عَنْ أَهْلِ الدَّارِ مِنْ أَهْلِ الْحَرْبِ يَقْسِمُونَ الدَّارَ وَيَمْلِكُ بَعْضُهُمْ عَلَى بَعْضٍ عَلَى ذَلِكَ الْقَسْمِ وَيُسْلِمُونَ ثُمَّ يُرِيدُ بَعْضُهُمْ أَنْ يَنْقُضَ ذَلِكَ الْقَسْمَ وَيَقْسِمَهُ عَلَى قَسْمِ الْأَمْوَالِ فَقَالَ لَيْسَ ذَلِكَ لَهُ فَقُلْتُ وَمَا الْحُجَّةُ فِي ذَلِكَ؟ قَالَ الِاسْتِدْلَالُ بِمَعْنَى الْإِجْمَاعِ وَالسُّنَّةِ فَذَكَرَ مَا لَا يُؤَاخَذُونَ بِهِ مِنْ قَتْلِ بَعْضِهِمْ بَعْضًا وَسَبْيِ بَعْضِهِمْ بَعْضًا وَغَصْبِ بَعْضِهِمْ بَعْضًا ثُمَّ قَالَ مَعَ أَنَّهُ أَخْبَرَنَا مَالِكٌ عَنْ ثَوْرِ بْنِ زَيْدٍ الدِّيلِيِّ قَالَ بَلَغَنِي أَنَّ رَسُولَ اللهِ ﷺ قَالَ أَيُّمَا دَارٍ أَوْ أَرْضٍ قُسِمَتْ فِي الْجَاهِلِيَّةِ فَهِيَ عَلَى قَسْمِ الْجَاهِلِيَّةِ وَأَيُّمَا دَارٍ أَوْ أَرْضٍ أَدْرَكَهَا الْإِسْلَامُ لَمْ تُقْسَمْ فَهِيَ عَلَى قَسْمِ الْإِسْلَامِ قَالَ الشَّافِعِيُّ وَنَحْنُ نَرْوِي فِيهِ حَدِيثًا أَثْبَتَ مِنْ هَذَا بَلَغَنِي بِمِثْلِ مَعْنَاهُ قَالَ الشَّيْخُ وَلَعَلَّهُ أَرَادَ مَا
