[Machine] The sheikh may Allah have mercy on him and this is something that he has gone to commendably. Likewise, what we have narrated from al-Qasim ibn Muhammad that he said: When a sinful man accuses a righteous man of something that people see as a lie and there has been no interaction between them to necessitate it, and the hadiths that we have mentioned contradict it, ash-Shafi'i (may Allah have mercy on him) said in his book al-Da'wah: The oath is upon the claimant against whom the claim is made, regardless of whether there has been interaction between them or not.
الشَّيْخُ رَحِمَهُ اللهُ وَهَذَا شَيْءٌ ذَهَبَ إِلَيْهِ عَلَى وَجْهِ الِاسْتِحْسَانِ وَكَذَلِكَ مَا رُوِّينَا عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ أَنَّهُ قَالَ إِذَا ادَّعَى الرَّجُلُ الْفَاجِرُ عَلَى الرَّجُلِ الصَّالِحِ الشَّيْءَ الَّذِيُ يَرَى النَّاسُ أَنَّهُ كَاذِبٌ وَأَنَّهُ لَمْ يَكُنْ بَيْنَهُمَا مُعَامَلَةٌ لَمْ يُسْتَحْلَفْ لَهُ وَالْأَحَادِيثُ الَّتِي ذَكَرْنَاهَا تُخَالِفُهُ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ فِي كِتَابِ الدَّعْوَى الْيَمِينُ عَلَى الْمُدَّعَى عَلَيْهِ سَوَاءٌ كَانَتْ بَيْنَهُمَا مُخَالَطَةٌ أَوْ لَمْ تَكُنْ
