bayhaqi:15231Abū Zakariyyā b. Abū Isḥāq from my father

[Machine] The man swears to his wife by Allah that he will not have sexual relations with her. She then observes a waiting period of four months. If he still decides to have sexual relations with her, he must atone for breaking his oath by either feeding ten poor people, or clothing them, or freeing a slave. If he is unable to do so, he must fast for three days. If four months have passed and he has not had sexual relations with her, the sultan has the choice to either fulfill his promise and keep her, or divorce her, as Allah has commanded.  

البيهقي:١٥٢٣١أَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ أنا أَبُو الْحَسَنِ الطَّرَائِفِيُّ نا عُثْمَانُ بْنُ سَعِيدٍ نا عَبْدُ اللهِ بْنُ صَالِحٍ عَنْ مُعَاوِيَةَ بْنِ صَالِحٍ عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ عَنِ ابْنِ عَبَّاسٍ ؓ فِي آيَةِ الْإِيلَاءِ قَالَ

الرَّجُلُ يَحْلِفُ لِامْرَأَتِهِ بِاللهِ لَا يَنْكِحُهَا تَتَرَبَّصُ أَرْبَعَةَ أَشْهُرٍ فَإِنْ هُوَ نَكَحَهَا كَفَّرَ عَنْ يَمِينِهِ بِإِطْعَامِ عَشَرَةِ مَسَاكِينَ أَوْ كِسْوَتِهِمْ أَوْ تَحْرِيرِ رَقَبَةٍ فَمَنْ لَمْ يَجِدْ فَصِيَامُ ثَلَاثَةِ أَيَّامٍ وَإِنْ مَضَتْ أَرْبَعَةُ أَشْهُرٍ قَبْلَ أَنْ يَنْكِحَهَا خَيَّرَهُ السُّلْطَانُ إِمَّا أَنْ يُفِيءَ فَيُرَاجِعَ وَإِمَّا أَنْ يَعْزِمَ فَيُطَلِّقَ كَمَا قَالَ اللهُ سُبْحَانَهُ وَتَعَالَى
