committed Zina." And she was committed Zina." And She was pregnant. He handed her over to her guardian and said: "Look after her, and when she gave birth, he brought her to him. He ordered that her garment be wrapped around her, then he offered the funeral prayer for her. 'Umar said to him: "Are you praying for her even though she committed Zina?" he said: "She has repented in a manner that, if it were to be shared among seventy of the people of Al-Madinah it would suffice them. Have you ever seen repentance better than the one who sacrificed herself for the sake of Allah, the Mighty and Sublime?" (Using translation from Nasāʾī 1957)   

ابن حبّان:٤٤٠٣أَخْبَرَنَا مُحَمَّدُ بْنُ الْحَسَنِ بْنِ الْخَلِيلِ قَالَ حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ إِبْرَاهِيمَ قَالَ حَدَّثَنَا الْوَلِيدُ قَالَ حَدَّثَنَا الْأَوْزَاعِيُّ قَالَ حَدَّثَنِي يَحْيَى بْنُ أَبِي كَثِيرٍ عَنْ أَبِي قِلَابَةَ عَنْ عَمِّهِ عَنْ عِمْرَانَ بْنِ حُصَيْنٍ قَالَ

أَتَتْ رَسُولَ اللَّهِ ﷺ امْرَأَةٌ مِنْ جُهَيْنَةَ فَقَالَتْ يَا رَسُولَ اللَّهِ إِنِّي أَصَبْتُ حَدًّا فَأَقِمْهُ عَلَيَّ فَدَعَا رَسُولُ اللَّهِ ﷺ وَلِيِّهَا فَقَالَ «أَحْسِنْ إِلَيْهَا حَتَّى تَضَعَ مَا فِي بَطْنِهَا فَإِذَا وَضَعَتْ فَأْتِنِي بِهَا» فَلَمَّا وَضَعَتْ أَتَى بِهَا رَسُولَ اللَّهِ ﷺ فَأَمَرَ بِهَا فَشُدَّ عَلَيْهَا ثِيَابُهَا ثُمَّ أَمَرَ بِهَا فَرُجِمَتْ ثُمَّ صَلَّى عَلَيْهَا فَقَالَ عُمَرُ يَا رَسُولَ اللَّهِ أَتُصَلِّي عَلَيْهَا وَقَدْ زَنَتْ؟ فَقَالَ رَسُولُ اللَّهِ ﷺ «لَقَدْ تَابَتْ تَوْبَةً لَوْ قُسِمَتْ عَلَى سَبْعِينَ مِنْ أَهْلِ الْمَدِينَةِ لَوَسِعَتْهُمْ وَهَلْ وَجَدْتَ أَفْضَلَ مِنْ أَنْ جَادَتْ بِنَفْسِهَا لِلَّهِ جَلَّ وَعَلَا»  

ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى أَنَّ إِقَامَةَ الْحُدُودِ تُكَفِّرُ الْجِنَايَاتِ عَنْ مُرْتَكِبِهَا

[Machine] "The Prophetﷺ said when Ma'iz ibn Malik was stoned to death: 'I have seen him indulging in the rivers of Paradise'"  

ابن حبّان:٤٤٠٤أَخْبَرَنَا الْحَسَنُ بْنُ سُفْيَانَ حَدَّثَنَا مُحَمَّدُ بْنُ أَبِي بَكْرٍ الْمُقَدَّمِيُّ حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرٍ

أَنَّ النَّبِيَّ ﷺ لَمَّا رَجَمَ مَاعِزَ بْنَ مَالِكٍ قَالَ «لَقَدْ رَأَيْتُهُ يَتَخَضْخَضُ فِي أَنْهَارِ الْجَنَّةِ»  

ذِكْرُ الْبَيَانِ بِأَنَّ مَنْ عُجِّلَ لَهُ الْعُقُوبَةُ بِالْحُدِودِ تَكُونُ إِقَامَتُهَا كَفَّارَةً لَهَا

[Machine] The messenger of Allah ﷺ took from us, the women, just as he took from us. He said, "Whoever wrongs any of them, their punishment is hastened for them as an expiation, and whoever is delayed from them, his matter is left to Allah. If He wills, He will have mercy on him, and if He wills, He will punish him."  

ابن حبّان:٤٤٠٥أَخْبَرَنَا مُحَمَّدُ بْنُ عَلِيٍّ الصَّيْرَفِيُّ بِالْبَصْرَةِ قَالَ حَدَّثَنَا أَبُو كَامِلٍ الْجَحْدَرِيُّ قَالَ حَدَّثَنَا يَزِيدُ بْنُ زُرَيْعٍ قَالَ حَدَّثَنَا خَالِدٌ الْحَذَّاءُ عَنْ أَبِي قِلَابَةَ عَنْ أَبِي أَسْمَاءَ* عَنْ عُبَادَةَ بْنِ الصَّامِتِ قَالَ

أَخَذَ عَلَيْنَا رَسُولُ اللَّهِ ﷺ كَمَا أَخَذَ عَلَى النِّسَاءِ مِنَّا وَقَالَ «مَنْ أَصَابَ مِنْكُمْ مِنْهُنَّ حَدًّا فَعُجِّلَتْ لَهُ عُقُوبَتُهُ فَهُوَ كَفَّارَتُهُ وَمَنْ أُخِّرَ عَنْهُ فَأَمْرُهُ إِلَى اللَّهِ إِنْ شَاءَ رَحِمَهُ وَإِنْ شَاءَ عَذَّبَهُ»  

ذِكْرُ الْأَمْرِ بِالْقَتْلِ لِمَنْ أَرَادَ أَنْ يُفَرِّقَ أَمْرَ أُمَّةِ مُحَمَّدٍ ﷺ بِفِرَاقِهِ الْجَمَاعَةَ وَهُمْ جَمِيعٌ

I have heard the Messenger of Allah ﷺ say: Different evils will make their appearance in the near future. Anyone who tries to disrupt the affairs of this Umma while they are united you should strike him with the sword whoever he be. (If remonstrance does not prevail with him and he does not desist from his disruptive activities, he is to be killed.) (Using translation from Muslim 1852a)  

ابن حبّان:٤٤٠٦أَخْبَرَنَا أَحْمَدُ بْنُ عَلِيِّ بْنِ الْمُثَنَّى حَدَّثَنَا أَبُو خَيْثَمَةَ حَدَّثَنَا حَجَّاجُ بْنُ مُحَمَّدٍ حَدَّثَنَا شُعْبَةُ عَنْ زِيَادِ بْنِ عِلَاقَةَ قَالَ سَمِعْتُ عَرْفَجَةَ يَقُولُ

سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «إِنَّهَا سَتَكُونُ هَنَاتٌ وَهَنَاتٌ فَمَنْ أَرَادَ أَنْ يُفَرِّقَ أَمْرَ هَذِهِ الْأُمَّةِ وَهُمْ جَمِيعٌ فَاضْرِبُوهُ بِالسَّيْفِ كَائِنًا مَنْ كَانَ»  

20.1.11 Subsection

٢٠۔١۔١١ ذِكْرُ الْإِخْبَارِ عَنْ إِبَاحَةِ قَتْلِ الْمَرْءِ الْمُسْلِمِ إِذَا ارْتَكَبَ إِحْدَى الْخِصَالِ الثَّلَاثِ الَّتِي مِنْ أَجْلِهَا أُبِيحَ دَمُهُ

"The Messenger of Allah [SAW] said: 'By the One besides Whom there is no other god, it is not permissible to shed the blood of a Muslim who bears witness to La ilaha illalla (there is none worthy of worship except Allah) and that I am the Messenger of Allah, except in three cases: One who leaves Islam and splits away from the Jama'ah, a person who has been married and then commits adultery, and a life for a life.'" ابن حبّان:٤٤٠٧أَخْبَرَنَا حَاجِبُ بْنُ أَرْكِينَ بِدِمَشْقَ حَدَّثَنَا أَحْمَدُ بْنُ إِبْرَاهِيمَ الدَّوْرَقِيُّ حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ حَدَّثَنَا سُفْيَانُ عَنِ الْأَعْمَشِ عَنْ عَبْدِ اللَّهِ بْنِ مُرَّةَ عَنْ مَسْرُوقٍ عَنْ عَبْدِ اللَّهِ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «وَالَّذِي لَا إِلَهَ غَيْرُهُ لَا يَحِلُّ دَمُ رَجُلٍ يَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللَّهُ وَأَنِّي رَسُولُ اللَّهِ إِلَّا ثَلَاثَةَ نَفَرٍ التَّارِكُ لِلْإِسْلَامِ الْمُفَارِقُ لِلْجَمَاعَةِ وَالثَّيِّبُ الزَّانِي وَالنَّفْسُ بِالنَّفْسِ» قَالَ الْأَعْمَشُ فَحَدَّثْتُ بِهِ إِبْرَاهِيمَ فَحَدَّثَنِي عَنِ الْأَسْوَدِ عَنْ عَائِشَةَ مِثْلَهُ

The blood of a Muslim man who testifies that there is no god but Allah and that I am the Messenger of Allah should not be lawfully shed but only for one of three reasons: married fornicator, soul for soul, and one who deserts his religion separating himself from the community. ابن حبّان:٤٤٠٨أَخْبَرَنَا أَبُو يَعْلَى قَالَ حَدَّثَنَا أَبُو خَيْثَمَةَ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ خَازِمٍ قَالَ حَدَّثَنَا الْأَعْمَشُ عَنْ عَبْدِ اللَّهِ بْنِ مُرَّةَ عَنْ مَسْرُوقٍ عَنْ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَحِلُّ دَمُ امْرِئٍ مُسْلِمٍ يَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللَّهُ وَأَنِّي رَسُولُ اللَّهِ إِلَّا بِإِحْدَى ثَلَاثٍ الثَّيِّبُ الزَّانِي وَالنَّفْسُ بِالنَّفْسِ وَالتَّارِكُ لِدِينِهِ الْمُفَارِقُ الْجَمَاعَةَ»
