البيهقي:١٥١٦٥ – وَقَدْ أَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ أنا إِسْمَاعِيلُ بْنُ مُحَمَّدٍ الصَّفَّارُ نا الْحَسَنُ بْنُ عَلِيِّ بْنِ عَفَّانَ نا عَبْدُ اللهِ بْنُ نُمَيْرٍ ح وَأَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ وَأَبُو بَكْرِ بْنُ الْحَارِثِ قَالَا أنا عَلِيُّ بْنُ عُمَرَ الْحَافِظُ نا أَبُو بَكْرٍ النَّيْسَابُورِيُّ نا أَبُو الْأَزْهَرِ نا عَبْدُ اللهِ بْنُ نُمَيْرٍ نا عُبَيْدُ اللهِ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ ؓ فِي الْأَمَةِ تَكُونُ تَحْتَ الْحُرِّ تَبِينُ بِتَطْلِيقَتَيْنِ وَتَعْتَدُّ حَيْضَتَيْنِ وَإِذَا كَانَتِ الْحُرَّةُ تَحْتَ الْعَبْدِ بَانَتْ بِتَطْلِيقَتَيْنِ وَتَعْتَدُّ ثَلَاثَ حِيَضٍ وَكَذَلِكَ رَوَاهُ سَالِمٌ عَنِ ابْنِ عُمَرَ فَمَذْهَبُهُ فِي ذَلِكَ

أَنَّ أَيَّهُمَا رَقَّ نَقَصَ الطَّلَاقُ بِرِقِّهِ هَذَا هُوَ مَذْهَبُ ابْنِ عُمَرَ ؓ فِي ذَلِكَ
