85.5 Inheritance of the offspring from dead fathers and mothers

٨٥۔٥ باب مِيرَاثِ الْوَلَدِ مِنْ أَبِيهِ وَأُمِّهِ

[Machine] Zaid Ibn Thabit said: If a man or a woman leaves behind one child, that child receives half of the inheritance. And if there are two or more children, they receive two-thirds of the inheritance. If there is a male among them, he is given a share that is equivalent to that of the females. This is followed by fulfilling the obligatory bequests. Whatever is left after that belongs to the male, equivalent to the share of two females.

وَقَالَ زَيْدُ بْنُ ثَابِتٍ إِذَا تَرَكَ رَجُلٌ أَوِ امْرَأَةٌ بِنْتًا فَلَهَا النِّصْفُ، وَإِنْ كَانَتَا اثْنَتَيْنِ أَوْ أَكْثَرَ فَلَهُنَّ الثُّلُثَانِ، وَإِنْ كَانَ مَعَهُنَّ ذَكَرٌ بُدِئَ بِمَنْ شَرِكَهُمْ، فَيُؤْتَى فَرِيضَتَهُ، فَمَا بَقِيَ فَلِلذَّكَرِ مِثْلُ حَظِّ الأُنْثَيَيْنِ.

The Prophet ﷺ said, "Give the Fara'id (the shares of the inheritance that are prescribed in the Qur'an) to those who are entitled to receive it. Then whatever remains, should be given to the closest male relative of the deceased."
