البيهقي:١٠٧٤١ – وَأَخْبَرَنَا أَبُو بَكْرٍ مُحَمَّدُ بْنُ الْحَسَنِ بْنِ فُورَكٍ أنا عَبْدُ اللهِ بْنُ جَعْفَرٍ ثنا يُونُسُ بْنُ حَبِيبٍ ثنا أَبُو دَاوُدَ الطَّيَالِسِيُّ ثنا ابْنُ أَبِي ذِئْبٍ عَنْ مَخْلَدِ بْنِ خُفَافٍ الْغِفَارِيِّ قَالَ خَاصَمْتُ إِلَى عُمَرَ بْنِ عَبْدِ الْعَزِيزِ فِي عَبْدٍ دَلَّسَ لَنَا فَأَصَبْنَا مِنْ غَلَّتِهِ وَعِنْدَهُ عُرْوَةُ بْنُ الزُّبَيْرِ فَحَدَّثَهُ عُرْوَةُ عَنْ عَائِشَةَ

أَنَّ رَسُولَ اللهِ ﷺ قَضَى أَنَّ الْخَرَاجَ بِالضَّمَانِ وَبِهَذَا الْمَعْنَى  

رَوَاهُ الشَّافِعِيُّ عَمَّنْ لَا يُتَّهَمُ مِنْ أَهْلِ الْمَدِينَةِ عَنِ ابْنِ أَبِي ذِئْبٍ
