[Machine] I proposed to Qudama ibn Maz'un's daughter, the daughter of Uthman ibn Maz'un, and he married her to me. Then Mugheerah ibn Shu'ba came to her mother and enticed her with money, so she inclined towards him and the slave girl inclined towards her mother's desire. They both refused until their matter was escalated to the Messenger of Allah ﷺ . Qudama ibn Maz'un said, "My niece was entrusted to me, and I married her to Abdullah ibn Umar. I did not fall short in righteousness or ability with her, but she is a woman, and indeed she inclined towards her mother's desire." The Messenger of Allah ﷺ said, "She is an orphan and should not be married without her consent." Qudama took her back from me, even though I had ownership of her, and they married her to Mugheerah ibn Shu'ba.  

البيهقي:١٣٦٥٦أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ إِسْحَاقَ ثنا أَبُو خَيْثَمَةَ ثنا يَعْقُوبُ بْنُ إِبْرَاهِيمَ ثنا أَبِي عَنِ ابْنِ إِسْحَاقَ حَدَّثَنِي عُمَرُ بْنُ حُسَيْنِ بْنِ عَبْدِ اللهِ مَوْلَى آلِ حَاطِبٍ عَنْ نَافِعٍ مَوْلَى عَبْدِ اللهِ بْنِ عُمَرَ عَنْ عَبْدِ اللهِ بْنِ عُمَرَ ؓ قَالَ تُوُفِّيَ عُثْمَانُ بْنُ مَظْعُونٍ ؓ وَتَرَكَ ابْنَةً لَهُ مِنْ خُوَيْلَةَ بِنْتِ حَكِيمِ بْنِ أُمَيَّةَ بْنِ حَارِثَةَ بْنِ الْأَوْقَصِ قَالَ وَأَوْصَى إِلَى أَخِيهِ قُدَامَةَ بْنِ مَظْعُونٍ قَالَ عَبْدُ اللهِ فَهُمَا خَالِايَ قَالَ

خَطَبْتُ إِلَى قُدَامَةَ بْنِ مَظْعُونٍ ابْنَةَ عُثْمَانَ بْنِ مَظْعُونٍ فَزَوَّجَنِيهَا فَدَخَلَ الْمُغِيرَةُ بْنُ شُعْبَةَ ؓ إِلَى أُمِّهَا فَأَرْغَبَهَا فِي الْمَالِ فَحَطَّتْ إِلَيْهِ وَحَطَّتِ الْجَارِيَةُ إِلَى هَوَى أُمِّهَا فَأَبَتَا حَتَّى ارْتَفَعَ أَمْرُهُمَا إِلَى رَسُولِ اللهِ ﷺ قَالَ فَقَالَ قُدَامَةُ بْنُ مَظْعُونٍ ابْنَةُ أَخِي أَوْصَى بِهَا إِلِيَّ فَزَوَّجْتُهَا مِنْ عَبْدِ اللهِ بْنِ عُمَرَ فَلَمْ أُقَصِّرْ بِهَا فِي الصَّلَاحِ وَلَا فِي الْكَفَاءَةِ وَلَكِنَّهَا امْرَأَةٌ وَإِنَّهَا حَطَّتْ إِلَى هَوَى أُمِّهَا قَالَ فَقَالَ رَسُولُ اللهِ ﷺ هِيَ يَتِيمَةٌ وَلَا تُنْكَحُ إِلَّا بِإِذْنِهَا قَالَ فَانْتُزِعَتْ وَاللهِ مِنِّي بَعْدَ مَا مُلِّكْتُهَا وَزَوَّجُوهَا الْمُغِيرَةَ بْنَ شُعْبَةَ ؓ

So she inclined towards him, and the slave girl inclined towards her mother's wishes. They both refused until their matter was taken to the Messenger of Allah ﷺ . Qudamah bin Mad'un said, "O Messenger of Allah, my brother's daughter was entrusted to me, so I married her to her cousin Abdullah bin Umar. I did not fall short in her righteousness or competence. However, she desires her mother's wishes." The Messenger of Allah ﷺ said, "She is an orphan, and no one can marry her without her consent." He then said, "By Allah, she was taken away from me after I married her," so they married her to Al-Mughirah.

[Machine] Uthman ibn Mazh'un passed away and left behind a daughter from Khawlah bint Hakim ibn Umayyah. He made a bequest to his brother Qudamah ibn Mazh'un, and they were paternal cousins. I proposed to Qudamah for the hand of Uthman's daughter, and he married her to me. Al-Mughirah then approached her mother and convinced her with wealth, so she agreed and the daughter followed her mother's desire. The matter was then brought to the attention of the Prophet ﷺ . Qudamah said, "O Messenger of Allah, she is my niece and her father has entrusted her to me. I married her to Ibn 'Umar, and I did not compromise on righteousness and suitability. However, she is a woman and she followed her mother's desire." The Messenger of Allah ﷺ said, "She is an orphan and should not be married without her consent." She was then taken away from me by Allah, even after I had ownership over her. So she was married to Al-Mughirah ibn Shu'bah.  

البيهقي:١٣٦٩٢أَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ أنبأ عَلِيُّ بْنُ عُمَرَ الْحَافِظُ قَالَ قُرِئَ عَلَى ابْنِ صَاعِدٍ وَأَنَا أَسْمَعُ حَدَّثَكُمْ عَبْدُ اللهِ بْنُ سَعْدٍ الزُّهْرِيُّ قَالَ ثنا عَمِّي ثنا أَبِي عَنِ ابْنِ إِسْحَاقَ حَدَّثَنِي عُمَرُ بْنُ حُسَيْنٍ مَوْلَى آلِ حَاطِبٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ قَالَ
