[Machine] Bakr and Umar used to say that a believer should not be killed for his servant, but he should be punished and imprisoned, and his share of inheritance should be denied. The chains of these hadiths are weak and do not serve as evidence, except that most of the scholars agree that a man should not be killed for his servant, and we have narrated it from Sulaiman ibn Yasar, Sha'bi, Az-Zuhri, and others.
بَكْرٍ وَعُمَرَ ؓ ا كَانَا يَقُولَانِ لَا يُقْتَلُ الْمُؤْمِنُ بِعَبْدِهِ وَلَكِنْ يُضْرَبُ وَيُطَالُ حَبْسُهُ وَيُحْرَمُ سَهْمَهُ أَسَانِيدُ هَذِهِ الْأَحَادِيثِ ضَعِيفَةٌ لَا تَقُومُ بِشَيْءٍ مِنْهَا الْحُجَّةُ إِلَّا أَنَّ أَكْثَرَ أَهْلِ الْعِلْمِ عَلَى أَنْ لَا يُقْتَلَ الرَّجُلُ بِعَبْدِهِ وَقَدْ رُوِّينَاهُ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ وَالشَّعْبِيِّ وَالزُّهْرِيِّ وَغَيْرِهِمْ
