البيهقي:١٦٣٣٩ – أَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ الْمُزَكِّي ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ أنبأ الشَّافِعِيُّ أنبأ سُفْيَانُ بْنُ عُيَيْنَةَ عَنْ صَدَقَةَ بْنِ يَسَارٍ قَالَ أَرْسَلْنَا إِلَى سَعِيدِ بْنِ الْمُسَيِّبِ نَسْأَلُهُ عَنْ دِيَةِ الْمُعَاهِدِ فَقَالَ قَضَى فِيهِ عُثْمَانُ بْنُ عَفَّانَ ؓ بِأَرْبَعَةِ آلَافٍ قَالَ فَقُلْنَا فَمَنْ قَبْلَهُ؟ قَالَ فَحَصَبَنَا قَالَ الشَّافِعِيُّ هُمُ الَّذِينَ سَأَلُوهُ آخِرًا وَرُوِيَ

عَنْ عُثْمَانَ بْنِ عَفَّانَ ؓ بِخِلَافِهِ وَهُوَ عَنْهُ بِإِسْنَادَيْنِ أَحَدُهُمَا غَيْرُ مَحْفُوظٍ وَالْآخَرُ مُنْقَطِعٌ قَدْ ذَكَرْنَاهُمَا فِي بَابِ لَا يُقْتَلُ مُؤْمِنٌ بِكَافِرٍ
