[Machine] Did any of you hear from the Prophet ﷺ about a fetus? Then Al-Mughirah bin Shu'bah stood up and said, "He passed a judgment regarding a male or female servant." The people started to ask each other about it, so Al-Maqdiyy stood up and said, "The Prophet ﷺ made a judgment for me regarding a male or female servant." The people started asking each other about it, then he (Al-Maqdiyy) said, "The Prophet ﷺ passed a judgment regarding a black slave of mine." I said, "Can I pass judgment concerning him when he neither ate, nor drank, nor talked?" and he said, "If you pass judgment regarding him, he will be the most deserving of it, as the Prophet ﷺ was inclined towards him with something." I said, "Is there a sign?" 'Umar said, "If it was not for what I heard from the Prophet ﷺ regarding the judgment, I would have made it a blood money between two parties."  

الدارمي:٦٦٨أَخْبَرَنَا مُحَمَّدُ بْنُ حُمَيْدٍ حَدَّثَنَا هَارُونُ بْنُ الْمُغِيرَةِ عَنْ عَنْبَسَةَ بْنِ سَعِيدٍ عَنْ خَالِدِ بْنِ زَيْدٍ الْأَنْصَارِيِّ عَنْ عَقَّارِ بْنِ الْمُغِيرَةِ بْنِ شُعْبَةَ عَنْ أَبِيهِ الْمُغِيرَةِ بْنِ شُعْبَةَ قَالَ نَشَدَ عُمَرُ النَّاسَ

أَسَمِعَ مِنَ النَّبِيِّ ﷺ أَحَدٌ مِنْكُمْ فِي الْجَنِينِ؟ فَقَامَ الْمُغِيرَةُ بْنُ شُعْبَةَ فَقَالَ قَضَى فِيهِ عَبْدًا أَوْ أَمَةً فَنَشَدَ النَّاسَ أَيْضًا فَقَامَ الْمَقْضِيُّ لَهُ فَقَالَ قَضَى النَّبِيُّ ﷺ لِي بِهِ عَبْدًا أَوْ أَمَةً فَنَشَدَ النَّاسَ أَيْضًا فَقَامَ الْمَقْضِيُّ عَلَيْهِ فَقَالَ قَضَى النَّبِيُّ ﷺ عَلَيَّ غُرَّةً عَبْدًا أَوْ أَمَةً فَقُلْتُ أَتَقْضِي عَلَيَّ فِيهِ فِيمَا لَا أَكَلَ وَلَا شَرِبَ وَلَا اسْتَهَلَّ وَلَا نَطَقَ إِنْ تُطِلَّهُ فَهُوَ أَحَقُّ مَا يُطَلُّ فَهَوَى النَّبِيُّ ﷺ إِلَيْهِ بِشَيْءٍ مَعَهُ فَقَالَ «أَشِعْرٌ» فَقَالَ عُمَرُ لَوْلَا مَا بَلَغَنِي مِنْ قَضَاءِ النَّبِيِّ ﷺ لَجَعَلْتُهُ دِيَةً بَيْنَ دِيَتَيْنِ
