البيهقي:١٦٤٩٣أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَنْبَأَ أَبُو الْوَلِيدِ ثَنَا مُحَمَّدُ بْنُ هَارُونَ ثَنَا عُثْمَانُ بْنُ سَعِيدٍ ثَنَا أَحْمَدُ بْنُ يُونُسَ ثَنَا أَبُو شِهَابٍ عَنِ الْأَعْمَشِ عَنْ تَمِيمِ بْنِ سَلَمَةَ عَنْ شُرَيْحٍ قَالَ شَهِدَ عِنْدَ شُرَيْحٍ رَجُلَانِ فَقَالَا نَشْهَدُ أَنَّ هَذَا لَهَزَهُ بِمِرْفَقِهِ فِي حَلْقِهِ فَمَاتَ فَقَالَ أَتَشْهَدُونَ أَنَّهُ قَتَلَهُ؟ قَالَ الْأَعْمَشُ فَلَمْ يُجِزْهُ قَالَ الشَّيْخُ أَبُو الْوَلِيدِ قَالَ

أَصْحَابُنَا قَدْ يَكُونُ الضَّرْبُ وَلَا يَمُوتُ مِنْهُ فَلَمَّا لَمْ يَقُولَا قَتَلَهُ لَمْ يَحْكُمْ بِهِ
