[Machine] Regarding the child of the cursed one and the child of adultery - who should inherit from them? They both said, "His mother should inherit her rights, and his siblings from his mother should inherit their rights. And the remaining of his wealth shall be inherited by the freed slaves of his mother, if she was a slave, or if she was an Arab, then she should inherit her rights, and his siblings from their mother should inherit their rights. And the remaining of his wealth shall be inherited by the Muslims." Malik (may Allah have mercy on him) said, "That is the ruling according to us, and it is what I have learned from the knowledgeable people in our land."  

البيهقي:١٢٤٩٦أَخْبَرَنَا أَبُو أَحْمَدَ الْمِهْرَجَانِيُّ أنا أَبُو بَكْرِ بْنُ جَعْفَرٍ الْمُزَكِّي ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ ثنا ابْنُ بُكَيْرٍ ثنا مَالِكٌ أَنَّهُ بَلَغَهُ عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ وَسُلَيْمَانَ بْنِ يَسَارٍ أَنَّهُمَا سُئِلَا

عَنْ وَلَدِ الْمُلَاعَنَةِ وَوَلَدِ الزِّنَا مَنْ يَرِثُهُ فَقَالَا تَرِثُهُ أُمُّهُ حَقَّهَا وَإِخْوَتُهُ مِنْ أُمِّهِ حُقُوقَهُمْ وَيَرِثُ مَا بَقِيَ مِنْ مَالِهِ مَوَالِي أُمِّهِ إِنْ كَانَتْ مَوْلَاةً وَإِنْ كَانَتْ عَرَبِيَّةً وَرِثَتْ حَقَّهَا وَوَرِثَ إِخْوَتُهُ مِنْ أُمِّهِمْ حُقُوقَهُمْ وَوَرِثَ مَا بَقِيَ مِنْ مَالِهِ الْمُسْلِمُونَ قَالَ مَالِكٌ رَحِمَهُ اللهُ وَذَلِكَ الْأَمْرُ عِنْدَنَا وَالَّذِي أَدْرَكْتُ عَلَيْهِ أَهْلَ الْعِلْمِ بِبَلَدِنَا

Yahya related to me from Malik that he had heard that Urwa ibn az-Zubayr said about the child of lian and the child of fornication, that if they died, the mother inherited her right from them according to the Book of Allah, the Mighty, the Majestic! The siblings by the mother had their rights. The rest was inherited by the former masters of the mother if she was a freed slave. If she was a free woman by origin, she inherited her due and the siblings by the mother inherited their due, and the rest went to the Muslims. Malik said, "I heard the same as that from Sulayman ibn Yasar." Malik said, "That is what I saw the people of knowledge in our city doing."  

مالك:٢٧-٢٤حَدَّثَنِي يَحْيَى عَنْ مَالِكٍ أَنَّهُ بَلَغَهُ

أَنَّ عُرْوَةَ بْنَ الزُّبَيْرِ كَانَ يَقُولُ فِي وَلَدِ الْمُلاَعَنَةِ وَوَلَدِ الزِّنَا إِنَّهُ إِذَا مَاتَ وَرِثَتْهُ أُمُّهُ حَقَّهَا فِي كِتَابِ اللَّهِ ﷻ وَإِخْوَتُهُ لأُمِّهِ حُقُوقَهُمْ وَيَرِثُ الْبَقِيَّةَ مَوَالِي أُمِّهِ إِنْ كَانَتْ مَوْلاَةً وَإِنْ كَانَتْ عَرَبِيَّةً وَرِثَتْ حَقَّهَا وَوَرِثَ إِخْوَتُهُ لأُمِّهِ حُقُوقَهُمْ وَكَانَ مَا بَقِيَ لِلْمُسْلِمِينَ قَالَ مَالِكٌ وَبَلَغَنِي عَنْ سُلَيْمَانَ بْنِ يَسَارٍ مِثْلُ ذَلِكَ قَالَ مَالِكٌ وَعَلَى ذَلِكَ أَدْرَكْتُ أَهْلَ الْعِلْمِ بِبَلَدِنَا

Yahya related to me from Malik that he had heard that ʿUrwa ibn az-Zubayr said that if the child of the woman against whom liʿan had been pronounced or the child of fornication, died, his mother inherited from him her right in the Book of Allah the Exalted, and his maternal half-brothers had their rights. The rest was inherited by the owners of his mother's wala' if she was a freed slave. If she was an ordinary free woman, she inherited her right, his maternal brothers inherited their rights, and the rest went to the Muslims. Malik said,"I heard the same as that from Sulayman ibn Yasar, and it is what I saw the people of knowledge in our city doing."
