[Machine] Abu Ubayd, may Allah have mercy on him, said: "Some of them say 'al-haqaq' which means 'dispute'. It means that the umm al-asabah (the maternal aunt) is disputed among them. So the correct understanding is that it is only perception, because it is the ultimate limit of infancy. Therefore, when women reach that limit, the asabah (the paternal aunt) is more entitled to the woman than her mother if they are forbidden (marriage-wise), and they can also marry her if they wish. And this makes it clear to you that the asabah and the guardians other than the fathers have no right to marry the orphan girl until she reaches that limit. Even if they had that right, they would not wait for her to reach the limit, according to the correct understanding. And whoever  

البيهقي:١٣٦٩٦أَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ أنبأ أَبُو الْحَسَنِ الْكَارِزِيُّ ثنا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ قَالَ

قَالَ أَبُو عُبَيْدٍ رَحِمَهُ اللهُ بَعْضُهُمْ يَقُولُ الْحَقَاقُ وَهُوَ مِنَ الْمُحَاقَّةِ يَعْنِي الْمُخَاصَمَةَ أَنْ تُحَاقَّ الْأُمُّ الْعَصَبَةَ فِيهِنَّ فَنَصُّ الْحَقَاقِ إِنَّمَا هُوَ الْإِدْرَاكُ؛ لِأَنَّهُ مُنْتَهَى الصِّغَرِ فَإِذَا بَلَغَ النِّسَاءُ ذَلِكَ فَالْعَصَبَةُ أَوْلَى بِالْمَرْأَةِ مِنْ أُمِّهَا إِذَا كَانُوا مَحْرَمًا وَيَتَزَوَّجُهَا أَيْضًا إِنْ أَرَادُوا قَالَ وَهَذَا يُبَيِّنُ لَكَ أَنَّ الْعَصَبَةَ وَالْأَوْلِيَاءَ غَيْرَ الْآبَاءِ لَيْسَ لَهُمْ أَنْ يُزَوِّجُوا الْيَتِيمَةَ حَتَّى تُدْرِكَ وَلَوْ كَانَ لَهُمْ ذَاكَ لَمْ يَنْتَظِرُوا بِهَا نَصَّ الْحَقَاقِ قَالَ وَمَنْ  

رَوَاهُ نَصَّ الْحَقَائِقِ فَإِنَّهُ أَرَادَ جَمْعَ حَقِيقَةٍ
