البيهقي:٢٠٦٣٤ – أَخْبَرَنَا أَبُو الْحُسَيْنِ عَلِيُّ بْنُ مُحَمَّدِ بْنِ عَبْدِ اللهِ بْنِ بِشْرَانَ الْعَدْلُ بِبَغْدَادَ أنبأ أَبُو عَلِيٍّ إِسْمَاعِيلُ بْنُ مُحَمَّدٍ الصَّفَّارُ ح وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو سَعِيدٍ مُحَمَّدُ بْنُ مُوسَى قَالَا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ قَالَا ثنا الْحَسَنُ بْنُ عَلِيِّ بْنِ عَفَّانَ الْعَامِرِيُّ ثنا زَيْدُ بْنُ الْحُبَابِ حَدَّثَنِي سَيْفُ بْنُ سُلَيْمَانَ الْمَكِّيُّ حَدَّثَنِي قَيْسُ بْنُ سَعْدٍ عَنْ عَمْرِو بْنِ دِينَارٍ عَنِ ابْنِ عَبَّاسٍ ؓ أَنَّ

رَسُولَ اللهِ ﷺ قَضَى بِشَاهِدٍ وَيَمِينٍ

أَخْرَجَهُ مُسْلِمُ بْنُ الْحَجَّاجِ فِي الصَّحِيحِ عَنْ أَبِي بَكْرِ بْنِ أَبِي شَيْبَةَ وَمُحَمَّدِ بْنِ عَبْدِ اللهِ بْنِ نُمَيْرٍ عَنْ زَيْدِ بْنِ الْحُبَابِ وَأَخْرَجَهُ أَبُو دَاوُدَ السِّجِسْتَانِيُّ فِي كِتَابِ السُّنَنِ عَنْ عُثْمَانَ بْنِ أَبِي شَيْبَةَ وَالْحَسَنِ بْنِ عَلِيٍّ عَنْ زَيْدِ بْنِ الْحُبَابِ وَكَذَلِكَ

Yahya said, "Malik said from Jafar ibn Muhammad from his father that the Messenger of Allah ﷺ pronounced judgement on the basis of an oath with one witness."

مالك:٣٦-٨ – قَالَ يَحْيَى قَالَ مَالِكٌ عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ عَنْ أَبِيهِ

أَنَّ رَسُولَ اللَّهِ ﷺ قَضَى بِالْيَمِينِ مَعَ الشَّاهِدِ
