[Machine] The Messenger of Allah ﷺ sent me to a man who had married his father's wife. He commanded me to kill him and take his wealth. This is the narration of Al-Rawd Al-Bariyy, and some of our companions have adopted it, believing that he married her thinking it was permissible, but then he apostatized, and therefore, it is obligatory to kill him and take his wealth. Al-Shafi'i (may Allah have mercy on him) said, and it was narrated that Muawiyah wrote to Ibn Abbas and Zaid ibn Thabit, asking them about the inheritance of an apostate. They replied that it should go to the state treasury. Al-Shafi'i meant that it is booty.  

البيهقي:١٢٤٥٩أَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ أنا أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمِصْرِيُّ ثنا عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ أَبِي مَرْيَمَ ثنا عَلِيُّ بْنُ مَعْبَدٍ ثنا عُبَيْدُ اللهِ بْنُ عَمْرٍو ح وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنا أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا عَمْرُو بْنُ قِسْطٍ الرَّقِّيُّ ثنا عُبَيْدُ اللهِ بْنُ عَمْرٍو عَنْ زَيْدِ بْنِ أَبِي أُنَيْسَةَ عَنْ عَدِيِّ بْنِ ثَابِتٍ عَنْ يَزِيدَ بْنِ الْبَرَاءِ عَنْ أَبِيهِ قَالَ لَقِيتُ عَمِّي وَمَعَهُ رَايَةٌ فَقُلْتُ أَيْنَ تُرِيدُ؟ قَالَ

بَعَثَنِي رَسُولُ اللهِ ﷺ إِلَى رَجُلٍ نَكَحَ امْرَأَةَ أَبِيهِ فَأَمَرَنِي أَنْ أَضْرِبَ عُنُقَهُ وَآخُذَ مَالَهُ لَفْظُ حَدِيثِ الرُّوذْبَارِيِّ وَقَدْ حَمَلَ هَذَا بَعْضُ أَصْحَابِنَا عَلَى أَنَّهُ نَكَحَهَا مُعْتَقِدًا لِإِبَاحَتِهِ فَصَارَ بِهِ مُرْتَدًّا وَجَبَ قَتْلُهُ وَأَخْذُ مَالِهِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَقَدْ رُوِيَ أَنَّ مُعَاوِيَةَ كَتَبَ إِلَى ابْنِ عَبَّاسٍ وَزَيْدِ بْنِ ثَابِتٍ يَسْأَلُهُمَا عَنْ مِيرَاثِ الْمُرْتَدِّ فَقَالَا لِبَيْتِ الْمَالِ قَالَ الشَّافِعِيُّ يَعْنِيَانِ أَنَّهُ فَيْءٌ

[Machine] Abu Jaddi sent Muawiyah to a man who married his father's wife. He ordered him to be killed and his wealth to be distributed. Our companions said, "Killing and confiscating wealth is only valid for apostasy. It is as if he had made it permissible with knowledge of its prohibition. Allah knows best." Al-Shafi'i, may Allah have mercy on him, said that it was narrated that Muawiyah wrote to Ibn Abbas and Zaid bin Thabit, asking them about the inheritance of an apostate. They said, "It belongs to the Bayt al-Mal (state treasury)." Al-Shafi'i said, meaning that it is seized.
