٤٤۔١ فصل

ذِكْرُ الْإِخْبَارِ عَنْ أَكْلِ مَا يَجُوزُ اسْتِعْمَالُهُ مِمَّا حَبَسَ الْكِلَابُ عَلَى أَرْبَابِهَا

I came to Messenger of Allah ﷺ and said: Messenger of Allah, we are in the land of the People of the Book, (so) we eat in their utensils, and (live) in a hunting region. where I hunt with, the help of my bow, and hunt with my trained dog, or with my dog which is not trained. So inform me what is lawful (Halal) for us out of that. He (the Holy Prophet) said: Regarding what you have mentioned of the fact that you live in the land belonging to the People of the Book and so you eat in their utensils, but if you can get utensils other than theirs, then don't eat in them; but if you do not find any, then wash them and eat in them. And regarding what you have mentioned about (your living) in a hunting region, what you hunt, (strike) with the help of your bow, recite the name of Allah (while shooting an arrow) and then eat; and what you catch with the help of your trained dog, recite the name of Allah (while letting oil) the dog and then eat it, and what you get with the help of your untrained dog, (if you find it alive) and slaughter it (according to the law of the Shari'ah), eat it. ابن حبّان:٥٨٧٩أَخْبَرَنَا مُحَمَّدُ بْنُ الْحَسَنِ بْنِ قُتَيْبَةَ قَالَ حَدَّثَنَا حَرْمَلَةُ بْنُ يَحْيَى قَالَ حَدَّثَنَا ابْنُ وَهْبٍ قَالَ أَخْبَرَنِي حَيْوَةُ بْنُ شُرَيْحٍ قَالَ سَمِعْتُ رَبِيعَةَ بْنَ يَزِيدَ الدِّمَشْقِيَّ يَقُولُ سَمِعْتُ أَبَا إِدْرِيسَ الْخَوْلَانِيَّ

أَنَّهُ سَمِعَ أَبَا ثَعْلَبَةَ الْخُشَنِيَّ يَقُولُ أَتَيْتُ رَسُولَ اللَّهِ ﷺ فَقُلْتُ يَا رَسُولَ اللَّهِ إِنَّا بِأَرْضٍ مِنْ أَهْلِ كِتَابٍ نَأْكُلُ فِي آنِيَتِهِمْ وَإِنَّ أَرْضَنَا أَرْضُ صَيْدٍ أَصِيدُ بِقَوْسِي وَبِالْكَلْبِ الْمُكَلَّبِ وَبِالْكَلْبِ الَّذِي لَيْسَ بِمُكَلَّبٍ فَأَخْبِرْنِي مَاذَا يَحِلُّ لَنَا مِمَّا يَحْرُمُ عَلَيَّ مِنْ ذَلِكَ؟ فَقَالَ رَسُولُ اللَّهِ ﷺ «أَمَّا مَا ذَكَرْتَ أَنَّكُمْ بِأَرْضِ أَهْلِ كِتَابٍ تَأْكُلُونَ فِي آنِيَتِهِمْ فَإِنْ وَجَدْتُمْ غَيْرَ آنِيَتِهِمْ فَلَا تَأْكُلُوا فِيهَا وَإِنْ لَمْ تَجِدُوا غَيْرَ آنِيَتِهِمْ فَاغْسِلُوهَا وَكُلُوا فِيهَا وَأَمَّا مَا ذَكَرْتَ مِنَ الصَّيْدِ فَمَا صِدْتَ بِقَوْسِكَ فَكُلْ مِنْهُ وَاذْكُرِ اسْمَ اللَّهِ عَلَيْهِ وَأَمَّا مَا أَصَابَ كَلْبُكَ الْمُكَلَّبُ فَكُلْ مِمَّا أَمْسَكَ عَلَيْكَ وَاذْكُرِ اسْمَ اللَّهِ عَلَيْهِ وَأَمَّا مَا أَصَابَ كَلْبُكَ الَّذِي لَيْسَ بِمُكَلَّبٍ فَإِنْ أَدْرَكْتَ ذَكَاتَهُ فَكُلْ وَمَا لَمْ تُدْرِكْ ذَكَاتَهُ فَلَا تَأْكُلْ»  

ذِكْرُ الْإِخْبَارِ عَمَّا لَا يَجُوزُ أَكْلُهُ مِنَ الصَّيْدِ الَّذِي صِيدَ بِالْقِسِيِّ وَالْكِلَابِ الْمُعَلَّمَةِ

[Machine] Adi bin Hatim asked the Prophet ﷺ and said, "I shoot my arrow and it strikes the game, but I am unable to reach it until a day or two later." The Prophet said, "If you have the ability to reach it and there is no mark or injury on it except for your arrow, then it is permissible for you to eat it. But if you find a mark on it other than your arrow, then do not eat it. And if you send your dog and mention the name of Allah upon it, and you find it before it kills the game, then slaughter it. But if you find it after it has killed the game and it has not eaten from it, then you may eat it. And if you find it after it has eaten from it, then do not eat it, for it has held it for itself." Adi said, "I send my dogs and mention the name of Allah, and they mix with other dogs, so they take the game and kill it." The Prophet said, "Do not eat it, for you do not know whether it was killed by your dogs or by other dogs."  

ابن حبّان:٥٨٨٠أَخْبَرَنَا أَحْمَدُ بْنُ عَلِيِّ بْنِ الْمُثَنَّى قَالَ حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ عُمَرَ الْقَوَارِيرِيُّ قَالَ حَدَّثَنَا عَبَّادُ بْنُ عَبَّادٍ قَالَ حَدَّثَنَا عَاصِمٌ عَنِ الشَّعْبِيِّ

أَنَّ عَدِيَّ بْنَ حَاتِمٍ سَأَلَ النَّبِيَّ ﷺ فَقَالَ أَرْمِي بِسَهْمِي فَأُصِيبُ فَلَا أَقْدِرُ عَلَيْهِ إِلَّا بَعْدَ يَوْمٍ أَوِ اثْنَيْنِ قَالَ «إِنْ قَدَرْتَ عَلَيْهِ وَلَيْسَ بِهِ أَثَرٌ وَلَا خَدْشٌ إِلَّا رَمْيَتُكَ فَكُلْ وَإِنْ وَجَدْتَ بِهِ أَثَرًا غَيْرَ رَمْيَتِكَ فَلَا تَأْكُلْهُ وَإِنْ أَرْسَلْتَ كَلْبَكَ وَذَكَرْتَ اسْمَ اللَّهِ عَلَيْهِ فَأَدْرَكْتَهُ قَبْلَ أَنْ يَقْتُلَهُ فَذَكِّهِ وَإِنْ أَدْرَكْتَهُ قَدْ قَتَلَهُ وَلَمْ يَأْكُلْ مِنْهُ شَيْئًا فَكُلْهُ وَإِنْ أَدْرَكْتَهُ وَقَدْ أَكَلَ مِنْهُ فَلَا تَأْكُلْ فَإِنَّهُ إِنَّمَا أَمْسَكَ عَلَى نَفْسِهِ» قَالَ عَدِيٌّ فَإِنِّي أُرْسِلُ كِلَابِي وَأَذْكُرُ اسْمَ اللَّهِ فَتَخْتَلِطُ بِكِلَابِ غَيْرِي فَيَأْخُذْنَ الصَّيْدَ فَيَقْتُلْنَهُ قَالَ «فَلَا تَأْكُلْ فَإِنَّكَ لَا تَدْرِي كِلَابُكَ قَتَلَتْهُ أَمْ كِلَابُ غَيْرِكَ»  

ذِكْرُ الْإِبَاحَةِ لِلْمَرْءِ أَكْلَ مَا حَبَسَ عَلَيْهِ كَلْبُهُ الْمُعَلِّمُ إِذَا ذَكَرَ اسْمَ اللَّهِ عَلَيْهِ

I said: Messenger of Allah, I set off trained dogs and they catch for me (the game) and I recite the name of Allah over it (I slaughter the game by reciting Bismillah-i-Allah-o-Akbar), whereupon he said: When you set off your trained dogs, if you recited the name of Allah (while setting them off), then eat (the game). I said: Even if they (the trained dogs) kill that (the game)? He (the Holy Prophet) said: Even if these kill, but (on the condition) that no other dog, which you did not set off (along with your dogs), participates (in catching the game). I said to him: I throw Mi'rad, a heavy featherless blunt arrow, for hunting and killing (the game). Thereupon he said: When you throw Mi'rad, and it pierces, then eat, but if it falls flatly (and beats the game to death), then do not eat that. (Using translation from Muslim 1929a)  

ابن حبّان:٥٨٨١أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدٍ الْأَزْدِيُّ قَالَ حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ قَالَ أَخْبَرَنَا جَرِيرٌ عَنْ مَنْصُورٍ عَنْ إِبْرَاهِيمَ عَنْ هَمَّامِ بْنِ الْحَارِثِ عَنْ عَدِيِّ بْنِ حَاتِمٍ قَالَ

قُلْتُ يَا رَسُولَ اللَّهِ إِنِّي أُرْسِلُ الْكِلَابَ الْمُعَلَّمَةَ فَيُمْسِكْنَ عَلَيَّ وَأَذْكُرُ اسْمَ اللَّهِ عَلَيْهِ قَالَ «إِذَا أَرْسَلْتَ كَلْبَكَ الْمُعَلِّمَ وَذَكَرْتَ اسْمَ اللَّهِ عَلَيْهِ فَكُلْ» قُلْتُ وَإِنْ قَتَلْنَ؟ قَالَ «وَإِنْ قَتَلْنَ مَا لَمْ يَشْرَكْهَا كَلْبٌ لَيْسَ مَعَهَا» قُلْتُ لَهُ فَإِنِّي أَرْمِي بِالْمِعْرَاضِ الصَّيْدَ فَأُصِيبُ قَالَ «إِذَا رَمَيْتَ بِالْمِعْرَاضِ فَخَزَقَ فَكُلْهُ وَإِنْ أَصَابَهُ بِعَرْضِهِ فَلَا تَأْكُلْهُ»  

ذِكْرُ مَا يُحْكَمُ لِمَنِ اصْطَادَ الصَّيْدَ فَانْفَلَتَ مِنْهُ بِشَبَكَتِهِ، فَظَفِرَ بِهِ آخَرُ غَيْرُهُ

[Machine] I heard my father, who had lived during the time of ignorance and embraced Islam, say, "I set traps with nets for hares, and one of them fell into my trap. It escaped, and I followed it until I found a man who had taken hold of it. We disputed over it until we came to the Messenger of Allah ﷺ . We found him sitting among the nets, under a tree seeking shade, and we presented our case to him. The Messenger of Allah ﷺ ruled between us and divided the hare into two parts. I said, 'O Messenger of Allah, we will encounter some camels with sore backs and they are in need.' He said, 'Call the owner of the camels three times; if he comes, give them to him, and if not, untie them and let them drink water, then tie them and leave the milk for their young.' I asked, 'O Messenger of Allah, should we expect a reward if we give them water?' He replied, 'Yes, in every living creature with a liver, there is a reward.' Then the Messenger of Allah ﷺ started talking to us and said, 'A time will come upon people when the best wealth they will have is sheep grazing between the two mosques, eating from the trees and drinking from their containers. The shepherd will consume the milk and wear clothes made from their wool.' He may have said, 'from their hair.' And trials will arise, spreading like the traces of a camel's hoof amongst the Arabs, and by Allah.' I said, 'O Messenger of Allah, advise me.' He said, 'Perform the prayer, pay the Zakah, observe fasting during Ramadan, perform Hajj to the House, perform Umrah, be dutiful to your parents, maintain ties of kinship, receive guests, enjoin what is good, forbid what is evil, and follow the truth wherever it leads you.'"  

ابن حبّان:٥٨٨٢أَخْبَرَنَا أَحْمَدُ بْنُ عَلِيِّ بْنِ الْمُثَنَّى حَدَّثَنَا مُحَمَّدُ بْنُ عَبَّادٍ الْمَكِّيُّ حَدَّثَنَا مُحَمَّدُ بْنُ سُلَيْمَانَ بْنِ مَسْمُولٍ قَالَ سَمِعْتُ الْقَاسِمَ بْنَ مُخَوَّلٍ الْبَهْزِيَّ* ثُمَّ السُّلَمِيَّ قَالَ

سَمِعْتُ أَبِيَ وَكَانَ قَدْ أَدْرَكَ الْجَاهِلِيَّةَ وَالْإِسْلَامَ يَقُولُ نَصَبْتُ حَبَائِلَ لِي بِالْأَبْوَاءِ فَوَقَعَ فِي حَبْلِي مِنْهَا ظَبْيٌ فَأَفْلَتَ بِهِ فَخَرَجْتُ فِي إِثْرِهِ فَوَجَدْتُ رَجُلًا قَدْ أَخَذَهُ فَتَنَازَعْنَا فِيهِ إِلَى رَسُولِ اللَّهِ ﷺ فَوَجَدْنَاهُ نَازِلًا بِالْأَبْوَاءِ تَحْتَ شَجَرَةٍ يَسْتَظِلُّ بِنِطَعٍ فَاخْتَصَمْنَا إِلَيْهِ فَقَضَى رَسُولُ اللَّهِ ﷺ بَيْنَنَا شَطْرَيْنَ قُلْتُ يَا رَسُولَ اللَّهِ نَلْقَى الْإِبِلَ وَبِهَا لَبُونٌ وَهِيَ مُصَرَّاةٌ وَهُمْ مُحْتَاجُونَ قَالَ «فَنَادِ صَاحِبَ الْإِبِلِ ثَلَاثًا فَإِنْ جَاءَ وَإِلَّا فَاحْلُلْ صِرَارَهَا ثُمَّ اشْرَبْ ثُمَّ صُرَّ وَأَبْقِ لِلَّبَنِ دَوَاعِيَهُ» قُلْتُ يَا رَسُولَ اللَّهِ الضَّوَالُّ تَرِدُ عَلَيْنَا هَلْ لَنَا أَجْرٌ أَنْ نَسْقِيَهَا؟ قَالَ «نَعَمْ فِي كُلِّ ذَاتِ كَبِدٍ حَرَّى أَجْرٌ» ثُمَّ أَنْشَأَ رَسُولُ اللَّهِ ﷺ يُحَدِّثُنَا قَالَ «سَيَأْتِي عَلَى النَّاسِ زَمَانٌ خَيْرُ الْمَالِ فِيهِ غَنَمٌ بَيْنَ الْمَسْجِدَيْنِ تَأْكُلُ مِنَ الشَّجَرِ وَتَرِدُ الْمَاءَ يَأْكُلُ صَاحِبُهَا مِنْ رِسْلِهَا وَيَشْرَبُ مِنْ لِبَانِهَا وَيَلْبسُ مِنْ أَصْوَافَهَا» أَوْ قَالَ «مِنَ أَشْعَارِهَا وَالْفِتَنُ تَرْتَكِسُ بَيْنَ جَرَاثِيمِ الْعَرَبِ وَاللَّهِ» قُلْتُ يَا رَسُولَ اللَّهِ أَوْصِنِي قَالَ «أَقِمِ الصَّلَاةَ وَآتِ الزَّكَاةَ وَصُمْ رَمَضَانَ وَحُجَّ الْبَيْتَ وَاعْتَمِرْ وَبِرَّ وَالِدَيْكَ وَصِلْ رَحِمَكَ وَاقْرِ الضَّيْفَ وَمُرْ بِالْمَعْرُوفِ وَانْهَ عَنِ الْمُنْكَرِ وَزُلْ مَعَ الْحَقِّ حَيْثُ زَالَ»
