[Machine] About the Prophet ﷺ that he said, "There is no marriage except with a guardian." He said, "Yes." Al-Hasan (ra) said, "Even if he (the woman's guardian) speaks on her behalf." The sheikh (may Allah have mercy on him) said, "And likewise."

البيهقي:١٣٦٢٣ – أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ قَالَ سَمِعْتُ يَحْيَى بْنَ مَنْصُورٍ يَقُولُ سَمِعْتُ الْحَسَنَ بْنَ سُفْيَانَ يَقُولُ سَمِعْتُ أَبَا كَامِلٍ الْفُضَيْلَ بْنَ الْحُسَيْنِ يَقُولُ ثنا أَبُو دَاوُدَ عَنْ شُعْبَةَ قَالَ قَالَ سُفْيَانُ الثَّوْرِيُّ لِأَبِي إِسْحَاقَ سَمِعْتُ أَبَا بُرْدَةَ يُحَدِّثُ

عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ لَا نِكَاحَ إِلَّا بِوَلِيٍّ قَالَ نَعَمْ قَالَ الْحَسَنُ وَلَوْ قَالَ عَنْ أَبِيهِ لَقَالَ نَعَمْ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَكَذَلِكَ

رَوَاهُ مَحْمُودُ بْنُ غَيْلَانَ وَأَبُو مُوسَى عَنْ أَبِي دَاوُدَ الطَّيَالِسِيِّ قَالَ أَبُو عِيسَى التِّرْمِذِيُّ رَحِمَهُ اللهُ فِي كِتَابِ الْعِلَلِ حَدِيثُ أَبِي بُرْدَةَ عَنْ أَبِي مُوسَى عِنْدِي وَاللهُ أَعْلَمُ أَصَحُّ وَإِنْ كَانَ سُفْيَانُ الثَّوْرِيُّ وَشُعْبَةُ لَا يَذْكُرَانِ فِيهِ عَنْ أَبِي مُوسَى لِأَنَّهُ قَدْ دَلَّ فِي حَدِيثِ شُعْبَةَ أَنَّ سَمَاعَهُمَا جَمِيعًا فِي وَقْتٍ وَاحِدٍ وَهَؤُلَاءِ الَّذِينَ رَوَوْا عَنْ أَبِي إِسْحَاقَ عَنْ أَبِي بُرْدَةَ عَنْ أَبِي مُوسَى سَمِعُوا فِي أَوْقَاتٍ مُخْتَلِفَةٍ وَقَالَ يُونُسُ بْنُ أَبِي إِسْحَاقَ قَدْ رَوَى هَذَا عَنْ أَبِيهِ وَقَدْ أَدْرَكَ يُونُسُ بَعْضَ مَشَايِخِ أَبِيهِ فَهُوَ قَدِيمُ السَّمَاعِ وَإِسْرَائِيلُ قَدْ رَوَاهُ وَهُوَ أَثْبَتُ أَصْحَابِ أَبِي إِسْحَاقَ بَعْدَ شُعْبَةَ وَالثَّوْرِيِّ
