ahmad:5129Muḥammad b. Jaʿfar > Shuʿbah > Abū Isḥāq > a man from Ahl Najrān > Saʾalt Ibn ʿUmar > Innamā Asʾaluk > Shayʾayn

I asked Ibn ʿUmar and said: I am only asking you about two things: about salam (forward sale) of the date palm trees, and about the raisin and dates [mixture].

So he said that an intoxicated man was brought to the Messenger of Allah ﷺ who had drank a raisin and date mixture. He said that he was whipped according to the prescribed penalty and [thr Prohpet] forbade mixing of the two.

And a man sold a forward sale of date palms to another man, however, it did not bear any of its dates. He came asking for them but he refused to give him [his due]. They then came to the Prophet ﷺ so he said, “Did you date palms bear any fruit?”. He said: No. Then he said, “Why are you then consuming his wealth?” He said that [the Prophet] then ordered him and invalidated the sale and forbade the forward sale of date palms unless they have begun to bear fruit.  

أحمد:٥١٢٩حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ حَدَّثَنَا شُعْبَةَ سَمِعْتُ أَبَا إِسْحَاقَ سَمِعْتُ رَجُلًا مِنْ أَهْلِ نَجْرَانَ قَالَ

سَأَلْتُ ابْنَ عُمَرَ قُلْتُ إِنَّمَا أَسْأَلُكَ عَنْ شَيْئَيْنِ عَنِ السَّلَمِ فِي النَّخْلِ وَعَنِ الزَّبِيبِ وَالتَّمْرِ:

فَقَالَ: أُتِيَ رَسُولُ اللهِ ﷺ بِرَجُلٍ نَشْوَانَ قَدْ شَرِبَ زَبِيبًا وَتَمْرًا. قَالَ: فَجَلَدَهُ الْحَدَّ وَنَهَى أَنْ يُخْلَطَا.

قَالَ: وَأَسْلَمَ رَجُلٌ فِي نَخْلِ رَجُلٍ فَلَمْ يَحْمِلْ نَخْلُهُ. قَالَ: فَأَتَاهُ يَطْلُبُهُ، قَالَ: فَأَبَى أَنْ يُعْطِيَهُ. قَالَ: فَأَتَيَا النَّبِيَّ ﷺ فَقَالَ: «أَحَمَلَتْ نَخْلُكَ؟» قَالَ: لَا. قَالَ: «فَبِمَ تَأْكُلُ مَالَهُ؟» قَالَ: فَأَمَرَهُ فَرَدَّ عَلَيْهِ وَنَهَى عَنِ السَّلَمِ فِي النَّخْلِ حَتَّى يَبْدُوَ صَلَاحُهُ.

[Machine] "He asked Ibn Umar and said, 'I only ask you about two things: about raisins and dates, and about climbing palm trees.' Ibn Umar said, 'The Messenger of Allah ﷺ had someone brought to him who was drunk, and he said, 'I only drank raisin and date juice.' So he had him flogged, and he forbade him from having them anymore.' Ibn Umar said, 'A man gave his date-palm trees to another man, and he said to him, 'Your date-palm trees did not bear any fruit this year.' So he wanted to take his money, but the man did not give it to him. So he came to the Messenger of Allah ﷺ and he said, 'Your date-palm trees did not bear any fruit.' He said, 'So why did you keep his money?' So he gave it to him.' The Messenger of Allah ﷺ forbade climbing palm trees until their goodness becomes apparent."
