البيهقي:١٦٣٩٠ – أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ ثنا بَحْرُ بْنُ نَصْرٍ ثنا عَبْدُ اللهِ بْنُ وَهْبٍ حَدَّثَنِي سُفْيَانُ الثَّوْرِيُّ عَنِ الْأَشْعَثِ بْنِ سَوَّارٍ عَنْ عَامِرٍ الشَّعْبِيِّ قَالَ جَعَلَ عُمَرُ بْنُ الْخَطَّابِ ؓ الدِّيَةَ فِي ثَلَاثِ سِنِينَ وَثُلُثَيِ الدِّيَةِ فِي سَنَتَيْنِ وَنِصْفَ الدِّيَةِ فِي سَنَتَيْنِ وَثُلُثَ الدِّيَةِ فِي سَنَةٍ قَالَ وَقَالَ لِي مَالِكٌ مِثْلُ ذَلِكَ سَوَاءٌ وَقَالَ لِي مَالِكٌ فِي النِّصْفِ يَكُونُ فِي سَنَتَيْنِ؛

لِأَنَّهُ زِيَادَةٌ عَلَى الثُّلُثِ
