[Machine] "Allah said: 'If there is no clear evidence for the seeker, then the liability is on the one being sought after to swear an oath. We narrated the hadith of evidence to the claimant, and the oath is upon the accused from various perspectives, all of which are weak. And what we mentioned is sufficient. Abu Tahir Al-Faqih informed us that Ahmad ibn Muhammad ibn Yahya informed us that Yahya ibn Al-Rabee' Al-Makki narrated to us from Sufyan ibn Uyaynah from Idris Al-Awdi who said: Sa'id bin Abi Burdah brought us a book and said, 'This is a book from Umar to Abu Musa Al-Ash'ari.' And he mentioned in it the evidence for those who claim and the oath upon those who deny."  

اللهِ ﷺ قَالَ إِذَا لَمْ يَكُنْ لِلطَّالِبِ بَيِّنَةٌ فَعَلَى الْمَطْلُوبِ الْيَمِينُ رُوِّينَا حَدِيثَ الْبَيِّنَةُ عَلَى الْمُدَّعِي وَالْيَمِينُ عَلَى الْمُدَّعَى عَلَيْهِ مِنْ أَوْجُهٍ أُخَرَ كُلُّهَا ضَعِيفَةٌ وَفِيمَا ذَكَرْنَاهُ كِفَايَةٌ 21207 حَدَّثَنَا أَبُو طَاهِرٍ الْفَقِيهُ أنبأ أَحْمَدُ بْنُ مُحَمَّدِ بْنِ يَحْيَى ثنا يَحْيَى بْنُ الرَّبِيعِ الْمَكِّيُّ ثنا سُفْيَانُ بْنُ عُيَيْنَةَ عَنْ إِدْرِيسَ الْأَوْدِيِّ قَالَ أَخْرَجَ إِلَيْنَا سَعِيدُ بْنُ أَبِي بُرْدَةَ كِتَابًا وَقَالَ هَذَا كِتَابُ عُمَرَ إِلَى أَبِي مُوسَى الْأَشْعَرِيِّ ؓ فَذَكَرَهُ وَفِيهِ الْبَيِّنَةُ عَلَى مَنِ ادَّعَى وَالْيَمِينُ عَلَى مَنْ أَنْكَرَ
