[Machine] "Let him have from the money what was agreed upon with them. Al-Shafi'i (May Allah have mercy on him) said, and we take from this that no one of the partners in the partnerships should take anything from the profits without the consent of its owner."  

البيهقي:٢١٦٩٨ – أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ أَخْبَرَنَا الشَّافِعِيُّ أنبأ عَبْدُ اللهِ بْنُ الْحَارِثِ عَنِ ابْنِ جُرَيْجٍ قَالَ قُلْتُ لِعَطَاءٍ مُكَاتَبٌ بَيْنَ قَوْمٍ فَأَرَادُوا أَنْ يُقَاطِعَ بَعْضَهُمْ قَالَ لَا إِلَّا

أَنْ يَكُونَ لَهُ مِنَ الْمَالِ مِثْلُ مَا قَاطَعَ عَلَيْهِ هَؤُلَاءِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَبِهَذَا نَأْخُذُ فَلَا يَكُونُ لِأَحَدِ الشُّرَكَاءِ فِي الْمُكَاتَبِ أَنْ يَأْخُذَ مِنَ الْمُكَاتَبِ شَيْئًا دُونَ صَاحِبِهِ
