[Machine] He heard a man from Muzaynah ask the Messenger of Allah ﷺ, "What do you say about a stray camel?" The Messenger of Allah ﷺ said, "What do you and it have? It has its shoes and its water bag." He said, "What about a stray sheep?" He said, "It belongs to you or your brother or the wolf." He said, "Then who deserves it if someone takes it from its pasture?" He said, "He will be punished and fined similar to its value." He said, "What if someone takes it by the neck rope or takes it out of the sheepfold when it is placed there for the night?" He said, "He has to pay the price for it and will be punished. And if someone takes something from it after it has settled in a corral or breaks a gate to get it, then he has to pay for the damaged goods." He said, "O Messenger of Allah, what about fruits that have ripened on their branches?" The Messenger of Allah ﷺ said, "There is no blame on the one who eats in such a way. But anyone who took a bunch of grapes will have to pay for it and be punished. And if anyone takes a camel load from it after it has sought refuge in a guarded enclosure or after he has dried the branches up, then what he takes will be assessed at the price of the stolen property and he will have to pay for it. He said, "O Messenger of Allah, what about buried treasures, whether they are found in ruins or buried in the ground?" The Messenger of Allah ﷺ said, "In those cases, they are subject to the fifth."  

أحمد:٦٧٤٦حَدَّثَنَا الْحُسَيْنُ حَدَّثَنِي ابْنُ أَبِي الزِّنَادِ عَنْ عَبْدِ الرَّحْمَنِ يَعْنِي ابْنَ الْحَارِثِ أَخْبَرَنِي عَمْرُو بْنُ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ

أَنَّهُ سَمِعَ رَجُلًا مِنْ مُزَيْنَةَ سَأَلَ رَسُولَ اللهِ ﷺ مَاذَا تَقُولُ يَا رَسُولَ اللهِ فِي ضَالَّةِ الْإِبِلِ؟ فَقَالَ رَسُولُ اللهِ ﷺ مَا لَكَ وَلَهَا؟ مَعَهَا حِذَاؤُهَا وَسِقَاؤُهَا قَالَ فَضَالَّةُ الْغَنَمِ؟ قَالَ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ قَالَ فَمَنْ أَخَذَهَا مِنْ مَرْتَعِهَا؟ قَالَ عُوقِبَ وَغُرِّمَ مِثْلَ ثَمَنِهَا وَمَنِ اسْتَطْلَقَهَا مِنْ عِقَالٍ أَوِ اسْتَخْرَجَهَا مِنْ حِفْشٍ وَهِيَ الْمَظَالُّ فَعَلَيْهِ الْقَطْعُ قَالَ يَا رَسُولَ اللهِ فَالثَّمَرُ يُصَابُ فِي أَكْمَامِهِ؟ فَقَالَ رَسُولُ اللهِ ﷺ لَيْسَ عَلَى آكِلٍ سَبِيلٌ فَمَنِ اتَّخَذَ خُبْنَةً غُرِّمَ مِثْلَ ثَمَنِهَا وَعُوقِبَ وَمَنْ أَخَذَ شَيْئًا مِنْهَا بَعْدَ أَنْ أَوَى إِلَى مِرْبَدٍ أَوْ كَسَرَ عَنْهَا بَابًا فَبَلَغَ مَا يَأْخُذُثَمَنَ الْمِجَنِّ فَعَلَيْهِ الْقَطْعُ قَالَ يَا رَسُولَ اللهِ فَالْكَنْزُ نَجِدُهُ فِي الْخَرِبِ وَفِي الْآرَامِ؟ فَقَالَ رَسُولُ اللهِ ﷺ فِيهِ وَفِي الرِّكَازِ الْخُمُسُ
