[Machine] I heard a man from Muzaynah asking the Prophet ﷺ , mentioning a narration from Ibn Idris. He asked him about fruits and what is inside the sleeves (of garments). He replied, "Whoever eats with his mouth and does not take handfuls of food, then there is nothing upon him. And whoever is found to have carried and bears the cost, then he must pay double and be lashed with a whip. And whatever he has taken from the shackles, then it is to be cut off when it reaches the amount that is usually taken. Then the price is the same as the hijazi dinar." The man asked, "O Messenger of Allah, what do we find in a public road with gathered items?" He said, "Identify it by surrounding it, and if its owner comes, return it to him, otherwise it is yours." He asked, "O Messenger of Allah, what do we find in ruins?" He replied, "In it, and Furfur has a fifth."  

أحمد:٦٩٣٦حَدَّثَنَا يَزِيدُ أَخْبَرَنَا مُحَمَّدُ بْنُ إِسْحَاقَ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ

سَمِعْتُ رَجُلًا مِنْ مُزَيْنَةَ وَهُوَ يَسْأَلُ النَّبِيَّ ﷺ فَذَكَرَ نَحْوَ حَدِيثِ ابْنِ إِدْرِيسَ قَالَ وَسَأَلَهُ عَنِ الثِّمَارِ وَمَا كَانَ فِي أَكْمَامِهِ؟ فَقَالَ مَنْ أَكَلَ بِفَمِهِ وَلَمْ يَتَّخِذْ خُبْنَةً فَلَيْسَ عَلَيْهِ شَيْءٌ وَمَنْ وُجِدَ قَدِ احْتَمَلَ فَفِيهِ ثَمَنُهُ مَرَّتَيْنِ وَضَرْبُ نَكَالٍ فَمَا أَخَذَ مِنْ جِرَانِهِ فَفِيهِ الْقَطْعُ إِذَا بَلَغَ مَا يُؤْخَذُ مِنْ ذَلِكَ ثَمَنَ الْمِجَنِّ قَالَ يَا رَسُولَ اللهِ مَا نَجِدُ فِي السَّبِيلِ الْعَامِرِ مِنَ اللُّقَطَةِ قَالَ عَرِّفْهَا حَوْلًا فَإِنْ جَاءَ صَاحِبُهَا وَإِلَّا فَهِيَ لَكَ قَالَ يَا رَسُولَ اللهِ مَا نَجِدُ فِي الْخَرِبِ الْعَادِيِّ؟ قَالَ فِيهِ وَفِي الرِّكَازِ الْخُمُسُ

[Machine] I heard a man from Muzaynah asking the Messenger of Allah ﷺ , he said, "O Messenger of Allah, I have come to ask you about a stray camel. What should I do if it has its saddle and water bag and is eating from the trees and drinking water? Should I leave it until its owner comes?" He said, "Leave it until its owner comes." He then asked, "What about a stray sheep?" He said, "It belongs to you, your brother, or the wolf. It should be gathered until its owner comes." He asked, "What about the stray female camel that is found in its designated grazing area?" He said, "Its price is double with the addition of a whip and whatever is taken from its udders, and includes the cutting if it reaches the stage where it can be cut. Then its price is the price of an adult she-camel." He asked, "O Messenger of Allah, what about the fruits and what is taken from them in their sleeves?" He said, "Whoever takes it with his mouth without picking it up, then there is nothing on him. And whoever carries it, then its price is double with the addition of a whip and a stick. And whatever is taken from its branch, then its price is the price of an adult she-camel." He asked, "O Messenger of Allah, what about the abandoned things found in the way of the Amarah?" He said, "Announce it, and if its owner is found, return it to him, otherwise it is yours." He asked, "What about the abandoned things found in the regular desert?" He said, "It belongs to you, and the fifth belongs to the public treasury."  

أحمد:٦٦٨٣حَدَّثَنَا يَعْلَى حَدَّثَنَا مُحَمَّدُ بْنُ إِسْحَاقَ عَنْ عَمْرِو بْنِ شُعَيبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ

سَمِعْتُ رَجُلًا مِنْ مُزَيْنَةَ يَسْأَلُ رَسُولَ اللهِ ﷺ قَالَ يَا رَسُولَ اللهِ جِئْتُ أَسْأَلُكَ عَنِ الضَّالَّةِ مِنَ الْإِبِلِ؟ قَالَ مَعَهَا حِذَاؤُهَا وَسِقَاؤُهَا تَأْكُلُ الشَّجَرَ وَتَرِدُ الْمَاءَ فَدَعْهَا حَتَّى يَأْتِيَهَا بَاغِيهَا قَالَ الضَّالَّةُ مِنَ الْغَنَمِ؟ قَالَ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ تَجْمَعُهَا حَتَّى يَأْتِيَهَا بَاغِيهَا قَالَ الْحَرِيسَةُ الَّتِي تُوجَدُ فِي مَرَاتِعِهَا؟ قَالَ فِيهَا ثَمَنُهَا مَرَّتَيْنِ وَضَرْبُ نَكَالٍ وَمَا أُخِذَ مِنْ عَطَنِهِ فَفِيهِ الْقَطْعُ إِذَا بَلَغَ مَا يُؤْخَذُ مِنْ ذَلِكَ ثَمَنَ الْمِجَنِّ قَالَ يَا رَسُولَ اللهِ فَالثِّمَارُ وَمَا أُخِذَ مِنْهَا فِي أَكْمَامِهَا؟ قَالَ مَنْ أَخَذَ بِفَمِهِ وَلَمْ يَتَّخِذْ خُبْنَةً فَلَيْسَ عَلَيْهِ شَيْءٌ وَمَنِ احْتَمَلَ فَعَلَيْهِ ثَمَنُهُ مَرَّتَيْنِ وَضَرْبًا وَنَكَالًا وَمَا أَخَذَ مِنْ أَجْرَانِهِ فَفِيهِ الْقَطْعُ إِذَا بَلَغَمَا يُؤْخَذُ مِنْ ذَلِكَ ثَمَنَ الْمِجَنِّ قَالَ يَا رَسُولَ اللهِ وَاللُّقَطَةُ نَجِدُهَا فِي سَبِيلِ الْعَامِرَةِ؟ قَالَ عَرِّفْهَا حَوْلًا فَإِنْ وُجِدَ بَاغِيهَا فَأَدِّهَا إِلَيْهِ وَإِلَّا فَهِيَ لَكَ قَالَ مَا يُوجَدُ فِي الْخَرِبِ الْعَادِيِّ؟ قَالَ فِيهِ وَفِي الرِّكَازِ الْخُمُسُ

[Machine] I heard the Messenger of Allah ﷺ and a man from Muzaynah asking him about a lost camel. He said, "If it has its shoes and water container with it, it eats from the trees and quenches its thirst from the water, so leave it until its owner comes. Then he asked him about a lost sheep. He said, "It belongs to you, your brother, or the wolf. Gather them until its owner comes". He then asked him about the stray camels in the pastures. He said, "Its price is double and its strike is equivalent to two camels. Whatever is taken from what is given, the owner has the right to obtain it until it reaches the value of a she-camel. He asked him, "O Messenger of Allah, can we find the Lqata (stray animal) in the traveled road?" He said, "Recognize it for a year. If its owner comes, give it to him, otherwise, it belongs to you". He asked, "O Messenger of Allah, what about what is found in the desolate areas?" He said, "It belongs to you, and in the fifth (of its value) is the Rikaaz."  

أحمد:٦٨٩١حَدَّثَنَا ابْنُ إِدْرِيسَ سَمِعْتُ ابْنَ إِسْحَاقَ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ

سَمِعْتُ رَسُولَ اللهِ ﷺ وَرَجُلًا مِنْ مُزَيْنَةَ يَسْأَلُهُ عَنْ ضَالَّةِ الْإِبِلِ؟ فَقَالَ مَعَهَا حِذَاؤُهَا وَسِقَاؤُهَا تَأْكُلُ الشَّجَرَ وَتَرِدُ الْمَاءَ فَذَرْهَا حَتَّى يَأْتِيَ بَاغِيهَا قَالَ وَسَأَلَهُ عَنْ ضَالَّةِ الْغَنَمِ؟ فَقَالَ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ اجْمَعْهَا إِلَيْكَ حَتَّى يَأْتِيَ بَاغِيهَا وَسَأَلَهُ عَنِ الْحَرِيسَةِ الَّتِي تُوجَدُ فِي مَرَاتِعِهَا؟ قَالَ فَقَالَ فِيهَا ثَمَنُهَا مَرَّتَيْنِ وَضَرْبُ نَكَالٍ قَالَ فَمَا أُخِذَ مِنْ أَعْطَانِهِ فَفِيهِ الْقَطْعُ فَإِذَا بَلَغَ مَا يُؤْخَذُ مِنْ ذَلِكَ ثَمَنَ الْمِجَنِّ فَسَأَلَهُ فَقَالَ يَا رَسُولَ اللهِ اللُّقَطَةُ نَجِدُهَا فِي السَّبِيلِ الْعَامِرِ؟ قَالَ عَرِّفْهَا سَنَةً فَإِنْ جَاءَ صَاحِبُهَا وَإِلَّا فَهِيَ لَكَ قَالَ يَارَسُولَ اللهِ مَا يُوجَدُ فِي الْخَرَابِ الْعَادِيِّ؟ قَالَ فِيهِ وَفِي الرِّكَازِ الْخُمُسُ

[Machine] I heard a man from Muzaynah asking the Messenger of Allah ﷺ about the stray animal. He mentioned the hadith and then asked him about the fruits that a person obtains. The Messenger of Allah ﷺ replied, "He should not take from the pockets, meaning the tops of the palm trees, what he carries, and he should bear its cost and its equivalent along with it, and a blow with a stick is not permitted, and what is in its leaf bundles, he should take it, when it reaches the price of the mijann (a unit of measurement), and if he eats from it and does not take, then he should consider it as a gift, and there is nothing upon him. And this is if it is correct, and this can be understood that there is nothing upon him in it, in terms of cutting, as long as he does not take it out of the haram (sanctuary)."  

البيهقي:١٩٦٥٣فَمِنْهَا مَا أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا أَحْمَدُ بْنُ عَبْدِ الْحَمِيدِ الْحَارِثِيُّ ثنا أَبُو أُسَامَةَ عَنِ الْوَلِيدِ بْنِ كَثِيرٍ حَدَّثَنِي عَمْرُو بْنُ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ

سَمِعْتُ رَجُلًا مِنْ مُزَيْنَةَ سَأَلَ رَسُولَ اللهِ ﷺ وَأَنَا أَسْمَعُ عَنِ الضَّالَّةِ فَذَكَرَ الْحَدِيثَ قَالَ ثُمَّ سَأَلَهُ عَنِ الثِّمَارِ يُصِيبُهُ الرَّجُلُ قَالَ مَا أَخَذَ فِي أَكْمَامِهِ يَعْنِي رُءُوسَ النَّخْلِ فَاحْتَمَلَهُ فَثَمَنُهُ وَمِثْلُهُ مَعَهُ وَضَرْبٌ نَكَالٌ وَمَا كَانَ فِي أَجْرَانِهِ فَأَخَذَ فَفِيهِ الْقَطْعُ إِذَا بَلَغَ ذَلِكَ ثَمَنَ الْمِجَنِّ وَإِنْ أَكَلَ بِفِيهِ وَلَمْ يَأْخُذْ فَيَتَّخِذْ خُبْنَةً فَلَيْسَ عَلَيْهِ شَيْءٌ وَهَذَا إِنْ صَحَّ فَمَحْمُولٌ عَلَى أَنْ لَيْسَ عَلَيْهِ فِيهِ قَطْعٌ حِينَ لَمْ يُخْرِجْهُ مِنَ الْحِرْزِ
