البيهقي:١٢٦٥٧ – أَخْبَرَنَا أَبُو أَحْمَدَ الْمِهْرَجَانِيُّ أنا أَبُو بَكْرٍ مُحَمَّدُ بْنُ جَعْفَرٍ الْمُزَكِّي ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ حَدَّثَنَا ابْنُ بُكَيْرٍ ثنا مَالِكٌ عَنْ عَبْدِ اللهِ بْنِ أَبِي بَكْرٍ عَنْ أَبِيهِ أَنَّ عَمْرَو بْنَ سُلَيْمٍ الزُّرَقِيَّ أَخْبَرَهُ أَنَّهُ قِيلَ لِعُمَرَ بْنِ الْخَطَّابِ ؓ إِنَّ هَا هُنَا غُلَامًا يَفَاعًا لَمْ يَحْتَلِمْ مِنْ غَسَّانَ وَوَارِثُهُ بِالشَّامِ وَهُوَ ذُو مَالٍ وَلَيْسَ لَهُ هَا هُنَا إِلَّا ابْنَةُ عَمٍّ لَهُ فَقَالَ عُمَرُ بْنُ الْخَطَّابِ ؓ فَلْيُوصِ لَهَا فَأَوْصَى لَهَا بِمَالٍ يُقَالُ لَهُ بِئْرُ جُشَمَ قَالَ عَمْرُو بْنُ سُلَيْمٍ فَبِعْتُ ذَلِكَ الْمَالَ بِثَلَاثِينَ أَلْفًا وَابْنَةُ عَمِّهِ الَّتِي أَوْصَى لَهَا هِيَ أُمُّ عَمْرِو بْنُ سُلَيْمٍ وَيُذْكَرُ عَنْ شُرَيْحٍ وَعَبْدِ اللهِ بْنِ عُتْبَةَ أَنَّهُمَا أَجَازَا وَصِيَّةَ الصَّغِيرِ وَقَالَا مَنْ أَصَابَ الْحَقَّ أَجَزْنَاهُ وَالشَّافِعِيُّ رَحِمَهُ اللهُ عَلَّقَ جَوَازَ وَصِيَّتِهِ وَتَدْبِيرِهِ بِثِبُوتِ الْخَبَرِ فِيهَا عَنْ عُمَرَ ؓ وَالْخَبَرُ مُنْقَطِعٌ؛ فَعَمْرُو بْنُ سُلَيْمٍ الزُّرَقِيُّ لَمْ يُدْرِكْ عُمَرَ ؓ إِلَّا

أَنَّهُ ذَكَرَ فِي الْخَبَرِ انْتِسَابَهُ إِلَى صَاحِبِ الْقِصَّةِ وَاللهُ أَعْلَمُ
