البيهقي:٢١٢٤٥ – أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو الْوَلِيدِ الْفَقِيهُ ثنا الْحَسَنُ بْنُ سُفْيَانَ ثنا حِبَّانُ بْنُ مُوسَى عَنِ ابْنِ الْمُبَارَكِ عَنْ عَبْدِ الْمَلِكِ بْنِ أَبِي سُلَيْمَانَ قَالَ قِيلَ لِعَطَاءٍ أَتَقْضِي بِالْأُصُولِ فِي الدُّورِ؟ قَالَ نَعَمْ إِذَا قَامَتِ الْبَيِّنَةُ أَنَّهَا دَارُهُ لَمْ يَبِعْ وَلَمْ يَهَبْ وَرُوِّينَا عَنْ عَطَاءٍ أَنَّهُ قَالَ أَدْرَكْتُ النَّاسَ يَقْضُونَ بِالْأُصُولِ فِي الدُّورِ

وَعَنْ شُرَيْحٍ وَعَامِرٍ الشَّعْبِيِّ أَنَّهُمَا كَانَا يَقْضِيَانِ بِالْأَصْلِ فِي الدُّورِ
