[Machine] About the jurists who hold the view among the people of Medina, they used to say, "Whoever wishes to allocate one third of his wealth to a wall, then he can place that wall wherever he desires." So, his inheritors say, "We do not approve of him having one third of the wall, rather he only has one third of his own wall." Thus, it is permissible for the testator to place one third of his wealth wherever he prefers, equivalent to its value. Only the wall is like the mount, the sword, or the garment. He can bequeath it without the heirs saying, "He only has one third of his mount, sword, or garment."
عَنِ الْفُقَهَاءِ الَّذِينَ يُنْتَهَى إِلَى قَوْلِهِمْ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ مَنْ أَوْصَى أَنْ يُجْعَلَ ثُلُثُهُ فِي حَائِطٍ ثُمَّ سُبِّلَ ذَلِكَ الْحَائِطُ حَيْثُ أَرَادَهُ فَقَالَ وَرَثَتُهُ لَا نُجِيزُ إِنَّمَا لَهُ ثُلُثُ حَائِطِهِ فَذَلِكَ جَائِزٌ عَلَيْهِمُ الْمُوصِي يَضَعُ ثُلُثَهُ حَيْثُ أَحَبَّ مِنْ مَالِهِ بِقِيمَةِ الْعَدْلِ؛ إِنَّمَا الْحَائِطُ كَالرَّحْلِ أَوِ السَّيْفِ أَوِ الثَّوْبِ يُوصِي بِهِ لَيْسَ لِلْوَرَثَةِ أَنْ يَقُولَوا إِنَّمَا لَهُ ثُلُثُ رَحْلِهِ وَسَيْفِهِ وَثَوْبِهِ
