87.29 No Diya for the one killed by an animal
٨٧۔٢٩ باب الْعَجْمَاءُ جُبَارٌ
[Machine] Ibn Sirin said, "They used to not gather fragrance, but they would gather strength." Hammad said, "A breeze does not gather fragrance unless a person affects the animal." Shurayh said, "Do not gather what will be retaliated against and struck with its own leg." Al-Hakam and Hammad said, "If the driver pushes a donkey when a woman is riding it and she falls off, then there is nothing on him." Al-Sha'bi said, "If one drives an animal and causes it to tire, then he is responsible for what it suffers, but if there is someone behind it urging it on, then he is not responsible."
وَقَالَ ابْنُ سِيرِينَ كَانُوا لاَ يُضَمِّنُونَ مِنَ النَّفْحَةِ وَيُضَمِّنُونَ مِنْ رَدِّ الْعِنَانِ. وَقَالَ حَمَّادٌ لاَ تُضْمَنُ النَّفْحَةُ إِلاَّ أَنْ يَنْخُسَ إِنْسَانٌ الدَّابَّةَ. وَقَالَ شُرَيْحٌ لاَ تُضْمَنُ مَا عَاقَبَتْ أَنْ يَضْرِبَهَا فَتَضْرِبَ بِرِجْلِهَا. وَقَالَ الْحَكَمُ وَحَمَّادٌ إِذَا سَاقَ الْمُكَارِي حِمَارًا عَلَيْهِ امْرَأَةٌ فَتَخِرُّ، لاَ شَيْءَ عَلَيْهِ. وَقَالَ الشَّعْبِيُّ إِذَا سَاقَ دَابَّةً فَأَتْعَبَهَا فَهْوَ ضَامِنٌ لِمَا أَصَابَتْ، وَإِنْ كَانَ خَلْفَهَا مُتَرَسِّلاً لَمْ يَضْمَنْ.
