[Machine] The man used to divorce his wife whenever he pleased, and even if he divorced her a hundred times or more, if he took her back before her waiting period ended. Then the man said to his wife, "By Allah, I will not divorce you so reveal to me from yourself and do not come to me." She asked, "How can that be?" He said, "I will divorce you, and every time your waiting period is about to end, I will take you back and then divorce you again." The woman complained about this to Aisha, and Aisha mentioned it to the Messenger of Allah, peace be upon him. He remained silent and did not say anything until the verse was revealed in the Quran, "Divorce is twice. Then, either keep [her] in an acceptable manner or release [her] with good treatment." [Quran 2:229]  

الحاكم:٣١٠٦أَخْبَرَنَا الشَّيْخُ أَبُو بَكْرِ بْنُ إِسْحَاقَ أَنْبَأَ عَلِيُّ بْنُ الْحُسَيْنِ بْنِ الْجُنَيْدِ ثنا يَعْقُوبُ بْنُ حُمَيْدِ بْنِ كَاسِبٍ ثنا يَعْلَى بْنُ شَبِيبٍ الْمَكِّيُّ ثنا هِشَامُ بْنُ عُرْوَةَ عَنْ أَبِيهِ عَنْ عَائِشَةَ قَالَتْ

كَانَ الرَّجُلُ يُطَلِّقُ امْرَأَتَهُ مَا شَاءَ أَنْ يُطَلِّقَهَا وَإِنْ طَلَّقَهَا مِائَةً أَوْ أَكْثَرَ إِذَا ارْتَجَعَهَا قَبْلَ أَنْ تَنْقَضِيَ عِدَّتُهَا حَتَّى قَالَ الرَّجُلُ لِامْرَأَتِهَ وَاللَّهِ لَا أُطَلِّقُكِ فَتَبِينِي مِنِّي وَلَا آوِيكِ إِلَيَّ قَالَتْ وَكَيْفَ ذَاكَ؟ قَالَ أُطَلِّقُكِ وَكُلَّمَا هَمَّتْ عِدَّتُكِ أَنْ تَنْقَضِيَ ارْتَجَعْتُكِ ثُمَّ أُطَلِّقُكِ وَأَفْعَلُ ذَلِكَ فَشَكَتِ الْمَرْأَةُ ذَلِكَ إِلَى عَائِشَةَ فَذَكَرَتْ ذَلِكَ عَائِشَةُ لِرَسُولِ اللَّهِ ﷺ فَسَكَتَ فَلَمْ يَقُلْ شَيْئًا حَتَّى نَزَلَ الْقُرْآنُ {الطَّلَاقُ مَرَّتَانِ فَإِمْسَاكٌ بِمَعْرُوفٍ أَوْ تَسْرِيحٌ بِإِحْسَانٍ} [البقرة 229] « »  

هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ وَلَمْ يَتَكَلَّمْ أَحَدٌ فِي يَعْقُوبَ بْنِ حُمَيْدٍ بِحُجَّةٍ وَنَاظَرَنِي شَيْخُنَا أَبُو أَحْمَدَ الْحَافِظُ وَذَكَرَ أَنَّ الْبُخَارِيُّ رَوَى عَنْهُ فِي الصَّحِيحِ فَقُلْتُ هَذَا يَعْقُوبُ بْنُ مُحَمَّدٍ الزُّهْرِيُّ وَثَبَتَ هُوَ عَلَى مَا قَالَ قد ضعفه غير واحد

"The people were such that a man would divorce his wife when he wanted to divorce her, and she remained his wife when he wanted to take her back while she was in her Iddah, and he could divorce a hundred times, or even more, such that a man could say to his wife: 'By Allah! I will neither divorce you irrevocably, nor give you residence ever!' She would say: 'And how is that?' He would say: 'I will divorce you, and whenever your Iddah is just about to end I will take you back. So a woman went to Aishah to inform her about that, and Aishah was silent until the Prophet came. So she told him and the Prophet was silent, until the Qur'an was revealed: Divorce is two times, after that, retain her on reasonable terms or release her with kindness.'" So Aishah said: "So the people could carry on with divorce in the future, (knowing) who was divorced, and who was not divorced."  

الترمذي:١١٩٢حَدَّثَنَا قُتَيْبَةُ حَدَّثَنَا يَعْلَى بْنُ شَبِيبٍ عَنْ هِشَامِ بْنِ عُرْوَةَ عَنْ أَبِيهِ عَنْ عَائِشَةَ قَالَتْ

قَالَ أَبُو عِيسَى وَهَذَا أَصَحُّ مِنْ حَدِيثِ يَعْلَى بْنِ شَبِيبٍ
malik:29-88Mālik > Hishām b. ʿUrwah from his father

Yahya related to me from Malik from Hisham ibn Urwa that his father said, "It used to be that a man would divorce his wife and then return to her before her idda was over, and that was alright, even if he divorced her a thousand times. The man went to his wife and then divorced her and when the end of her idda was in sight, he took her back and then divorced her and said, 'No! By Allah, I will not go to you and you will never be able to marry again.' Allah, the Blessed, the Exalted, sent down, 'Divorce is twice, then honourable retention or setting free kindly.' People then turned towards divorce in a new light from that day whether or not they were divorced or not divorced."  

مالك:٢٩-٨٨وَحَدَّثَنِي عَنْ مَالِكٍ عَنْ هِشَامِ بْنِ عُرْوَةَ عَنْ أَبِيهِ
