Prohibition of meeting caravans and the option in buying a musarrah

ahmad:18821 – Wakīʿ > Muḥammad b. Jaʿfar > Shuʿbah > al-Ḥakam > ʿAbd al-Raḥmān b. Abī Laylā > rajul min aṣḥāb al-Nabī ﷺ

[AI] The Messenger of Allah ﷺ said, "Do not meet the caravans." Ibn Jafar said: "No incoming goods are to be met, and no town-dweller should sell for a desert-dweller, and whoever buys a musarrah has the latter of the two options." And Ibn Jafar said: one of the two options. "If he returns it, he returns with it a sa of food or a sa of dates."

أحمد:١٨٨٢١ – حَدَّثَنَا وَكِيعٌ وَمُحَمَّدُ بْنُ جَعْفَرٍ قَالَا حَدَّثَنَا شُعْبَةُ عَنِ الْحَكَمِ عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي لَيْلَى قَالَ ابْنُ جَعْفَرٍ سَمِعْتُ ابْنَ أَبِي لَيْلَى عَنْ رَجُلٍ مِنْ أَصْحَابِ النَّبِيِّ ﷺ قَالَ

قَالَ رَسُولُ اللهِ ﷺ: «لَا تَلَقَّوْا الرُّكْبَانَ». قَالَ ابْنُ جَعْفَرٍ: «لَا يُتَلَقَّى جَلَبٌ، وَلَا يَبِعْحَاضِرٌ لِبَادٍ، وَمَنْ اشْتَرَى مُصَرَّاةً فَهُوَ فِيهَا بِآخِرِ النَّظَرَيْنِ». وَقَالَ ابْنُ جَعْفَرٍ: بِأَحَدِ النَّظَرَيْنِ. «إِنْ رَدَّهَا رَدَّ مَعَهَا صَاعًا مِنْ طَعَامٍ أَوْ صَاعًا مِنْ تَمْرٍ».

Whoever buys a sheep whose udder has been tied up, or a camel - Shu'bah said: he only said "camel" one time - then he has the choice after he milks it. If he returns it, he returns with it a sa' of food. Al-Hakam said: or he said, "a sa' of dates."
