البيهقي:٢١٢٤٨ – أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ قَالَ قَالَ الشَّافِعِيُّ قَالَ حَفْصُ بْنُ غِيَاثٍ عَنِ ابْنِ أَبِي لَيْلَى عَنِ الْحَكَمِ عَنْ حَنَشٍ أَنَّ عَلِيًّا ؓ كَانَ يَرَى الْحَلِفَ مَعَ الْبَيِّنَةِ كَذَا رَوَاهُ مُحَمَّدُ بْنُ عَبْدِ الرَّحْمَنِ بْنِ أَبِي لَيْلَى وَقَدْ رُوِّينَا فِيمَا مَضَى مِنْ وَجْهٍ آخَرَ عَنْ حَنَشٍ عَنْ عَلِيٍّ ؓ

أَنَّهُ إِنَّمَا رَآهُ عِنْدَ تَعَارُضِ الْبَيِّنَتَيْنِ وَاللهُ أَعْلَمُ
